SAN DIEGO (KGTV) - A battle is brewing between the San Diego bay cruise companies over which companies can start up again and which ones cannot. Some companies are cleared to resume dinner cruises next weekend, while others are still stuck at the docks. On Hornblower Cruises & Events’ Facebook page, the announcement is up that it's reopening this upcoming weekend. Wednesday, the fleet was docked but starting Saturday, the company is offering dining cruises through the bay. “At the moment, we have not been permitted to leave the dock,” said Carole Noska, owner of Charter Services. She told 10News that her boat and other charters still can't operate bay tours. County guidelines only permit recreational boating, not charters, and the recreational sailing is only for passengers within the same household. The County reports that dining cruises, though, are fine to set sail so long as they operate within the County's dine-in guidelines for restaurants.“We probably lost ,000 to ,000 over Memorial weekend after having already been at the dock for the last two months since COVID started," Noska told 10News and added, “Those of us in the legal charter community the credentialed vessels for charter would just ask that the County and the Port and the State level the playing field.”In a press release, Hornblower Cruises & Events provided an extensive list of safety measures its implementing, including social distancing aboard, and facial covering requirements. The company sent 10News the following statement on Wednesday."In accordance with the latest Stage 2 Variance which now permits dine-in restaurants to operate, we are thrilled to be able to offer a limited choice of seated dining cruises starting this weekend. Like other restaurants within the County, we are adhering to the specific guidelines laid out in the San Diego Safe Onsite Dining Plan for Restaurants and the State guidance for Dine-in restaurants. In addition to already stringent cleaning protocols, we are adapting the onboard experience to reflect the need for social distancing, alongside elevated health and hygiene practices. So, while our Guests can still expect the same high standards and welcoming service, they can be assured we are fully compliant with all relevant and necessary requirements."Flagship Cruises & Events is starting dining cruises as well, but the company is also doing bay tours which is in violation of the County health code. The company was cited by Harbor Police over the holiday weekend but reports that it is continuing its operation, maintaining its allowed to do so under a certain section of County code, which the County disputes. 2679

SAN DIEGO (KGTV) – A catholic priest overseeing a mission in San Diego has been granted temporary relief from the state's COVID-19 restrictions on in-person worship.On Friday, ABC 10News spoke to the attorney representing Father Trevor Burfitt in his legal fight to reopen his Southern California parishes, including St. John Bosco Mission inside the Four Points Sheraton hotel off the 163 and Aero Drive.On Thursday, a Kern County judge issued a preliminary injunction protecting Father Burfitt's churches from COVID-19 restrictions but the ruling does not apply to all churches in the state.“Under the existing blueprint for a safer economy, all of [his] churches are subject or were subject to a total worship ban until the court's ruling yesterday,” said attorney Christopher Ferrara. He added, “That ruling has overturned those restrictions and the churches are now free to operate.”On Friday, San Diego County Supervisor Jim Desmond said that he supported the ruling and added in part, “I think and I always have thought that churches are essential, particularly in these times of high anxiety with having to deal with COVID.”The new ruling stems from a recent lawsuit that Father Burfitt filed against Governor Gavin Newsom and other state and local officials over lockdown measures.The judge ruled in part, "The restrictions at issue here, by effectively barring many from attending religious services, strike at the very heart of the first amendment's guarantee of religious liberty. Before allowing this to occur, we have a duty to conduct a serious examination of the need for such a drastic measure." The ruling goes on to read in part, "The free exercise of religion clause in the California constitution prohibits defendants from treating religious activities worse than comparable secular activities. California's current COVID-related restrictions do exactly that."“Right now, I would say that this decision provides guidance to the public authorities throughout the state and they should follow it,” added Ferrara.Father Burfitt is seeking a permanent injunction. SAN DIEGO (KGTV) - A baby hippo was born Saturday night at the San Diego Zoo and is now freely exploring its habitat, although always under the watchful eye of her mother. The calf, the 9th birthed by Funani since she arrived at the Zoo, is yet to be given a name."Less than ten minutes after it was born, it was already on the beach," Senior Wildlife Care Specialist Jennifer Chapman told 10News. "Out of the pool, on the beach, so right away we knew this was a strong calf."Funani can already be seen exhibiting the behaviors of hippo mothers, including licking sand off her calf, nudging her into the water, and making sure she is coming up to the surface for air. "That bond is already starting and she can start to train the calf immediately," Chapman said. "This is where you go. This is where you don't go. Listen to me. And she goes through all of that with the calf and it's really from minute one."Because Funani is very protective of the calf, the father, Otis, is being kept in a separate area from the other two. They will eventually rotate into the publicly-facing part of the habitat.The last calf born at the Zoo was a male named Tony in 2017. Because hippo mothers typically lose interest in their offspring when they begin preparing to resume mating, Tony was sent to a different zoo in 2019. 1318

SAN DIEGO (KGTV) -- A 74-year-old man reportedly hit a bicyclist with his truck in La Mesa Tuesday before leaving the scene thinking he simply hit a curb, police say. According to police, the crash happened on the 7000 block of University Avenue at 4:19 p.m. Tuesday. Police say the 74-year-old was driving his 1994 GMC pick-up truck when he turned right onto Harbinson Avenue and struck the 21-year-old bicyclist. Police say the cyclist was in a designated bicycle lane. The man kept driving, thinking he hit a curb, according to authorities. “When contacted by the police the driver of the pick-up truck was shocked to learn that he had hit a bicyclist and cooperated fully with the investigation,” La Mesa Police said in a news release. According to police, the bicyclist appeared to have a broken ankle as a result of the crash. Anyone with information is asked to call police at 619-667-1400. 906

SAN DIEGO (KGTV) - A 79-year-old woman struck while crossing a Mira Mesa intersection is expected to recover from her injuries, San Diego Police said Monday. The woman was walking north in the crosswalk of Mira Mesa Boulevard and Black Mountain Road about 5 a.m. when she was struck by a male driver, police said. Officers reported the woman suffered a fractured pelvis, open fracture to the right tibia, and head injuries. She was taken to the hospital. The crash shattered the driver’s windshield. He was not hurt. Traffic backed up for several hours during the morning commute for the investigation. Police have not yet determined who was at fault. 659
