(KGTV) - A new California law could let convicted killers out of prison, and San Diego County's district attorney said her office will fight it on a case-by-case basis.Senate Bill 1437 passed the state Legislature last year and went into effect on January 1. It narrows the definition of murder so that only people who are involved in a killing can be charged with that crime.Before the law, accomplices in a killing could also have been charged with murder."It may let murderers go free, because of how far it goes," said San Diego County District Attorney Summer Stephan.Stephan said her office will challenge some re-sentencing hearings based on the new law, although she said they don't know how many there will be.One possible case involves Kurese Bell, who He as convicted of murder in 2016 for his role in the robbery of a North Park marijuana dispensary.During the robbery, Bell and another man, Marlon Thomas, got into a shootout with a security guard at the dispensary. The guard shot and killed Thomas.The DA's office argued that Bell should face murder charges because his actions in the robbery led to the shootout and, ultimately, Thomas' death.Bell is currently serving a 65-year-to-life sentence.Stephan said criminals need to be held accountable for the crimes they commit and cause."It's really important that each offender is held culpable at the right level," she said. "That's what justice is about."Supporters of the new law say it is a vital part of California's efforts at criminal justice reform. They say the old law unfairly targeted young minorities.On its website, the group Restore California says the new law makes sentencing in California more "equitable." They also say it gives accomplices an incentive to cooperate with investigators."In a co-defendant felony murder case, co-defendants who were not the actual killers, who did not aid and abet the killing, or who did not act with reckless indifference to human life will now have an incentive to talk and tell the truth about what happened," the website reads. 2073

SAN DIEGO - San Diego photographers are taking advantage of the serene and luminous glow of the surf this week.Eerie neon blue waves have been seen against San Diego's shore this week, creating some rare photo opportunities. The phenomenon is created when a red tide, which is algae bloom filled with phytoplankton called "dinoflagellates," rolls off waves onto or near the shoreline.The organisms react with a bioluminescent chemical reaction when jostled as a way to warn predators, to lure prey, or communicate within their species. The blue glow can be created by a simple step in the water or crash of a wave.IN SAN DIEGO...The current red tide is being caused by massive numbers of dinoflagellates including "Ceratium falcatiforme" and "Lingulodinium polyedra," according to the Scripps Institution of Oceanography at UC San Diego.The Scripps Institution of Oceanography at UC San Diego is not affiliated with The E.W. Scripps Co., the parent company of this station. Researchers do not know how long this current red tide will last or "the full spatial range of the bloom." In the past, blooms have lasted anywhere from a week to a month or more.San Diego's last red tide event in September 2013 lasted one week, while the previous one in October 2011 lasted a month, according to researchers. Previous ones have lasted even longer.Monday's event was captured from La Jolla to Encinitas. Scripps recommends viewing the marine event from a dark beach at least two hours after sunset, though visibility is not guaranteed.IS IT HARMFUL?...In some areas, a red tide can be toxic to local marine life. In California, the majority are not caused by species that produce toxins, such as domoic acid, according to researchers. However, it's still best to be cautious around the bloom.The Southern California Coastal Ocean Observing System at Scripps samples the water for potential harmful algal toxins weekly.Red tides are unpredictable events and do not always give off bioluminescence, Scripps said.BUT WHY IS IT RED?...The red coloration is due to the high number of organisms in the water. During the day, organisms will swim to the surface to soak in sunlight. Each cell contains a little sunscreen that gives off the color, according to Scripps.When these organisms gather at the surface for sunlight, they can create an especially intense red.Researchers say a combination of physical, chemical, and biological factors are the driving forces behind allowing red tides to form. 2586

San Diego County handles approximately 9,000 cases of elder and dependent adult abuse every year. Elder abuse is defined by the Centers for Disease Control as "an intentional act, or failure to act, by a caregiver or another person in a relationship involving an expectation of trust that causes or creates a risk of harm to an older adult." Types of elder abuse include: physical abuse, sexual abuse, emotional/psychological abuse, neglect, or financial abuse. The county sees about 450 cases a year of criminal elder abuse cases, according to Paul Greenwood with the Elder Abuse Prosecution Unit of the District Attorney’s Office.  The District Attorney’s Elder Abuse Unit prosecutes crimes against seniors, as well as addresses the special needs of elderly victims. They meet with seniors to teach them how to protect themselves, train bank and credit union employees on protecting financial assets of elderly customers, and train first responders to be aware of issues involving elders.  The National Council on Aging? said approximately 1 in 10 Americans over the age of 60 have experienced some type of elder abuse. However, knowledge about elder abuse lags behind the fields of child abuse and domestic violence. SAN DIEGO, Calif. (KGTV) -- People living on the streets are worried that the new portable restrooms installed by the city will get shut down because of those using them for illegal activity.  The city installed four portable bathrooms on First and C Street near City Hall. Four hand washing stations were also installed.On Monday, people using the restrooms were thankful and said the restrooms were long overdue. One man, a Navy veteran, told 10News he's used the restroom twice since they were installed. On one of those trips, he found a used needle. He worries drug users will force the city to shut the bathrooms down. The area has 24-hour security. Security guards work in 12- hour shifts. One guard told 10News he warns people that they can't stay in the bathroom for too long. The city plans on installing other portable restrooms at different locations in the coming weeks. SAN DIEGO (KGTV)---San Diego Fire Department recruiter Captain Jason Shanley reminds people all the time, "If you don’t see it it’s hard for you to know that you can be it."As the department's only full-time recruiter he spends his days making connections, trying to show not only kids but adults that being a firefighter is possible, no matter who they are or where they come from."The narrative is that tall white guys with mustaches are the ones that become firefighters and that’s just not true," saidShanley.Take Captain Shanley for instance. His path to the fire department was paved by members of an organization called Brothers United, a group of African American firefighters in San Diego."I started taking some classes, met some other firefighters, got a mentor and then here I am 20 years later," Shanely said.His passion for what he does and desire to share it made him a perfect fit when the department created the full time recruiting position four years ago."As a department, we really wanted to focus more specifically on and make an actual effort to recruit more diversity into our fire department," he explained.Captain Shanley says some of the biggest obstacles are simply educating people on what it takes to become a firefighter. And once they do know, then trying to help them get the training they need.EMT schools are spread out all over San Diego County; hard to get to for those in the middle of the city without transportation."So we're working to try to bring some of those classes and resources to be more centrally located so we can solve that equity issue and that’s part of what we’re doing in the department as we speak," said Shanley.While there is still work to do, Captain Shanley says it's important the department has someone like him dedicated to hiring staff representative of the community it serves."I want other people to know this is something you can do, it’s more than just a job, it’s a career." 1950
