SAN DEIGO (KGTV) -- As the migrant caravan makes its way through Mexico, local attorneys and shelters in Tijuana are monitoring their progress, in case the immigrants arrive at the Tijuana and San Diego border.The group Federal Defenders of San Diego worked illegal entry cases during the last caravan in April. Kara Hartzler is one of their attorneys, she says theirs already a daily backlog with immigration cases and this caravan will further overwhelm the system.Hartzler says many immigrants from April's caravan are still in the asylum process.  It's estimated the new caravan is 4,000 to 7,000 immigrants in size, roughly three times bigger than the one in April. In Tijuana, shelters are having meetings to prepare for the possibility of a large arrival. In a series of tweets Monday morning, President Trump called the latest caravan a "national emergency" and threatened to cut off aid to certain Central American countries, adding that he's already alerted Border Patrol and the military.  1038

SAN DIEGO (CNS) - A grand jury indictment charging three San Diegans with conspiracy to commit fraud, grand theft, forgery and identity theft was unsealed Thursday, alleging the defendants defrauded more than 100 local Navy service members out of millions by selling the service members unnecessary life insurance policies.Paul Flanagan, 54; Ranjit Kalsi, 52; and Gregory Martin II, 49, are accused of selling 4,700 life insurance policies and annuity contracts to service members who already had life insurance through the Navy, otherwise known as Servicemembers' Group Life Insurance.Prosecutors allege the defendants -- through their company, Go Navy Tax Service -- misrepresented what services the company was providing when they sold policies to the service members. Bank accounts were opened in the service members' names to make automatic payments toward the policies' premiums, though the victims believed they were signing up for a retirement savings account or other services, rather than life insurance policies.Flanagan, the company's owner, pleaded not guilty to nearly 70 felony counts at the downtown San Diego courthouse Thursday afternoon. Kalsi and Martin, who allegedly did the bulk of the sales out of the company's office -- a trailer located near the San Diego Naval Base on 32nd Street -- were arraigned Wednesday afternoon.The defendants face more than 20 years in prison if convicted of all counts, according to the San Diego County District Attorney's Office. Prosecutors allege the victims were defrauded out of around .8 million total.The company's website, www.gonavytaxservice.com, currently only provides a brief statement on its homepage, which reads, "Hello, we are currently unable to provide Tax Preparation Services this off-season. Sorry for the inconvenience. If you need anything else, please call us and leave a message. Someone will get back to you asap."Flanagan's attorney, Earll Pott, said outside court Thursday that the allegations against his client were "mystifying," as he alleged the service members should have been well aware through bank statements that their accounts were being accessed and why."If this was a fraud, it was a pretty short-lived fraud and it made no sense at all," Pott said. "Within two months, these guys were going to get statements that told them exactly what the product was that they had, and they had a clawback provision where they could come back and complain, and say `well, I didn't understand this' or 'I don't want this,' and the insurance company would have refunded the money."According to Pott, Flanagan was out of state during most of the time of the charged incidents and simply received and submitted the policy applications. But as to Kalsi and Martin, Pott said, "We don't have any reason to believe that the two agents involved did anything appropriate either."The attorney said, "The disturbing thing about this prosecution is the suggestion that the government's going to come in and second-guess whether or not you need these particular financial vehicles. There's nothing illegal about getting more insurance or having another investment vehicle that helps you feel more secure in their retirement."Kalsi’s attorney, Domenic Lombardo, had no comment at this time.Martin’s attorney, Jeremy Warren, tells 10News, “Mr. Martin has been aware of the investigation for some time and vigorously denies the allegations. He looks forward to defending himself in court.”The investigation into the alleged fraud began last year, on the basis of complaints sent to the Attorney General's office."The victims of this scam were young women and men serving our country who were essentially tricked into signing up for something they didn't need and couldn't afford." District Attorney Summer Stephan said. "Enlisted sailors were not given a chance as to whether they wanted a supplemental life insurance policy. That decision was made for them through corrupt and fraudulent methods."The defendants are due back in court July 17 for a readiness conference. 4048

