SAN DIEGO (KGTV) - There's a stretch of Linda Rosa Avenue in Bird Rock that winds up a hillside and leads to homes with sweeping views of San Diego's coastline.The homes that enjoy that view, however, vary quite a bit. Some are older, smaller, and were built in the 1960s.Others are modern, and tower above the rest. Some refer to those larger homes as "McMansions," and wonder how they keep getting approved without any pushback from neighbors to protect community character."They basically skirt the reviews," said Dave Ish, who lives in an older home on Linda Rosa.READ?JON HORN'S ORIGINAL LOOK AT 'MCMANSIONS'Developers are able to skip the lengthy and public Coastal Development Permit process as long as they retain at least 50 percent of a structure's exterior walls. It's spelled out in city code. That's why McMansions are popping up in San Diego's coastal neighborhoods. But it turns out the city's 50-percent exemption creates even more flexibility for developers because they can get permit after permit with no waiting period in between.RELATED: Coronado neighbors worried about historic mansion turned transitional homeDeveloper Ben Ryan, of Tourmaline Properties, did that for an ocean-view home on Linda Rosa.In October, the city issued him a permit to add a closet and convert a garage to a carport, under the 50-percent exemption.  "Obviously it was just a temporary deal," Ish said. "Nothing was finished, it was this bowed out paneling, these windows weren't finished. The cuts were all messed up."RELATED: Study: Rents rising faster in affordable areasThe city reports the work being finished Feb. 1. It may have been a quick job, but it changed the layout of the home enough to allow Ryan to alter the design for a larger project.Ryan got a new permit later in February - again under the 50-percent exemption - calling for a second story, master suite, decks, kitchen, living room, dining room, and more. Today, the home is just half a wood frame - the closet and carport nowhere in site. The closet, however, was once a massive frame added on to the home (more photos above):</p><p>In a statement, Ryan said the Coastal Development Permit has become an arduous process - delaying projects a year and adding up to 0,000 in costs."It has no relation whatsoever to bulk or scale," Ryan said. "The bulk and scale of a house designed using the 50-percent exemption is governed by the same rules as a house designed without using it."Ryan said the back-to-back serial permitting simply allowed him more options, such as with windows and openings - under the same rules.RELATED: Man accused of squatting in multi-million dollar Coronado mansions"We are excited about the design of the home, and hopeful that it will be a contender for several architectural awards," he said.A representative for Councilmember Barbara Bry, whose district includes Bird Rock, said her staff recently contacted the mayor's office to address concerns over the 50-percent exemption. 3104

Mother of two, Shannon Crais spent the day at Ocean Beach Sunday. "We live a couple of blocks away, so we come down here a couple of times a week."Her daughter Sam likes to play tag with the waves, as they ripple towards her older brother Alex. The Ocean Beach residents say they know the potential dangers of their favorite play area. "I talk to my son about it because he is a little bit bigger," Craig said. "But my daughter, she stays close. We talk about the ocean being dangerous."Sunday afternoon, the National Weather Service dropped the Beach Hazards Warning for all of San Diego County. But all weekend, beachgoers faced strong rip currents and high breaking waves. This was a point of concern for some, but great news for surfers like Jesus Rodriguez. "I think the hurricane is bringing the swell from down south and it has been awesome!" Rodriguez said. Rodriguez says the waves were much better this long holiday weekend thanks to the high surf advisory. They were so good that he had to share the waves with a lot more people than usual. That is why he was doing two-a-day sessions over the last few days. "You get a lot better waves and a lot better form on the wave, so you can start ripping them up," Rodriguez said. Craig also appreciates the beautiful, ridable waves. As a mother, wants her kids to be safe, but she is not totally against having her children learn about the water on their own."If you get wiped out a couple of times, you gain a little bit more respect for the ocean," Craig laughed. 1678

This Beach Hazard Warning continues until Sunday. Whether you're playing, laying, or even working on this July 4th holiday, spending time at Mission Beach was a dream come true. Especially if you were the Newman family, escaping the Phoenix heat. "When we left, I think it was 114 degrees," Bryant Newman said. They said it just doesn't compare. "We used to hang out a lot at the resorts there locally [in Phoenix], but we have been coming to California for Fourth of July for the last for five or six years," Newman said.But let's not forget about the Beach Hazard Warnings, still in effect until Sunday. "They did warn us about high surf before I left the hotel this morning," visitor from LA, Saira Kinuthia said. Kinuthia is not letting her two boys out of sight. She said while they are here for fun, safety comes first. "We had our talk, and if the lifeguard says that we need to come out of the water, then we have to come out of the water," Kinuthia said. Also keeping a close eye, there was a large police presence along the beaches and boardwalk. While most of the patrols were for alcohol, officers were also regulating the new e-scooter rules that took place on July 1st. Riders must slow down to 8 miles per hour on the boardwalk. But 10News saw many people zooming by. One was an accident between a double-rider and an elderly gentleman, walking on the boardwalk. All parties were okay. San Diego Police said they are giving many verbal warnings and a few citations for what they consider egregious e-scooter violations. Whether it's on the scooter or in the ocean, please remember. SAN DIEGO (KGTV) - The Tierrasanta woman whose toddler died after being discovered in a car was arrested Thursday, San Diego Police said. Police said they waited this long to make the arrest to build evidence for a trial.Twenty-month-old Scarlett was found unresponsive outside the home at 10304 Leary St. on Aug. 5. Paramedics tried to resuscitate the child but were unsuccessful. Police said the girl’s mother, Pricilla Marquez Harris, called them at 12:45 p.m. that day to say she could not find her daughter. Harris later called back to say the girl was in her Nissan Altima and not breathing. RELATED: San Diego police: Child found inside parked vehicle in Tierrasanta dies Two days after the girl died, Harris’ cousin and the cousin’s boyfriend suffered possible drug overdoses at the Tierrasanta home. Harris was taken to a hospital for a psychiatric evaluation the same day, officials confirmed to 10News.Harris is charged with child endangerment, inflicting great bodily injury on a child under the age of five years, and personal infliction likely to produce great bodily injury or the death of a child.
