SAN DIEGO (KGTV) -- A San Diego judge has ruled that demolition of the historic California Theatre would violate environmental law.The theatre, which was built in 1926, was the largest vaudeville and movie palace in San Diego.City Council approved the demolition of the theatre in 2017. The proposed demolition, however, required an environmental impact report.RELATED: San Diego approves replacement for dilapidated California Theatre?The legal challenge to the approval, filed by the Save Our Heritage Organization, said the city failed to adequately address the ability to adapt and reuse the California Theatre.The court granted SOHO’s legal petition because the review failed to comply with the California Environmental Quality Act.The demolition approved by the city would have allowed a 40-story skyscraper to be built that would have included 282 residential units."The California Theatre is an outstanding historic building that has been standing for almost 100 years, it presents many opportunities for successful adaptive reuse to revitalize the C Street corridor. When the City's EIR failed to study alternatives to demolition, we put our faith in the Court to enforce CEQA. We are grateful for the Court's comprehensive enforcement of environmental law and look forward to review of an alternative in an EIR that will allow this historic building to survive as part of a successful new project. SAN DIEGO (KGTV) — A longtime North Park business has been forced to shutter its doors due to the economic toll of the pandemic.A&B Sporting Goods has sat on University Ave. for 79 years. The business told ABC 10News that it thrives off of local youth sports, which have largely been canceled this year due to the coronavirus.Owner Greg Schloss, whose father and grandfather worked at the store before him, said he hadn't planned on closing shop, but could not keep the business going any longer."I've worked here 40 years. The neighborhood is driven by a lot of kids playing ball in this neigborhood. And at the moment, for the past sever, eight, nine months, there's no kids playing any organized sports," Schloss said.RELATED: Rebound: Find resources for small businesses amid the pandemicAs for himself, Schloss said he's not ready to retire and he's hoping some of his longtime customers may be able to help him find a new job.In a Facebook post, the shop told fans they will close as of the end of the year and thanked the community for its support over nearly eight decades."It is with heavy heart that we announce that A&B Sporting Goods is closing shop as of the end of the year. We cannot thank our friends enough for your ongoing support. We were so fortunate to be part of the North Park community for so many decades. SAN DIEGO (KGTV) — A man convicted of killing a San Diego Police officer in 1978 in the city's Skyline neighborhood has been granted parole by a review board.Jesus Cecena was convicted of killing SDPD officer Archie Buggs on Nov. 4, 1978, during a traffic stop. He was sentenced to life in prison without the possibility of parole after shooting the 30-year-old officer four times before killing him with a final shot at point-blank range, according to the San Diego District Attorney's office.According to Deputy District Attorney Richard Sachs on Wednesday, the parole board feels Cecena is no longer a risk to society. The San Diego District Attorney's office believes he should remain in prison."He hasn't come to grips with the crime. He doesn't own the causative factors of this offense. He does not accept his true motivation behind committing this crime," Sachs told 10News anchor Lindsey Pena on Tuesday.The former gang member was 17-years-old at the time of the slaying. His prison term was later modified to seven years-to-life due to his age, making him eligible for Youth Offender Parole.Since then, Cecena has been denied parole at least 14 times, the latest being 2019, 2017, 2016, and 2014. Each time, the seriousness of his crime was cited. The DA's office told 10News last year that Cecena has had an unstable social history in prison, receiving more than 10 violation reports for misconduct.Last year, Gov. Gavin Newsom denied Cecena parole.Tuesday, Pena spoke with Buggs' former partner, Jesse Navarro. Navarro was there the day he and his partner made the traffic stop and remembers the day vividly."It was a planned execution by gang members in the area. They'd been talking about killing a police officer in the area for a number of months," Navarro recalls.Buggs died right in Navarro's arms. Buggs was laid to rest just a month before he was supposed to get married."Not only we became partners but Archie and I became very good friends," said Navarro. 1985
