SAN DIEGO (KGTV)- A local family contacted Team 10, concerned about the recent marriage of their elderly father to his new caregiver.  In a petition filed in probate court through an attorney, the family of James Donald Hess accused his new wife and former caregiver of "physically and verbally abusing him, and asserting undue influence over him." "It's just heartbreaking," said Dede Hess about her father-in-law. "I was just like, this isn't real." Dede Hess said her father-in-law, known to many as Don, is not in the best health. In the petition, it said his "health steadily declined" after Don's second wife passed away in February 2016 and that he suffered from "depression and loneliness" and became dependent on in-home caregivers. In the petition, it claimed that a caregiver named Nicky convinced Hess to marry her after just a few months. Hess and Nicky Shepard -- now Nicky Hess -- were married on October 14, 2017. Hess was 86-years-old. Nicky was 64.  "I think of her as a shark that smelled the blood in the water," Dede Hess said. RELATED: Resource guide for elderly San Diegans and families Dede Hess also learned more about the past of her father-in-law's new bride.  "When she met dad, she was married, but she was a newlywed," Dede Hess said. "Two weeks after her divorce was final, she married dad." Team 10 found Nicky was divorced at least five times.  The family alleged Nicky convinced her new elderly husband to "withdraw large sums of money from his investment accounts" and that she "forged [ his] name on documents," according to the petition. It also said she placed his health "in extreme danger" by keeping medication from him or giving him too much.  "I would love to see some justice on behalf of my father-in-law, especially if he's ill," Dede Hess said.  Team 10 learned that Don Hess is now hospitalized. His family said his heart stopped for several minutes and he also suffered from renal failure and pneumonia. The conflict brought both sides to probate court in mid-March where the judge acknowledged the difference of opinion regarding Mr. Hess's marriage.  "I know that you have very different views about whether this is on one hand, a recent marriage of an elderly person to his caregiver and the vulnerability that that can present and the possibility of financial abuse versus, on the other hand, a person who is engaging in his right in his older years to find love and get married," said Judge Julia Kelety. The petition is to remove Don Hess from the new trust made late last year. Hess's children claimed he was not competent at the time.  The petition said the new trust "largely disinherits his natural children... in favor of Nicky."  "The document was done in December so we have issues about its validity," said attorney Todd Stevens. However, the attorney present for Don's side said that is not the case.  "It appears to be a validly, executed trust by Mr. Hess," said attorney Lisa Frisella. Frisella said in court Mr. Hess went to a lawyer on his own and amended the trust.  Team 10 visited the Hess home to get Nicky Hess's side of the story.  She was home and did not want to talk in person. However, less than an hour later, Nicky called Team 10 and said over the phone: "All I need is love. I don't even think about his money. His kids did not approve our marriage."  Team 10 asked about allegations of elder and financial abuse. Nicky Hess said, "No, no way. I never elderly abuse my husband. I love him so much." In the petition response filed by Don's lawyer, it also denied any abuse and said the "children were more concerned about their inheritance than his happiness." In court, Judge Kelety temporarily "suspended" Mrs. Nicky Hess as successor trustee until another court appearance scheduled for April 5th.  It was a small victory for Dede Hess and the other Hess children, as they pray for their father's recovery. "I don't want this to happen to anybody else," Dede Hess said.  According to the National Council on Aging, elder financial abuse is likely underreported. SAN DIEGO (KGTV) — While the CDC has issued guidance for the cruise ship industry to reopen during the pandemic, the Port of San Diego says it's too soon to tell when the industry would restart locally.Friday, the CDC urged a "phased approach" to reopening the industry that has been largely shuttered since April following a no-sail order due to the pandemic. The agency says cruise lines will need to test safety protocols via mock voyages with volunteers before they can host passengers. Still, the order was the first movement on cruise ships since the CDC issued its no-sail order in March to help stop the spread of the coronavirus outbreak. Adam Deaton, Port of San Diego cruise business representative, told ABC 10News that the port will have to coordinate with cruise companies on what their next steps will be."It is too soon to say how soon sailing could resume in