SAN DIEGO (KGTV) --The FDA has placed new restrictions on a controversial birth control device called Essure.The maker of the implant, Bayer, will only be allowed to sell to providers who agree to fully inform women about the risks and side effects.A San Diego woman who had the Essure implant is now suing the physician who performed the procedure.She says she wasn't given enough information and wants to warn others about her experience.Three months after Essure was implanted she began experiencing severe pain. She eventually had a full hysterectomy. 568

SAN DIEGO (KGTV) Sewage contaminated water is keeping swimmers out of the ocean in Imperial Beach. Late Tuesday afternoon, The County of San Diego Department of Environmental Health extended an existing water contact closure to include all of Imperial Beach. The original closure was issued on June 27th for the Tijuana Slough National Wildlife Refuge shoreline. According to the county, sewage-contaminated runoff in the Tijuana River has been entering the Tijuana Estuary. Eric Syverson is a life long resident of Imperial Beach. He keeps a close eye on what's happening in the Tijuana River Valley. "It was dry on Saturday, not dry on Sunday. Monday, we wondered what was going on and now, Tuesday, there was quite a bit of flow this morning and it just smelled horrible and it’s green,” said Syverson. The water was pooling under the bridge on the north side of Dairy Mart Road. "At six a.m. this morning, probably double the volume that’s flowing right now and the air was twice as bad, you couldn’t breath under this bridge this morning," said Syverson. According to a San Diego inspector with the International Boundary and Water Commission, there was transboundary flow Monday night into Tuesday morning from a ruptured potable water line. The IBWC estimates 300,000 gallons of treated and untreated wastewater flowed into the U.S. Initially, the IBWC said the figure was much higher; roughly two million gallons. The number was revised after the inspector determined their gauging station was not accurately recording the flows. Members of Citizens Against Sewage are skeptical. "I’m looking at the gauge data from the river gauge from IBWC's information. We put values on those numbers that they provide, and it’s over seven milllion gallons,” said Lance Rodgers, Co-Founder of Citizens Against Sewage. This is just the latest in a series of sewage spills that have closed South County beaches."There were flows on the second, there were flows on the 30th, the 28th, 24, 23, 20, 19 it’s been a bad month,” said Syverson. Syverson said it's the same problem with no solutions from either side of the border. "I mean, why should we even have to think about it. It's July 9th, we should be at the beach right now, going "God, look at how gorgeous this area is," not standing in a horrible valley wondering how to solve a problem that’s existed for my entire lifetime," said Syverson. The county will continue taking water samples Wednesday morning, but it takes twenty-four hours to get back the results. 2522

SAN DIEGO (KGTV)- Students at some private schools in San Diego returned for on-campus learning Tuesday.The Academy of Our Lady of Peace in Normal Heights is one of them. The 138 year-old Catholic, all-girls high school is the oldest in San Diego.Solana Musicant is excited to start her senior year."I think this is kind of the new normal, I think getting used to it now is really good," said Musicant.Head of School Dr. Lauren Lek said they began preparing for this day as soon as the school year ended."It's about layer upon layer of safety," said Lek.Those layers include face mask requirements, social distancing, and temperature checks upon entry."From our plexiglass desk to 6 feet physical distancing to make at all times to only eating outdoors to even our UV lights that are on in our buildings to help make sure all bacteria and viruses are cleaned out before the air comes into the classrooms," said Lek.Lek says the changes cost more than half a million dollars. The twenty-thousand dollar a year tuition and donations paid for the upgrades.It's an investment Musicant appreciates."I learn better in person, having a teacher there than I do virtually."Lek says 15% of the roughly seven-hundred plus students chose to continue learning virtually from home. 1275

SAN DIEGO (KGTV)-- Some Mission Beach residents say they are fed up after their streets are piling up with trash. They say designated parking spots for e-scooters have remained uncleaned for months, causing concern for flooding. It's all fun and games until it's not. "When the rainy season does happen, you will see Mission Beach flooding," Mission Beach resident and Town Council VP, Greg Knight said. First, the problem was unsupervised parking. E-scooters were piling up all over the neighborhood. Now, they are giving Mission Beach residents a new headache - their corralled parking spots."This [Corral] gets filled a lot of times with leaves, sand, debris," Knight said. "We have a lot of party rentals that go on here, which means excess trash."All of the debris should be swept up twice a week on Mission Boulevard. But since the City of San Diego put in the e-scooter parking corrals in July, Knight says these areas have remained untouched. "When this washes down, that's the stuff that goes into the storm drain and will actually block it up," Knight said. Knight saw a City street sweeper driving around the corrals, even after he says the Mayor's office promised street sweeping would not be affected. SAN DIEGO COUNTY (KGTV)-- Scattered showers sprinkled all across San Diego County Saturday, bringing with it up to a quarter inch of rain. While rain totals were not significant, it was the reason for hundreds of car accidents.At 11:40 AM, 10News found a passenger van flipped onto its side. The driver said he was turning onto the Home on-ramp on WB 94 when he hydroplaned and flipped over. With some help from good Samaritans, he was able to climb up out of the passenger side door. He was not hurt. There were no passengers. One of many solo spin-outs happened on the 163 S to the 8 E on-ramp. The driver said at around 12:30 PM, he lost control of his truck at the top of the loop, then smashed into the concrete barrier. He said he felt lucky he did not roll down into a 50-foot embankment like another car did just a few hours prior in the same spot.RELATED: Check today's San Diego forecast10News crews also saw countless fender benders and flatbed tow trucks roaming the highways. Mother nature also wreaked havoc onto herself. At around 2:30 PM, a tree toppled onto Northbound 805 near Plaza South.Branches partially blocked the slow lane until clean up crews arrived.By afternoon, the rain clouds started to concentrate over North County. A three-car crash happened along Westbound 78 near the Nordahl Rd on-ramp in San Marcos. The small red vehicle ended up mangled, and the Prius somehow climbed up an embankment. Firefighters said all airbags on the Prius were deployed, and thankfully no-one was injured. 1526
