SAN DIEGO (KGTV) -- There is road rash on his forehead and a smile on his face. "Just hangin' in there, man."Julio Vazquez is in a hospital bed at U.C.S.D. Medical Center in Hillcrest, his broken leg in a cast from above the knee to his toes.  "The pain I have is in my right leg.  Once I move it, it's a crazy pain, really bad. My right rib, one is broken and when I raise my voice, it hurts really bad."It was Sunday night about midnight in Ocean Beach. He had pulled over to assist a stranded couple on the shoulder of Sunset Cliffs Blvd.  The Ocean Beach man was trying to help start their white Lexus when another car slammed into them. The impact peeled back the door of the Lexus and propelled Julio into the air, over his own car, and into the ditch.Paramedics were soon on-scene; as his wife and two young children watched.Vazquez was doing a good deed; and paying a price for it.  "Stuff happens. Doesn't make me feel bad. It's just something I do when I see somebody needs help."Now he needs help; could be off work for several months and people are responding.  A GoFundMe page was set up to help offset costs; asking ,000.    "It feels great! Never thought so many people were gonna be helping me: people texting, social media, something surprising."As for the driver who took off, he said,   "If I was in his position, I'd go to the police."Despite the pain and his uncertain future.  "I don't have anger at nobody. SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. Lake’s father says the young boy is expected to testify in the trial later Thursday.Lake is still receiving extensive treatments for his injuries.RELATED: Jury deadlocked in case against driver accused in San Ysidro hit-and-run?Banda was speeding west on Camino de La Plaza around 11:30 p.m. on May 6 when he reportedly ran a stop sign at Dairy Mart Road and crashed his pickup into a Honda Accord carrying the Lake family. In September of 2017, a jury found Banda guilty of misdemeanor charges of driving without a license, battery and vandalism. The jury was hung, however, on felony charges of hit and run causing death or permanent injury, DUI causing injury and driving with immeasurable blood alcohol causing injury.  1866

SAN DIEGO (KGTV) - The San Diego Police Department is preparing for the possibility of big demonstrations on and around Election Day. "We don't have any credible information to say that there's going to be civil unrest or large protests groups out on Election Day or soon thereafter on Election Day. However, we have been in contact with other cities throughout the United States. We've been in contact with our federal partners throughout the United States. We're preparing for possible unrest to occur on Election Day and afterward," said SDPD Lt. Shawn Takeuchi.SDPD will not reveal exact staffing levels but said that officers will be ready to handle the calls. Lt. Takeuchi added that SDPD has nine stations throughout the city and it’s up to each station's captain to determine appropriate staffing levels for the election. He said that officers are mindful of concerns surrounding the ballots and the pandemic. “As humans, when you don't know your future, I think it brings out a little bit of anxiety and so I think that we are aware of that and the emotions,” Takeuchi added.Sean Eldridge, with Protect the Results, told ABC10 News his group is focused in part on preparing several upcoming rallies in San Diego and beyond.“Part of our work at Protect the Results is to encourage every American to be patient and realize that it could take days if not longer before we know the full count of this election,” said Eldridge. "We have nearly 400 pre-planned events across the country which could happen as early as the afternoon of Wednesday, Nov. 4, the day after Election Day, if Trump were to try to undermine the election results.”Eldridge says that participants are being encouraged to remain peaceful.Lt. SAN DIEGO (KGTV) -- The San Diego Unified School District says it has removed a letter from President Trump inserted into food baskets that, according to the district, downplays the importance of wearing a mask. The district says the letter “significantly diminishes the scientifically-backed importance of wearing a mask to protect against the transmission of COVID-19.”According to the district, the letter was placed into boxes of free groceries set to be distributed to 50 million families across the country.The district says President Trump’s letter recommends that Americans practice social distancing and “consider wearing a face covering in public.”“Science is clear: wearing a mask works to prevent the spread of the coronavirus,” Superintendent Cindy Marten said. “Masks are required in California and on every San Diego Unified school campus. It is not optional, as the President wrote in his letter.”The state currently requires that people wear face coverings when in public spaces, indoors, and areas where physical distancing is not possible. 1066

SAN DIEGO (KGTV) -- The San Diego Police Department says pedestrian fatalities are going up in California - so they're cracking down on drivers, pedestrians and those violating laws that pertain to motorized scooters. All of this, just as new reports show a flood of scooter-related injuries backing up local emergency rooms. Wednesday night SDPD sent out targeted patrols to downtown and Lincoln Park. Two spots where pedestrian and bike collisions have increased in the last three years. In many cases, traffic violations led to those crashes. 10News watched as officers ticketed more than 50 people, and gave out more than 20 warnings. Sixteen of those tickets - to people on scooters.  727
