SAN DIEGO (KGTV) - Law enforcement agencies across San Diego Country will have extra officers stationed near busy railroad intersections this week as part of "Operation Clear Track. "The week-long enforcement ties into National Rail Safety Week, from Sept. 22-28.In Carlsbad, officers will be near Carlsbad Village Drive and Grand Avenue during the lunch hour, reminding people to only cross when there are no trains nearby."The goal is to raise railroad safety awareness through education and the enforcement of state railroad grade crossing and trespassing laws," the Carlsbad Police Department said in a statement.Amtrak officers will also keep an eye on well-known trouble spots along the coast, like a stretch in Del Mar where surfers and hikers frequently cross over tracks to get to the beach."It's not safe to cross here," said surfer Cooper Baker, who admitted he does it regularly. "But, if people have their wits about them and make good choices about where they're stepping, it's totally safe. So I just try to make sure I know a train is not going to be here and that my footing is sure. I think it's fine."A recent study found San Diego is the 9th deadliest county for accidental train casualties in the U.S. from 2013-2017. In that time, 44 people were killed while trying to cross tracks. Los Angeles County topped the list, with 110 deaths in that time."It's definitely good to give people a reminder that trains are coming through," said surfer Shayne Jensen. "You gotta be safe."In the last year, the North County Transit District has taken steps to make trains safer. In 2018, they equipped all of their trains with Positive Train Control, a new technology that automatically slows trains down if any danger is detected.Meanwhile, there have been calls in Del Mar for more railroad crossings to be built. Residents are asking for more options, so they're not tempted to cross illegally. SAN DIEGO (KGTV) -- La Mesa Police Department announced it has dropped their charges against Amaurie Johnson, a black man whose controversial arrest was captured in a viral video last week.La Mesa Chief of Police Walt Vasquez said that "after a full review of all of the evidence in the criminal investigation" against Johnson, the police department will not seek prosecution "on any of the alleged misdemeanor charges."The announcement comes two days since the department released body camera footage showing the events that led up to an arrest video that surfaced last week.A week prior, a video surfaced showing an argument between Johnson, a black man, and a white police officer at the Grossmont Trolley Station. The officer is seen pushing Johnson into a sitting position onto a bench. Eventually, Johnson is handcuffed and told he is being charged with assaulting an officer.It's unknown what actually occurred in the first few moments of the encounter because the witness video began recording sometime after the confrontation began, and the first the 30 seconds of the video provide by police starts without any sound. On the day the body camera video was released, Vasquez said the beginning of the video is muted because of the way the body camera is activated."Mr. Johnson is relieved that the criminal aspect of this case seems to be over with (but) until we have something formal from the prosecuting agency, he is not at rest in believing that it is completely over with," Johnson's attorney, Troy Owens, said. "He has still expressed that he is shaken up and upset by what took place. He has expressed that this is not the first time an incident like that has happened, it's just the first time it happened to be captured on camera, so Mr. Johnson is adamant he wants to see change.""We do believe that the officer should be investigated for potential criminal liability, but there is also a civil aspect to this. Mr. Johnson and I are discussing our options as far as moving forward with a complaint with the city of la mesa and potentially taking this to state or federal court," Owens added.The incident sparked a large protest last Saturday in La Mesa. Thousands of demonstrators took over city's streets to protest Johnson's arrest and the department's investigation of the incident. The peaceful demonstration and marches ended when a large group gathered outside of the La Mesa Police Department and began attacking a bear cat vehicle that was brought in to help disperse the crowd. SAN DIEGO (KGTV) — ICE served four subpoenas to the San Diego Sheriff's Department (SDSO) Friday for information protected by sanctuary state policies regarding migrants arrested in San Diego.SDSO is required to protect the data under California's sanctuary state laws, which prohibits local law enforcement from cooperating with immigration detainers or requests for data concerning illegal immigrants."The public needs to be aware and concerned that California sanctuary state laws do not protect public safety and is bad public policy. Criminal aliens are being released back into the community daily and most will reoffend resulting in more victims, " said Gregory Archambeault, San Diego Field Office Director for ICE’s Enforcement and Removal Operations in San Diego.RELATED: US border agents to pursue migrants in 'sanctuary' citiesICE says it rarely uses subpoenas for information because most law enforcement agencies comply with requests for data on illegal immigrants that have been arrested.California passed its sanctuary state policy in 2017, preventing local agencies from complying with ICE's request. Friday's subpoenas are the agency's first issued in California."The Sheriff’s Department has received the subpoenas from ICE and is in the process of reviewing them. If able to, the Department will comply with the lawful requests in a timely manner," a statement from SDSO read.ICE is seeking information to the following cases:A 40-year-old Mexican national who was arrested in December by San Diego Police for continuing sexual abuse of a child, lewd and lascivious act of a child under fourteen years old, and oral copulation with a person under fourteen years old. ICE says the individual has two DUI convictions from 2009, has been returned to Mexico on eleven occasions between 2009 and 2011, and is currently in SDSO custody.A 42-year-old Mexican national who was arrested for first degree robbery by SDPD in November 2019. ICE says he has a prior conviction for possession of a controlled substance (methamphetamine) from 2013 and he was granted a voluntarily departure, but failed to leave the U.S. ICE says he has since been released back into the community.A 31-year-old Mexican national who was arrested by SDPD for battery of spouse and false imprisonment in December 2019. ICE says he has a prior conviction for a deceptive government identification from 2008 and that he's been removed from the U. S. three times between 2008 and 2010. ICE says he has since been released back into the community.A 28-year-old Mexican national who was arrested for assault with force, great bodily injury, child cruelty and battery of spouse by SDPD in January 2020. ICE says he was previously arrested in 2017 for battery on spouse by local law enforcement and was returned to Mexico multiple times in 2004 and in 2018. SAN DIEGO (KGTV) - Infrastructure improvements will halt Coaster and Amtrak rail service this weekend in San Diego County.During the March 3 - 4 closures, neither Amtrak or Metrolink will be available to commuters in Oceanside, according to North County Transit District (NCTD). Connecting bus service will require an Amtrak reservation, however.There will be no connecting bus service for Coaster commuters, though passengers can use Breeze Route 101 or MTS connecting service, NCTD says.10NEWS TRAFFIC CONDITIONSCoaster and Amtrak service will be canceled on March 10 - 11 as well due to an emergency exercise. The exercise will be held at the Carlsbad Poinsettia Coaster Station from 10 a.m. to 3 p.m. Those in the immediate area should expect to see emergency vehicles.On the Friday following each closure, southbound Amtrak Rail 2 Rail trains A792 and A796, scheduled to depart Oceanside at 10:05 p.m. and 12:01 a.m., will complete their trips to Santa Fe Depot, but Amtrak train A590 will be canceled.The Monday following each closure, rail service will re-open, though trains may be delayed up to fifteen minutes.For future closure information, visit NCTD's website. 1196
