PHOENIX (AP) — Police served a search warrant Tuesday to get DNA from all male employees at a long-term care facility in Phoenix where a patient who had been in a vegetative state for years gave birth, triggering reviews by state agencies and putting a spotlight on safety concerns for patients who are severely disabled or incapacitated.Hacienda HealthCare said it welcomed the DNA testing of employees."We will continue to cooperate with Phoenix Police and all other investigative agencies to uncover the facts in this deeply disturbing, but unprecedented situation," the company said in a statement.Local news website Azfamily.com first reported the woman, who had been in a vegetative state for more than 10 years after a near-drowning, delivered a baby on Dec. 29. Her identity has not been reported, and it's not known if she has a family or a guardian. It's also unclear if staff members at the Hacienda de Los Angeles facility were aware of the pregnancy until the birth.In a statement, board member Gary Orman said the facility "will accept nothing less than a full accounting of this absolutely horrifying situation.""We will do everything in our power to ensure the safety of every single one of our patients and our employees," Orman said.Hacienda CEO Bill Timmons stepped down Monday, spokesman David Leibowitz said. Most of them involve fire drill and evacuation preparation or Medicaid eligibility. But one complaint from December 2013 outlines an allegation that a staff member made inappropriate sexual comments about four patients two months earlier. Nobody relayed the incidents to an administrator. That employee was later fired.Martin Solomon, a personal injury attorney in Phoenix whose clients are mostly vulnerable adult victims of abuse and neglect, said a lawyer representing this woman should call for all pertinent medical records, a list of current and ex-employees and any past litigation involving Hacienda. It would be the police who would lead DNA testing to figure out who fathered the baby, Solomon said.It would be hard for Hacienda to escape any kind of liability in court."There's a lot of information we do not have, But things like this don't happen without someone either knowing about it or should have known about it," Solomon said. "Whether it's an employee or someone from the outside, the facility has an obligation to protect residents."Advocates for the disabled say Arizona needs to find a way to monitor allegations of sexual abuse and sexual violence in these group settings. Doing background checks isn't enough, said Erica McFadden, executive director of the Arizona Developmental Disabilities Planning Council."I think when you've had somebody who's had multiple allegations from different parties, there has to be some way to track that," McFadden said. "If it's the same story from different people, then there's something wrong."The council recently formed a task force to look at how to improve training for health care workers when it comes to identifying and reporting sexual abuse."We don't have a systematic way to train people what's a good touch or a bad touch. We also don't have required training for providers," McFadden said. "We really need a lot of work in this area."Jon Meyers, executive director of The Arc of Arizona, an advocacy group for people with intellectual and developmental disabilities, called the allegations "disturbing, to put it mildly.""I wasn't there. I clearly don't have firsthand knowledge of what happened," Meyers said. PINELLAS COUNTY, Florida — Beaches across Florida are about to see a major change. Stretches of sand behind condos, hotels and homes, could soon be off limits to the public. Starting July 1, it will be up to private businesses and homeowners to decide if they want to restrict the public from using their portion of the sand from the high tide water line up. That means the dry sand adjacent to their building could be private, while the wet sand will remain public. It's an idea beachgoer Heather Towns does not agree with. The mom, from Indiana, comes to Redington Shores every year with her family.“I think it’s a beach. I think you should be able to walk wherever you want," she elaborated. “We come here every year for the past 4 years because it’s private.”Yet, come July 1, the sand that Towns and her family often visit behind a 4-story condo building, could be reserved for condominium owners only. Governor Rick Scott recently signed a bill allowing hotels, condos and other property owners to put up signs or even rope off their section of the beach, if they choose. Ron Gonzalez manages the Gulf Mariner Condos on Redington Shores. While he doesn’t agree with roping off the beach, he says protecting private property— which he pays taxes on— is critical.“It’s no different than if they came in and took your own personal backyard on the mainland. It is no different whatsoever," Gonzalez explained.The new law is the first of its kind in the country, and goes against Florida’s long standing "customary use" policy, which states that beaches belong to the public. “It’s everybody’s beach. It’s everybody’s ocean!," beach visitor Dennis Hansen said in disbelief when he learned about the new law. The law also takes away a local city or county’s ability to restrict private beaches. So the next time you pick a perfect spot along the sandy shore, don’t be surprised if a private property owner asks you to move. Craig Towns believes the law is only fair.“If you’re going to make the investment and spend the money and time down here, you deserve your own private space,” he said.His wife, Heather, disagrees, "I kinda like the open feel. OVERLAND PARK, Kan. — Forever 21 is one of a handful of stores that allows men and women to try on clothes in the same area.Now, some shoppers believe it might be time for a change.This comes after a man was charged for allegedly recording a woman and a girl inside a Forever 21 changing room at the Overland Park mall.“For a place like this, I don't think that's appropriate at all to have men, women and children in the same dressing room at all,” said Jaymee Henderson, who shops at Forever 21.Scripps station KSHB in Kansas City sat down with an attorney to find out what the laws are when it comes to recording video in a clothing store like this.Attorney Bernie Rhodes said anything within the store is fair game."If I want to walk into a Forever 21 store and put my cell phone in my breast pocket and film my interaction with the sales clerk, that's perfectly legal,” said Rhodes.But once you get to the dressing room area, the rules change."What a store can't do is install a security camera in the bathroom or dressing rooms because there we have what we call an expectation of privacy. The same is true for perverts,” said Rhodes.Rhodes said a person can record themselves in the dressing room with their own device.In the Forever 21 dressing rooms, there is a large gap between the floor and the fitting room wall. That’s how prosecutors allege a man took video of a girl and a woman on his cell phone.A petition on Change.org is calling on the store to separate their dressing rooms by gender, but Rhodes believes that change won’t prevent people from breaking the law."It falls upon the individual who is acting illegally, he or she knows what they're doing is wrong.
