CARLSBAD, Calif. (KGTV) — Officials have identified the bicyclist killed this week after being hit by a train in Carlsbad.Thursday night, 37-year-old Jason Holsinger was riding his bike on the sidewalk when he came to the Grand Avenue train intersection in downtown Carlsbad. Officials say even though the crossing arms were fully down, he rode around them and collided with the side of a passing train.The San Diego County Medical Examiner ruled the death an accident.Holsinger's death has renewed worries of safety surrounding train crossings in Carlsbad.The tragedy occurs just two days after Operation Clear Track, an event meant to raise awareness about railroad safety hosted by Carlsbad Police, Amtrak Police, and Operation Lifesaver. The event is the largest rail safety law enforcement initiative in the U.S., running from Sept. 22 - 28.In 2017, the family of Patrick Terrin filed a lawsuit against the City of Carlsbad and BNSF Railway, arguing they "negligently, carelessly and wrongfully failed to properly warn persons crossing the railroad tracks."Terrin was killed in 2014 after a night of bar-hopping nearby with his sister and friends. He had crossed under the crossing arm bar before it was fully down, as the rest of the group waited. Despite begin several feet off the tracks, he was hit and killed.The family's lawyer says crossing arms only extend across traffic lanes, leaving sidewalks unmarked with no paint to warn pedestrians where to safely stand.To make the area safer, Carlsbad has approved construction on a trench along the tracks as a safety measure. California regulators want to tax text messages to increase funds for programs that bring connectivity to underserved residents.A new surcharge proposed by the California Public Utilities Commission (CPUC) wouldn't be a per-text tax, but a monthly fee based a cellular bill that includes any fees for text-message services. Most carriers offer a flat fee option for texting, and already charge a similar fee for other services included in the bill — such as phone calls. The exact structure of the charge would vary from carrier to carrier.The commission will vote on the measure January 10, 2019, and is facing strong opposition from industry trade groups like the CTIA, which represents AT&T Mobility, Sprint, and T-Mobile. (AT&T is the parent company of CNN.)The 52-page proposal by CPUC Commissioner Carla J. Peterman lays out the details of the plan, and says the state's Public Purpose Program budget is going up while incoming fees to fill it are decreasing. Currently the surcharge rate is less than 7%.The proposed plan could be complicated by a new Federal Communication Commission ruling. On Wednesday, the FCC approved a new rule that classifies text messages as an "information service" like email. Proponent of the rule say it will give carriers the ability to crack down on spam messages, and critics say it could lead to carriers censoring messages.The CTIA argued in a legal filing submitted Wednesday that if texts are an information service, then the CPUC doesn't have authority over them and can't add on surcharges. It claims the proposal would go against federal law.The industry group also says the proposal would create inequity "between wireless carriers and other providers of messaging services," such as WhatsApp, iMessage and Skype."Subjecting wireless carriers' text messaging traffic to surcharges that cannot be applied to the lion's share of messaging traffic and messaging providers is illogical, anticompetitive, and harmful to consumers," the CTIA said in its filing.In light of the FCC ruling and other legal filings submitted to the CPUC, the group could change its draft proposal before the vote next month.According to the CPUC, the charges go to a number of different programs, including 911 services, subsidized phone service for low-income residents, and equipment for deaf and hard-of-hearing users. 2379

CA?ON CITY, Co. -- The Royal Gorge Bridge and Park has been a place providing natural beauty and adrenaline rushing rides for 91 years.“It’s history,” said Chad Harris, who works at the admissions desk. “It’s one of the most iconic places in the United States, and I feel honored to work here.” Harris said the park has been a special part of his life. He was an intern at the park several years ago and then came back to work full-time.“My family worked here, my brother, my sister my mom,” Harris said. “I wanted to come back to this place and have a career here.” But seven years ago, Harris watched decades of memories go up in flames. The Royal Gorge Bridge and Park was destroyed by a wildfire. The bridge was nearly all that was left.The heartbreak of the fire—only preparing Harris and his team for the challenges that COVID-19 would bring.“I honestly thought the fire was the worst thing that could happen to us,” said Peggy Gair, who manages public relations for the park.Gair has been with the park for more than 20 years and said the virus was a new strain of devastation.“Never in my wildest dreams did I think we’d be closed for that many weeks, the two and a half months that we were,” Gair said. She said the fire was different—the park had insurance and was prepared to rebuild. No one could have prepared them for the pandemic.Just before the pandemic hit, employees spent dozens of hours and thousands of dollars hiring 30 new employees. Days later, they had to let everyone go, and now, the process to rehire is more complicated than ever before.Gair is signed up for a new way to find workers: a live, virtual job fair. She’s hoping to fill dozens of open positions around the park. Some of those jobs have been available since last year, and now, Gair believes the extra 0 a week in unemployment benefits is playing a role in keeping people from applying.“There’s jobs available,” Gair said. “People aren’t excited to go back to work.