SAN DIEGO - A 13-year-old Tierrasanta, California boy is battling for his life after family members say he was diagnosed with bacterial meningitis.A week ago Sunday, Grant Eyles started throwing up while his mother drove him and his siblings back from Los Angeles.  He quickly developed a fever, but didn't get worse until Thursday, when he lost mobility on his right side and became confused.His mother said a battery of tests pointed to bacterial meningitis, where membranes around the brain and spinal cord become inflamed, and it started with a common ailment."It was a complication essentially from a sinus infection. The infection breached the sinus cavity and went into the brain," said family friend Vanessa Bredehoft.Over the weekend, seizures forced doctors to place Grant in a medically induced coma.  Grant remains in critical condition.County health officials say many strains of bacterial meningitis do not require an alert for person-to-person prevention, and this appears to be one of those cases.A Gofundme campaign has been set up to help with the family's expenses. 1107

  

SAN DIEGO (AP) — The American Civil Liberties Union on Wednesday released documents detailing widespread allegations of misconduct by U.S. border authorities toward children, including kicking one in the ribs, denying medical attention to a pregnant teen who complained of pain and threatening others with sexual abuse.Its report is based on more than 30,000 pages of government documents in response to Freedom of Information Act requests and a subsequent lawsuit. The allegations date from 2009 to 2014 and, according to its authors, number in the hundreds.Customs and Border Protection strongly denied the claims, as it has rejected similar accusations of widespread excessive use of force in recent years. The documents compiled by the Homeland Security Department's Office of Civil Litigation and Civil Rights for the ACLU are partially redacted, making it more difficult to assess the allegations and findings.TEAM 10 INVESTIGATES: Increase in arrests of immigrants smuggled into San Diego by seaHomeland Security's internal watchdog agency has reviewed the claims and found them unsubstantiated, said Customs and Border Protection spokesman Dan Hetlage. In 2014, the department's inspector general investigated 16 cases of alleged child neglect and abuse — out of 116 that advocacy groups had compiled — and reported that federal prosecutors declined to file charges because there was no evidence of crimes."The false accusations made by the ACLU against the previous administration are unfounded and baseless," said Hetlage.Mitra Ebadolahi, an attorney for the ACLU's border litigation project, said the quantity of the allegations as well as their consistency — spanning several years and several states and coming from children with differing backgrounds — indicates some level of truth.RELATED: Customs and Border Protection details reasons for San Diego border wall testing"These records document a pattern of intimidation, harassment, physical abuse, refusal of medical services, and improper deportation between 2009 and 2014. SAN DIEGO (CNS and KGTV) - The San Diego Humane Society announced Thursday that its Humane Law Enforcement division conducted a one-day sweep of pet stores and issued more than 100 citations for violations of a partial state ban on the sale of dogs, cats and rabbits.Assembly Bill 485, which went into effect at the beginning of this year, requires pet stores to get their animals from a partnered shelter or rescue center in an effort to curb the sale of pets from so-called puppy mills and kitten factories that breed animals for sale en masse, often in inhumane conditions.Humane Law Enforcement officers issued 39 citations to Broadway Puppies and 38 to Bark Avenue, both located in Escondido, for failing to provide a documented agreement with a public or private animal shelter or rescue organization, according to Humane Society spokeswoman Dariel Walker. Officers also issued 25 citations to Pups & Pets in Santee for improper signage on the cages holding its available animals, she said.RELATED: 26-pound cat helping raise awareness on pet obesity10News spoke to Mindy Patterson, Co-President of "The Cavalry Group," an organization that represents animal businesses. One of their members is Broadway Puppies in Escondido. Patterson said AB485 treats legitimate pet stores unfairly."To mandate that a store is required to obtain and source their animals for sale, from a specific source is unconstitutional," Patterson said. "All I know is that our members are in accordance with the law."Patterson said she wants the public to recognize the difference between illegitimate backyard breeders and USDA-certified breeders. She said both of them are often lumped into the same negative category of "puppy mills.""They are licensed, regulated and regularly inspected facilities that meet very stringent standards," Patterson said. Cavalry Group co-founder Mark Patterson said the store "and its parent organization are faithfully following the letter of the law in this case and will be exonerated of these citations. Other pet stores in San Diego County have been subject to similar harassment by SDHS only to have the citations dismissed in court."Representatives of the other two pet stores could not immediately be reached for comment on the citations, which were issued during a countywide sweep Wednesday of pet stores under the Humane Society's purview.Last July, the county's Department of Animal Services ceded nearly all countywide animal control duties to the Humane Society, except unincorporated areas of the county that are served by the department's shelters in Carlsbad and Bonita.RELATED: San Diego Humane Society sees surge in young wildlife in need of care"My advice is beware," said Humane Law Enforcement Officer Allen Villasenor. "As a brand-new law takes effect, people will use different methods to try to circumvent the law and at this point it's our job to make sure everything is in compliance.
