During a declared state of emergency, it’s illegal for a business to increase prices for essential goods or services by more than 10 percent. The only exception is if businesses can prove their own costs have increased. On March 4, Governor Gavin Newsom declared a state of emergency throughout California. RELATED: Santa Clara County announces first coronavirus deathThe San Diego County Board of Supervisors also extended a state of emergency for an additional 30 days on February 19. “We want county residents to know that we stand ready to protect their consumer rights under the law,” District Attorney Summer Stephan said. “We will strictly enforce violations related to price gouging.”Violations of the price gouging statute could face up to a year in prison and a fine of up to ,000. "We're going to go out when we get citizen complaints and provide them notice and explain to them what the law is," said Damon Mosler, Chief of the Economic Crimes Division for the DA's office. "Do not take advantage of people during the time of crisis or perceived crisis," said Mosler. SAN DIEGO (KGTV) -- San Diegans spend years saving up enough cash for a down payment on a home, but now the FBI says fraudsters are getting much better at stealing it.Hackers are getting into the emails of private real estate agents and escrow companies - duping would-be buyers into wiring their down payment cash to false accounts. They're also getting tipped off by celebratory Facebook photos about accepted offers, using clues like listing agent signs to get in touch with the buyers and pretend to be escrow companies - asking for payment. In all, the FBI says Americans lost nearly billion in real estate wire fraud in fiscal 2017, up 50 fold from fiscal 2016. San Diego special agent Chris Christopherson says the FBI can reverse wire transfers if contacted quickly after they happen. He said internationally they have a day or two, and domestic about a week. He said San Diegans can protect themselves by verifying payment information they get by email either in person or by phone with a trusted source. "Make sure you're not using a phone number you got from the email, be skeptical, verify it separately," he said. The FBI said another way to help protect yourself is to never to reply to emails that ask for financial information. Instead, forward them to the recipient you know, typing in their address. San Diego realtor Gary Kent was selling a duplex last year when hackers got the buyer to wire a ,000 down payment to a fraudulent account. They mimicked an email pretending to be from the escrow company."The buyer went down to the bank, said 'I need to wire the money,' and they said, this wasn't the same account number you did before," Kent said. Kent noted that the bank was able to reverse the transfer. 1804

SAN DIEGO (KGTV) -- San Diego Harbor Police have cited a charter company for violating the county's health order. A sergeant for Harbor PD confirmed with 10News that Flagship Cruises and Events was cited for being in violation. The county health order states that recreational boating is allowed provided all occupants of a boat are from the same household.10News cameras were rolling as people walked onto the Flagship Cruises and Events dock and onto the company's Spirit of San Diego, capturing the boat's departure and arrival back into the bay. It is unclear if those boarding were all members of one family. 10News reached out to the company and a spokesperson sent us a picture of the county health order saying "We are stating we are part of section 14E, not C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."Flagship's website states, "We are Open" and has several sections outlining how they are operating during the pandemic. One section states that masks are required for passengers and everyone must respect six-feet social distancing guidelines. The website also states that all employees will be in masks, gloves and screen upon arrival. Also adding that the company is limiting the number of passengers per cruise to allow for maximum distancing and that they've invested in new machinery to sanitize all chairs between cruises. Harbor Police says the citation for violating the county health order has a maximum fine of a thousand dollars and up to a year in jail. 1702

  

SAN DIEGO (KGTV) - San Diego City Councilman Chris Cate sent a letter to Gov. Gavin Newsom's office on Monday, asking that comedy clubs in San Diego be allowed to reopen safely.The letter requests that performances be allowed to reopen in outdoor settings, with shows lasting no longer than an hour."We're not talking about concerts here where thousands of people are sitting next to each other," Cate said. "These are performances that are done while folks and individuals are having dinner in a restaurant setting, properly distanced, why should they be treated any differently?"Earlier this month, some comedy clubs, like The Comedy Palace in Kearney Mesa, moved their comedy shows outdoors, only to find out they were in violation of public health orders and made to stop.George Salek, co-owner of The Comedy Place, said they have a lot of outdoor space, and people were able to observe social distancing."Eighty people is what we're trying to put in 5,000 square feet," he said. "It's really safe."Cate said San Diego's entertainment industry is an important part of the economy."I think anyone who can fit the confines of what we want to have done," Cate said. "If you're all able to comply with all, you should be allowed to reopen absolutely." 1259
