SAN DIEGO (AP) — In Washington, it's all about the wall. At the border, it's only part of the story.Border authorities are struggling with outdated facilities ill-equipped to handle the growing increase in family migrants, resulting in immigrants being released onto the streets every day. The immigration court system is so clogged that some wait years for their cases to be resolved, and lacks funding to pay for basic things like in-person translators. An increase in sick children arriving at the border is putting a strain on medical resources.But the Washington debate has focused almost exclusively on the billion in wall spending that President Donald Trump wants. Other proposals being discussed keep the rest of the Homeland Security department funding at existing levels."The wall is a tool. Unfortunately even if it's implemented across the border it isn't a solution to all the problems," said Victor M. Manjarrez, a former Border Patrol chief with more than 20 years of experience, now a professor at the University of Texas-El Paso.Trump has suggested migrants won't bother to come if he gets his way, making other immigration issues less problematic. Walls and fencing currently blankets about one-third of the border — mostly built under President George W. Bush — and the president wants to extend and fortify them. But contracting, designing and building new wall systems complete with updated technology could take years.Trump met Friday with Congressional leaders who said the president threatened the shutdown could go on for "years." Trump later said he'd considered using executive authority to get a wall built on the border."You can call it a barrier, you can call it whatever you want," Trump said a day earlier, flanked by immigration union heads. "But essentially we need protection in our country. We're going to make it good. The people of our country want it."Meanwhile, the House passed a bill Thursday evening to fund the government without the billion, with new Democratic Speaker Nancy Pelosi calling the wall an "immorality."The debate overlooks major bottlenecks in the immigration system as more families and children traveling alone turn themselves in to authorities to seek asylum, instead of trying to elude capture as almost everyone did just a few years ago. In many cases, the current migrants are climbing existing border fence and seeking out agents to surrender to agents.The backlog in immigration courts has more than doubled to 1.1 million cases since shortly before Trump took office, according to Syracuse University's Transactional Records Access Clearinghouse. Families and children now account for about six of 10 Border Patrol arrests, but there are only about 3,300 family detention beds and the number of unaccompanied children in government care has soared under Trump.Border crossers are stuck in short-term holding cells for days and there has been a spike in sick migrant children, including two who died in custody.In addition, the wall will do little to address the issue of visa overstays — when immigrants come to the country legally and remain here after their papers expire. Authorities say there were nearly 740,000 overstays during a recent 12-month period.And border agents continue to struggle with growing numbers children and families. Officials say they are stopping about 2,000 people a day, more than 60 percent children and families, higher than during many periods under President Barack Obama. They referred 451 cases to a medical provider from Dec. 22 to Dec. 30, more than half children.David Aguilar, the Border Patrol chief from 2004 to 2010 and a former acting Customs and Border Protection commissioner, said agencies that oversee long-term immigration custody need more funding to immediately step in after the Border Patrol makes an arrest. He says the agency is "overwhelmed" in dealing with all the children and families coming across the border now, much different from 1990s and 2000s. And any wall"The demographics and the flows that are crossing the southern border are very different from the demographics and flows when we built the original walls ... back in 2006 and 2008," he said.Customs and Border Protection Commissioner Kevin McAleenan, testifying before the Senate Judiciary Committee last month, said stations were not built to manage the crush of families coming over. The wall was important, he said, but so were these other issues. He said they needed budgeting for medical care and mental health care for children in their facilities.Trump has significantly increased the number of immigration judges but, A. Ashley Tabaddor, president of the National Association of Immigration Judges, said it came without enough support staff. About a week before the shutdown, judges were told the courts ran out of money for many in-person translators and that, as a result, it would have to reach them telephonically. A hearing that might last three minutes would last 20 minutes.The shutdown is already having an impact on the immigration system. Courts were only functioning for those who were detained. Other cases will be reset for a date once funding resumes, according to the website for the courts, which are overseen by the Department of Justice.Immigration lawyers said that will only worsen the already overwhelming backlog. Immigration attorney Jeremy McKinney said he expects cases in Charlotte, North Carolina will be moved to 2020 because this year's docket is already full."The situation is a lose-lose," he said.In contrast, the funding problems have only minimally affected the U.S. government agency tasked with reviewing immigrants' applications for green cards and other benefits. Federal prosecutors accused him and his wife Margaret of misusing 0,000 in campaign funds. Hunter, under indictment during the 2018 election, still defeated Campa-Najjar by 3 percentage points, or 9,000 votes in the 50th District, which leans Republican.Campa-Najjar is running in 2020 to take the open seat. He secured the most votes in the Super Tuesday primary against a split Republican field, with Issa coming in second. Still, the Republican votes combined outnumbered Campa-Najjar in the March primary. By registration, Republicans outnumber Democrats in the district by about 33 percent.Issa, a longtime veteran of the House of Representatives, last represented the coastal 49th District. He did not seek re-election in 2018 amid changing voter registration. He is now running to go back to Washington, D.C., in the 50th District, which extends from parts of El Cajon into southern Riverside County. Issa, a staunch ally of the president, expressed confidence in his campaign Tuesday."The policies of this president, this administration, are my policies," he said. "Free and fair trade, enforcement of the borders, a recognition that the constitution is as it is."Campa-Najjar, while a Democrat, said district