The officer who fired the gunshots in a deadly swatting prank will not be charged as a Wichita, Kansas prosecutor ruled that the officer "acted reasonably," the Wichita Eagle reported on Thursday.Andrew Finch was killed on Dec. 28 after a prankster called the Wichita Police claiming that Finch was holding the caller hostage, and that multiple others had been shot. When police entered the home, they did not know at the time that the call was a prank. District Attorney Marc Bennett said Thursday that officers believed that Finch was reaching for a gun at the time of the shooting. Officers claimed that Finch was reaching for his waistband, and did not follow instructions to keep his hands up. "This shooting should not have happened," Bennett told the Wichita Eagle. "The officer's decision was made in the context of the false call."Finch was shot roughly 10 seconds after he opened the door. An autopsy confirmed that Finch was wounded by multiple bullet fragments, the Eagle reported. "The family's devastated and the family is disappointed by the decision of the district attorney today," Finch's family attorney told the Eagle. While many questions remain in Washington, like whether President Donald Trump has the votes to replace Ginsburg before the election, one thing is clear: issues will come before the Supreme Court very soon.HEALTH CARE ARGUMENTS IN NOVEMBERWhile election issues are expected, the future of the Affordable Care Act is an issue guaranteed to come up before the Supreme Court soon. A hearing is set to take place one week after the election regarding whether the law can be struck down. Essentially, Republicans from around the country believe that the only reason the Supreme Court upheld the law in 2012 was because the opinion said Congress has the power to tax. Since that time, however, Trump has removed the tax penalty for not having health insurance. The thinking from some conservatives is that since the tax penalty is gone, the entire law can be struck down now, too. WHERE THE COURT STANDS Prior to Ginsburg's death, the general thinking was that the law would still stand. It faced a challenged in 2012, but Chief Justice John Roberts sided with four liberal justices to uphold it. With Ginsburg's passing, there are only three liberal justices on the court. If Roberts joins the liberal justices it would create a 4-4 tie. "If there is a 4-4 split on the court, then no precedent is set and whatever the lower court decided stands," Professor Paul Schiff Berman with George Washington University said. That would mean parts of the Affordable Care Act can be struck down since lower courts have already ruled in that way. If Trump is able to get another nominee on the court before the hearing, it would only make the court more conservative. Berman cautioned though that other conservatives could potentially join the liberals on this case since the lawsuit's legal standing is murky. The Louisville Metro police department has fired one of the police officers involved in the fatal shooting of Breonna Taylor. A termination letter for Officer Brett Hankison released by the city’s police department today said Hankinson violated procedures by showing “extreme indifference to the value of human life." The letter also said Hankinson violated the rule against using deadly force. Taylor, who was Black, was shot eight times by officers who burst into her Louisville home using a no-knock warrant during a March 13 narcotics investigation. The man accused of killing 17 people at Marjory Stoneman Douglas High School in Parkland, Florida earlier this year reportedly attacked a detention officer inside a Florida jail Wednesday morning.WTVJ-TV in Miami spoke to the Broward County Sheriff's office in Miami, who confirmed that Nikolas Cruz attacked an injured a detention officer at the Broward County Jail Wednesday morning. The condition of the injured officer is unknown.Cruz is the suspected shooter in the Feb. 14 shooting at Marjory Stoneman Douglas High School in Parkland, where 17 students and teachers were killed. Cruz was charged with 34 counts of premeditated murder and attempted murder in March and is currently awaiting trial.More on this as it develops.  779
