SAN DIEGO (KGTV) -- A second lawsuit has been filed by family members of a mother and daughter killed by a YouTube star in a deadly wrong-way crash last year.18-year-old Trevor Heitmann, known as McSkillet on YouTube, drove his McLaren the wrong way on I-805 in August 2018. The crash killed Aileen Pizarro and her 12-year-old daughter Aryana. This latest lawsuit was filed August 22nd by Angelo Pizarro and Arcelio Garcia. Pizarro is one of the sons of Aileen Pizarro. Garcia is the father of Aryana. A lawsuit earlier this summer was filed by Aileen Pizarro's other son, Dominic, and her father. The lawsuit claims wrongful death and negligence by the City of San Diego and the County of San Diego. The family is also suing Heitmann’s estate. It states that San Diego police received a “mental case” call that Heitmann was “screaming, paranoid and delusional and threatening to harm his mom.”Police were advised by a licensed psychiatrist that Heitmann needed to be “possibly placed on a 5150 mental hold,” according to court records. However, officers did not speak to or evaluate Heitmann to determine if he was a danger to himself or others. The lawsuit also states that “one or more of the Police Officers represented or implied that they were part of a San Diego County Psychiatric Emergency Team.”Team 10 reached out to both county and city officials. As of Wednesday afternoon, there was no comment regarding the lawsuit from the city. A county spokesperson said they have not seen the lawsuit yet. Cynthia Chihak, the attorney for Pizarro and Garcia, sent Team 10 a statement which reads in part:"I am privileged to represent Angelo Pizarro, the son of Aileen Pizarro, and Arcelio Garcia, the father and sole heir of twelve year old Aryana Pizarro, who were killed on August 23, 2018 when their car was struck head-on by a McLaren automobile driven by Trevor Heitmann... This family is not excusing Mr. Heitmann’ s reckless behavior, but believe this tragic loss of three lives could have been prevented if the City of San Diego has taken seriously earlier reports of his violent and dangerous behavior. The loss suffered by this young man Angelo, of his mother and sister and the loss to Mr. Garcia of his daughter can never be rectified. SAN DIEGO (KGTV) - A shopping trip in City Heights ended with a flurry of anti-gay slurs and a road rage assault.On Tuesday afternoon, Marco Aguirre spent an hour shopping, before heading back to his truck, parked in the 3700 block on University Avenue."I back out and lightly bump the car behind me," said Aguirre, 49.Aguirre says he saw two men emerge from an older-model, red sedan. Aguirre apologized, offering to show his insurance, but the men were agitated."The driver came on my side and the passenger came on the other side. Both of them were screaming," said Aguirre.With his cellphone, Aguirre, who is openly gay, capturing the profanities, including a string of anti-gay slurs. Aguirre was frozen. "I feel terrible. Panicked," said Aguirre.He says the slurs continued for about 15 minutes, before he decided to get out of the car to assess the damage."I see no damage to my truck and no damage to their vehicle," said Aguirre. Aguirre says when he stepped onto the sidewalk, he was attacked."One of the guys grabbed my phone and smashed it into the sidewalk. The same guy punched me in the face, under my left eye," said Aguirre. Aguirre says the two men got in the car and took off, leaving him with swelling under his left eye. The incident also left him determined to find the two men."It's not right. I need to take a stand. SAN DIEGO (KGTV) — A Superior Court judge gave San Diego County restaurants the green light to serve on-site again, but not all will make use of the opportunity.For Roddy Browning, the pressure to reopen his restaurant is intense.“We lay in bed at 2:30 in the morning, going, 'Okay, what am I going to do? What am I going to do tomorrow? What am I going to do the next day?'” said Browning, who owns Oceanside's Flying Pig Pub and Kitchen.Browning said sales are down 60% and employees have been reduced from 30 to 12. Reopening for outdoor dining under the new court ruling could boost those numbers.“The state's going to appeal it, and what is the point in opening back up again, and then bringing all these people back to work and saying okay guys the ruling changed, now we're going to have to kick you out of the restaurant again,” Browning said. “I don’t want to do that to my employees anymore.”Don't get him wrong. Browning does plan to reopen under the new court order - but he wants to respect the full three weeks intended in this latest shutdown order, set to complete on Dec. 28."This is not about us against them," Browning said. SAN DIEGO (KGTV) - A U.S. Marine Corps veteran is spreading the message anyone can do anything they set their mind to.Kionte Storey enlisted with the USMC in 2007. He joined after witnessing the Twin Towers attack in 2001 and wanted to discover himself and push his limits."I did join knowing I was going to go to war." Storey said his second deployment took him to Afghanistan. His team went to investigate a building, ten members went in, leaving him and one other Marine outside."I make two steps in and the IED goes off. It's kinda like a movie or what you would see in video games where everything goes gray, my ears ringing, but it felt like I was hit by a truck."He said he tried to get up but his legs weren't doing what he was asking them to. He lost his right leg in the blast. He propped himself against a wall in the hallway and said he tried to remain calm, focused on the team's safety.Back home, the Semper Fi and America's Fund took care of him, starting with getting a prosthetic leg."Learning how to walk was not the hardest part, it was the easiest part out of my entire experience." Storey said it was the mental game that was most challenging. So he took it head on."I've done more than I think I would have ever done with both my legs, than I've done with one and I've exceeded all my expectations by far." Storey has run marathons, climbed mountains like Kilamanjaro in Tanzania and Vinson Massif in Antartica."It was not only difficult because of the climb itself but but it was a mental break-through that I had that opened a lot of new possibilities of once I got to the summit [of Mt. Vinson]. I was like I can do anything, there is nothing that can stop me at this point." Storey said he hopes his story encourages others facing challenges to keep fighting.The Fund has not left his side, helping Storey buy a house, enroll at Cal State San Marcos, where he's studying Kinesiology, and connect him with Koja, his service dog."He's my best friend and I couldn't see life without him... He's made my life completely worth it."
