LONDON (AP) — Ireland’s Supreme Court has ruled that bread sold by the fast food chain Subway contains so much sugar that it cannot be legally defined as bread. The ruling came in a tax dispute brought by Bookfinders Ltd., an Irish Subway franchisee. The company argued that some of its takeaway products including including teas, coffees, and heated sandwiches, were not liable for value-added tax. A panel of judges rejected the appeal Tuesday, ruling that the bread sold by Subway contains too much sugar to be categorized as a “staple food,” which is not taxed. They said that the bread in Subway's heated sandwiches has a sugar content of 10% of the weight of the flour included in the dough, exceeding the 2% specified in the law.The law makes a distinction between “bread as a staple food” and other baked goods “which are, or approach, confectionery or fancy baked goods,” the judgement said.Bookfinders was appealing a 2006 decision by authorities who refused to refund value-added tax payments. Lower courts had dismissed the case before it reached the Supreme Court. 1085

LOS ANGELES (AP) — Orange County sheriff's deputies shot and killed a Black man Wednesday after he allegedly tried to grab one of their guns during a struggle. According to an Orange County Sheriff's Department press release, two deputies from the Homeless Outreach Team made contact with the man outside the Hotel Miramar in San Clemente. "During the contact, a physical altercation occurred. Surveillance video at the scene showed that during the physical altercation, the subject attempted to gain control of a deputy’s gun," the department said in the news release. "Shortly after, a deputy-involved shooting occurred. Deputies began lifesaving measures, and the subject was pronounced deceased at the scene."The latest killing of a Black person by law enforcement happened on the same day as the decision not to charge Kentucky police officers for Breonna Taylor's death was announced. Part of the incident Wednesday afternoon in San Clemente, California, was captured on video and posted to social media by the Southern Orange County Black Lives Matter group. The man's name has not been released by authorities. It's not clear from the video if the man tried to grab the firearm. 1194

LOS ANGELES (AP) — The western Joshua tree needs protection under the California Endangered Species Act because of threats from climate change and habitat destruction, the Center for Biological Diversity said in a petition Tuesday to the state's Fish and Game Commission.The petition comes amid rising concern about the future of the crazy-limbed trees with spikey leaves that have come to symbolize the Mojave Desert and draw throngs to Joshua Tree National Park."The state has to step up for these trees," center conservation director Brendan Cummings said in a statement.The petition asks that western Joshua trees be given "threatened" status under the act.The request states that the trees meet the definition of a plant that "is likely to become an endangered species in the foreseeable future in the absence of the special protection and management efforts."Researchers have found that Joshua trees are dying off due to hotter and drier conditions, and fewer young trees are surviving, according to the center, a nonprofit conservation organization based in Tucson, Arizona.The trees are migrating to higher elevations where there are cooler and more moist conditions, but they face destruction by fire due to invasive, non-native grasses in those locations.Joshua trees also face challenges due to urban sprawl in the desert as well degradation of habitat for energy projects, powerlines, pipelines and off-road-vehicle use.The western Joshua tree's habitat includes Joshua Tree National Park and stretches to the west along the north slopes of the San Bernardino and San Gabriel mountain ranges into the Antelope Valley, northward along the eastern flank of the southern Sierra Nevada and eastward toward the edge of Death Valley National Park and into Nevada.The eastern Joshua tree — a distinctly different plant — lives in the Mojave National Preserve and eastward into Nevada, Arizona and Utah.The Center for Biological Diversity said that under the California Endangered Species Act, the state Department of Fish and Wildlife has three months to make a recommendation to the Fish and Game Commission, which would then vote on the petition next year. 2171

  

LITTLETON, Colo. — Watch out! A Grinch is tip-toeing around outside windows of unsuspecting children, to bring delight and a moment of joy this holiday season.In a neighborhood full of Christmas cheer, the Grinch was ready to strike with fear. He didn’t exactly attempt to hide as the children sat inside.Dressed from head-to-toe as the Grinch, Ethan Hecker, 14, banged on the window of a home and was met with laughter and joy, but little did they know, he was there to steal their Christmas cheer.“My goal is to scare the kiddos, let them have some fun,” Hecker said.Allison Hecker, Ethan’s mom, came across a post online of a girl dressed up as the Grinch scaring kids and moving things around in the yard. Ethan says as soon as he saw it, he knew he wanted to do it himself and begged his mom for the costume.“Ethan loves the theatrics and kids and it was perfect,” she said.Hecker ordered the costume and it arrived on Monday. That same day, they posted on social media.“He is asking per visit--he will spend 5-7 minutes creeping around the outside of your home while your kids scream with excitement (or fear),” the Facebook post read.Hecker says they were flooded with requests for the Grinch to stop at homes and birthdays.“We’ve had 10 (bookings), so far and he has about 50-55 booked,” she said.The money Ethan raises will go into savings and help him buy a car. LOS ANGELES (CNS) - A member of a downtown Los Angeles street gang caught with thousands of dollars worth of methamphetamine packaged to resemble 14 foil-wrapped burritos was sentenced Monday to 15 years behind bars for federal drug and gun crimes.Ricardo ``Flaco'' Renteria, 48, of Colton, was also ordered to serve five years of supervised release following prison and pay a mandatory special assessment of 0.``He has a very long criminal history,'' Chief U.S. District Judge Virginia A. Phillips said from the bench. ``This was a large amount of methamphetamine -- and the way it was packaged, it was clearly for sale.''According to evidence presented at trial, Los Angeles police officers pulled Renteria over on Feb. 3, 2018, in the Angelino Heights neighborhood of Los Angeles after they witnessed him erratically and evasively driving a white Chevrolet Tahoe.Renteria consented to a search of the SUV and law enforcement found a black garbage bag on the floor behind the driver's seat. Inside the bag were 14 foil-wrapped, burrito-shaped packages containing 13.7 pounds of methamphetamine with a street value ranging from ,000 to ,000.A subsequent search revealed a fully loaded Smith & Wesson .38 Special handgun and more than 0 in cash, evidence showed. Renteria was arrested at the scene and indicted by a federal grand jury in March 2018.After a one-day bench trial in March, Phillips found him guilty of three felonies: possession with intent to distribute methamphetamine, being a felon in possession of a firearm, and possession of a firearm in furtherance of a drug trafficking crime.At his sentencing hearing, Renteria asked the judge to ``take into consideration (that) I have a family waiting for me -- and I apologize for the situation I find myself in.''But Phillips said that a significant prison sentence was necessary ``to protect the public from further crimes of the defendant.'' She also recommended that Renteria undergo a mental and physical health examination while behind bars. 2031
