SAN CLEMENTE, Calif. (KGTV) - Border Patrol agents arrested a teenager Tuesday on suspicion of smuggling heroin along Interstate 5 in San Clemente. The 19-year-old man was weaving in and out of lanes near Camino de Estrella about 3 a.m., agents said. He drove his 1997 Chevy pickup truck to a nearby gas station and agents followed to conduct a safety check. “During the encounter, the agents grew suspicious of the driver’s behavior and they decided to request for a K-9 team to respond. The K-9 alerted to the truck’s engine compartment,” agent Theron S. Francisco said in a news release. Agents said they found four packages of heroin inside the truck’s air intake box. The drugs weighed almost five pounds and had a street value of about 7,000. The driver, a U.S. citizen, faces felony drug smuggling charges. 824

SAN BERNARDINO, Calif. (AP) — A jury on Monday recommended the death penalty for a Southern California man convicted of killing a family of four with a sledgehammer and burying their bodies in shallow desert graves.Jurors in San Bernardino made the recommendation for Charles "Chase" Merritt, 62, in a case that puzzled investigators for years after a couple and their two young sons vanished from their home in 2010. Their bodies were found three years later.Merritt supported his head on his fists and closed his eyes as the verdicts were read. He also spoke briefly to his attorney.He was convicted this month of the murders of his former business associate Joseph McStay, McStay's wife Summer, and their 4- and 3-year-old sons, Gianni and Joseph Jr.Merritt had pleaded not guilty and his lawyers didn't offer witnesses during the penalty phase of his trial, insisting he is innocent.San Bernardino County Superior Court Judge Michael A. Smith set a Sept. 27 hearing to formally sentence Merritt. He thanked the jurors after the verdicts were read, saying he knew the decision was "extremely difficult."Authorities said they believed Merritt killed the family as McStay was cutting him out of his business making and selling custom water fountains. When the family disappeared, there were no signs of forced entry at their San Diego County home and their car was found parked at a strip mall near the Mexico border.For years, no one could figure out what happened to them. In 2013, their bodies were found in shallow graves in the desert after an off-road motorcyclist discovered skeletal remains in the area. Authorities also unearthed a rusty sledgehammer that they said was used to kill the family.Merritt was arrested the following year. Authorities said they traced his cellphone to the area of the desert graves in the days after the family disappeared and to a call seeking to close McStay's online bookkeeping account. Merritt also had referred to McStay in the past tense during an interview with investigators.Authorities concede the case against Merritt largely focused on circumstantial evidence and that questions remain about what happened at the McStay home.During the trial's penalty phase, prosecutor Britt Imes asked jurors to consider any possible motive for the killing of two young boys, whether they could have been witnesses to the murder of their parents or simply victims of callous killings."There is no motive that can be ascribed to the killer of a 4-year-old and a 3-year-old that passes muster," he said.Merritt's attorneys didn't call any witnesses during the penalty phase, instead appealing to any lingering doubts jurors may have had about killings they say their client didn't commit."From the very beginning, this case screamed doubt," defense attorney Raj Maline told jurors. "This case is filled with unanswered questions."California has not executed anyone since 2006. Voters approved a ballot measure to speed up executions in 2016, but Gov. SAN DIEGO (CNS) - A firefighter suffered a minor hand injury Thursday morning while working to extinguish a fire that damaged a North Park business, authorities said.The blaze was reported around 5:30 a.m. at a single-story business on El Cajon Boulevard near Illinois Street, just west of Interstate 805, according to the San Diego Fire-Rescue Department.Crews responded to the scene and found smoke and flames coming from the roof of the building, the agency reported. No one was inside the building at the time and firefighters knocked down the flames within about 20 minutes.One firefighter was taken to Sharp Memorial Hospital for treatment of a minor hand injury.The cause of the blaze was under investigation. 724

  

SAN DIEGO — Small business owners across San Diego are bracing for a new round of Coronavirus restrictions. And some say they'll have to fight them in order to survive.The movement into the state's purple tier would block restaurants, nail salons, estheticians and gyms from operating indoors - a change that some say would spell the end of their businesses."If we're forced to close again we may permanently have to close our doors," said Todd Brown, owner of Bub's at the Beach, in Pacific Beach. "It's tough for us, 22 years later I never anticipated that we'd be fighting for our lives, and that's where it's at."Bubs can only fit 9 tables on the street, so Brown is bracing to defy the order. He says otherwise food expires, equipment languishes and bills pile up."I know for a fact if we follow it then I'm done," he said. SAN DIEGO — The city of San Diego never waived permit repair fees for sidewalks, despite a January announcement from the mayor's office saying it would do so throughout 2020.A homeowner pays the fees, which total to just over ,000, when he or she elects to repair the sidewalk in front of their home. A spokeswoman for the mayor says, however, that the city had to delay the fee waiver program once the coronavirus outbreak hit. The city instead was forced to cut upwards of million from the general fund budget. "The City continues to prioritize sidewalk repair amid the uncertainty and budgetary impacts that COVID 19 has brought," city spokesman Anthony Santacroce said in a statement. "While COVID-related holds slowed repair down for a few months, we estimate another 10,000 locations will be repaired with concrete slicing this (fiscal year 2021) and we are off to a great start."The news release announcing the fee waiver, however, is still on the city's website.Marie St. George, a Mission Hills resident, saw that announcement and contacted the city. She wanted to spend upwards of ,500 to repair the crumbling sidewalk in front of her home. That sidewalk, laid down in 1922, is likely one of upwards of 81,000 backlogged locations the city has marked for repair."I actually am afraid now," St. George said. "People could trip. It's become sort of a hazard."The city has a program to split the construction cost with residents, as both the city and homeowners can be liable for the condition of the sidewalk. St. George, however, was willing to pay all of the cost because she wanted it done faster. However, when she called to get the permits, the city representative said she couldn't waive the fees. "I thought based on the mayor's announcement that it would be waived, so it was pretty shocking," she said. Councilman Mark Kersey, who heads the Active Transportation and Infrastructure Committee, which was moving the fee waiver program forward, said in a statement that he hopes this will be prioritized as money comes available. “Repairs on sidewalks are even more important in the pandemic since so many people depend on them every day," he said. "Programs like the fee waiver can keep residents moving safely and save valuable City dollars by preventing trip-and-fall lawsuits."The city says it also repaired or replaced more than 7,500 sidewalk locations last fiscal year. The mayor's spokeswoman says the hope is to get the fee waiver program to the full council by the end of the year. 2522
