RUTHERFORD COUNTY, North Carolina — A teen who shot and killed her mother's boyfriend will not be charged, authorities said.The Rutherford County Sheriff’s Office and the District Attorney’s Office said on Aug. 8, Chandra Nierman's 15-year-old daughter shot the 46-year-old male as he was attacking Nierman.Her other children, a 12-year-old son, and a 16-year-old daughter were there when the violence occurred. Sheriff's deputies said the man was threatening to "cut Nierman’s throat and kill everyone in the house."A release from authorities said:"Nierman’s twelve-year-old son retrieved a firearm and Nierman’s fifteen-year-old daughter took the gun from her brother and fired it twice, striking the deceased male in the chest. One of the fired rounds fragmented, grazing Nierman’s sixteen-year-old daughter in the leg."The 16-year-old was taken to a hospital and was released."Nierman suffered significant bruises and contusions from the assault," the release said.The investigation also revealed the deceased man had threatened Nierman several times previously, and four days before, he had assaulted Nierman and fired multiple rounds from a firearm inside the residence to threaten and terrorize her."The investigation further revealed that the deceased male, who had multiple firearms in the house and frequently carried one on his person, was a convicted felon and had two active domestic violence protection orders against him from two different women in Indiana and Ohio, although no domestic violence or assaults had been reported to law enforcement locally prior to the fatal shooting," the release said. "The deceased male has been positively identified as Steven Kelley, originally from Indiana."Based on the facts and the evidence, "it is the conclusion of the District Attorney’s Office that the shooting was justified and no charges will be filed," the release states. 1903

They'll wait until county clerks can determine if opponents led by tobacco companies filed enough signatures to put the new law to a statewide vote. RMH Franchise Holdings, a company that operates a number of Applebee's restaurants, announced this week that customers who used credit cards at some locations may have been subject to a data breach. "Upon learning of a potential incident, RMH promptly launched an investigation and obtained the help of leading cyber security forensics firms," the company said in a statement. "Based on the experts’ investigation, RMH believes that unauthorized software placed on the point-of-sale system at certain RMH-owned and -operated Applebee’s restaurants was designed to capture payment card information and may have affected a limited number of purchases made at those locations."The company said that customers’ names, credit or debit card numbers, expiration dates and card verification codes were subject to the breach. Customers who used Applebee's tabletop payment system, or its online ordering system were not subject to the breach.RMH said that customers should closely monitor their payment card statements, and check for any unauthorized transactions. If customers notice any unauthorized transactions, they should contact their bank.RMH said that it learned of the incident on February 13, and has since contacted law enforcement. "RMH is continuing to closely monitor its systems and review its security measures to help prevent something like this from happening again," the company said. The company did not say why it waited three weeks before notifying the public. Many of the affected transactions took place from December 6 through January 2. Instead, one Ohio man is doing the opposite.Robert Blocksom, 87, is looking for a job, and he’s not alone.“It's definitely a trend. The bureau of labor statistics is predicting an increase over the next five years," Lori Long and Entrepreneurship Professor at Baldwin Wallace University said.In the last year, nearly 300,000 Americans 85 and older were working. That number is up 3 percent from the start of the 2006 recession.Industries, like the trucking industry, who years ago might not have given Blocksom a shot, could now do just that.“The shortage of drivers spans the entire country and virtually every trucking company in the United States," Frank Gagyi, President of the Buckeye Interimobile Trucking company in Cleveland said.And that’s where Blocksom is hoping a door will open.“I've always liked driving, so I figured that I'd like to be able to make some money driving," he said.Since his wife's been ill, he's had to sell his home, mobile trailer and other assets to cover expenses. Now he says trucking is a practical solution for income.“That would be the best way to do it," he said.And though it’s something he has to do, he’s pretty optimistic about trying something new."I believe I can do this pretty well, and it would be a nice challenge and it'd be fun,” he said.Blocksom still has to pass his commercial driver's licenses test for him to start working. His classes for that test start next month. He said the ideal shift would be local weekend trips, so he can still care for his wife.  1638