voters are taking to his independent voice."I stand with the people of the 50th through thick and thin," he said. "When our back's against the wall, I'll have my back and I'll have their back. I won't care about the partisan stuff. I focus on my district every time."SurveyUSA posed the question of Issa or Campa-Najjar to 508 likely voters. Issa led by 21 points among men, while Campa-Najjar led by 18 points among women.The poll also showed Joe Biden leading Donald Trump in the race for president 48 to 45 percent. SAN DIEGO — It appears the Congressional seat vacated by Republican Duncan Hunter will remain in Republican hands, according a new scientific poll.The ABC-10 Union-Tribune scientific poll shows Republican Darrell Issa leading Democrat Ammar Campa-Najjar 51 percent to 40 percent, with 9 percent undecided. The poll, released Tuesday, has a margin of error of 5.7 points. It comes after the two prior polls showed the candidates in a virtual tie for the 50th Congressional District, which comprises most of East County and stretches into southern Riverside County. The shift came because independents moved to support Issa. Last month, the poll showed Campa-Najjar leading Issa in independents by 13 points. Tuesday's poll showed a major swing, with Issa leading among independents by 14 points. That's a 27-point swing. "In the end, independents in red-leaning area tend to be more red leaning, vice versa for blue-leaning areas, and so it's not surprising that Darrell Issa, as we get closer to the election, is bringing home these independents out in East County, San Diego," said Thad Kousser, political scientist at UC San Diego.The 50th District is the county's last in which Republicans outnumber Democrats in registration, giving Issa the advantage.In an interview Tuesday, Issa said he was traveling the district from Temecula to Jamul, meeting voters with social distancing. "I think my 18 years of support for pro-business, pro-50th type voting has allowed me to whether some pretty egregious claims of, somehow, corruptness and so on," he said. Campa-Najjar declined an interview Tuesday, but released this statement: “I’m inviting voters to reach me personally at 619-721-5148. The only poll that matters is on Election Day, and CA-50 voters have defied the odds time and time again. Darrell Issa is trying to buy and lie his way back to Congress. But CA-50 voters know me, I’ve spent the last four years listening to their needs. And I know that in one week, voters will show the world what I’ve seen over the past four years.”In response to that statement, Issa said, "It's a statement of somebody who is way behind in the polls, not likely to win, and somebody who spent more money and went negative claiming that, somehow, I was unfit from day one."SurveyUSA polled 538 likely voters in the district from Oct. 22 to Oct. 26. 2348

  

SAN DIEGO (CNS) - A complaint was filed Friday on behalf of an asylum-seeking Honduran family -- which includes a newborn U.S. citizen born in Chula Vista -- that was sent across the border to Mexico to await asylum proceedings two days after the child's birth.All four family members, including the newborn who lacks legal immigration status in Mexico, were ordered across the border by Border Patrol agents, according to the joint administrative complaint filed by the American Civil Liberties Union and Jewish Family Service.The organizations have asked the U.S. Department of Homeland Security Office of Inspector General to conduct an investigation into the family's case. They say the family should have been allowed a legally required non-refoulement interview regarding the family's fears of being sent to Mexico.Reached for comment, a CBP spokesperson said, "As a matter of policy, CBP does not comment on pending litigation. However, lack of comment should not be construed as agreement or stipulation with any of the allegations."The complaint alleges the family -- father, pregnant mother and 9-year- old son -- fled Honduras about a year ago and turned themselves in at the U.S.-Mexico border in San Diego on June 27, one day before the mother gave birth to her son. As she was giving birth at Scripps Mercy Hospital in Chula Vista, her husband and son were not told which hospital she was taken to and were ordered back across the border, according to the complaint.After giving birth on June 28, the mother was "interrogated" by Border Patrol agents, according to the complaint, which says the woman asked the whereabouts of her husband and older son but was not given any information by the agents.The ACLU and Jewish Family Service allege the family should have been provided a non-refoulement interview, with both father and mother expressing fears about being returned to Mexico, but instead the mother and newborn were forced across the border on June 30.The complaint also alleges the family tried to enter the United States in March near the U.S-Mexico border in Texas and stated fears over being turned back to Mexico, but were also turned away without being provided a non-refoulement interview. They were told to return weeks later for an immigration hearing, but COVID-19 led to a postponement of their court date.While forced to wait in Mexico, the complaint alleges the family was "accosted and detained by a group of armed men who attempted to extort them."The family is now staying in a rented room in Tijuana, "and neither the newborn, nor his mother, has received any medical care since the birth," in contradiction of guidance from Scripps Mercy Hospital to have follow-up visits with doctors, according to the ACLU and Jewish Family Service."This family should have been granted release into the U.S. to await their asylum proceedings, as the Department of Homeland Security has done with more than 23,500 individuals -- all in family units -- over the past 1.5 years across the San Diego border region," said Luis M. Gonzalez, supervising immigration attorney with Jewish Family Service. "We urge Homeland Security to grant this family entry into the U.S. immediately to keep the family together and allow for adequate care for the U.S. citizen newborn child and for the mother's postpartum medical care."The complaint alleges that not providing the family with a non-refoulement interview violates U.S. law and Department of Homeland Security policies. The organizations demand the family be paroled together in the United States while they await asylum proceedings."This case reflects many of the lived horrors of both the so-called `Migrant Protection Protocols' and Border Patrol impunity," said Mitra Ebadolahi, an ACLU senior staff attorney. "No family should have to endure what this family has experienced. Together with Jewish Family Service, we are demanding a full investigation. The agency must be held to account for its disregard of basic human rights and its policy and legal transgressions." 4050