San Diego. Our next steps will be to coordinate with Holland America and Carnival on their plans, as they are the first few cruises on our schedule. Currently, our first scheduled cruise is Dec. 19 with Holland America’s Koningsdam. If any cruise lines request to conduct test sailings in San Diego, we will coordinate with all relevant federal, state and local agencies," Deaton said.RELATED: CDC offers framework for cruise lines to start sailing againAccording to the Port of San Diego, 70 cruises have been canceled during the 2020-21 season. SAN DIEGO (KGTV) - With the March 2020 Presidential Primary approaching, the San Diego Registrar of Voters is urging everyone to make sure they are registered properly."This one election is the most complex elections for administrators like ourselves and voters that are out there," says Registrar Michael Vu.With six political parties holding presidential primaries, plus the dozens of overlapping state and local district elections, Vu expects to create more than 12,000 unique versions of the ballot. Rules on who can vote in each party make it even more complicated.In December, Vu's office sent out more than 500,000 mailers to voters to make sure they know the options.Anyone registered with a specific party will only be allowed to vote in that party's primary. Republicans will vote for the Republican candidates, Democrats for Democrats and so on.But, right now more then 30 percent of registered voters in San Diego are listed as "No-Party Preference."For those people, they can choose to vote in the primary for American Independent, Democrat, or Libertarian parties. They cannot vote in the Republican, Green, or Peace and Freedom parties."It makes it a little more confusing," says Vu. "Something that voters need to know what political party status they are in. And if it’s different from the presidential candidates they want to vote for, they need to register or re-register now."To help voters navigate their options, the Registrar has set up a website where people can get all the information they need.The deadline to choose a party, or to choose which primary you want to vote in, is January 6."If you’re a non-partisan voter, now is the time to act," says Vu. SAN DIEGO (KGTV) — With hospital beds running short, healthcare workers are trying to care for COVID-19 patients as efficiently as possible, using everything they’ve learned over the last nine months.Improvements in medications and methods have helped shorten hospital stays, said Sharp Memorial Hospital chief medical officer Dr. Tom Lawrie.In March, Sharp said COVID-19 patients stayed 12 days in the hospital on average. In November, the average dropped to 5.3 days. Other institutions have reported similar drops in the length of patient stays.COVID-19 patients now receive a three drug regimen: Remdesivir to fight the virus, a powerful steroid called dexamethasone to prevent the immune system from going haywire, and medications like heparin to reduce blood clotting.On top of that, hospitals have improved techniques like when to use ventilators.“Initially, we were in this conundrum where we weren't sure whether we should intubate patients early or whether we should wait a little later,” Dr. Lawrie said. “Over the last several months we've figured out a really good progression.”The progression now starts with a surprisingly simple technique called proning. Doctors around the country discovered that turning COVID-19 patients onto their stomachs rapidly improved breathing.Early research suggests proning may keep COVID patients off ventilators.“By putting people on their stomach in these positions and by proning them, you allow blood to get where the air is and therefore you get better oxygenation,” Dr. Lawrie said. “It makes the oxygen levels better. It makes their work of breathing better. It makes them feel better generally.”Proning helps move blood from one area of the lung to another where it can receive more oxygen. These regions are called West’s zones of the lung, named after research in the 1960’s by UC San Diego Professor Emeritus John B. West.Proning has been used as a medical intervention since 1976, when a doctor and a nurse in central Michigan published a study showing it could benefit patients in respiratory distress.Dr. Lawrie said there are also two outside factors contributing to shorter hospital stays across the country. The patients that are showing up now tend to be younger than early in the pandemic. Younger patients are more likely to respond well to treatment.There’s also evidence the virus has mutated over time, possibly making it more contagious but slightly less severe, Dr. Lawrie said.However, patients lately have been showing up faster than hospitals can care for them, threatening to overwhelm already crowded facilities. "If that happens, they won't have access to an ICU bed or to the medications that they need," he said. 2699
