SAN DIEGO (KGTV) -- A San Diego county father is speaking out about his family's close call caught on video during an off-road race down in Baja, but the driver behind the wheel says it's not what it looks like. Earlier in April, Matt Scarpuzzi of Alpine and hundreds of other drivers were participating in the "San Felipe 250" when he says another driver deliberately drove through a group of spectators, including his wife and two young children. In this type of racing drivers can deviate from the set course as long as they make it to the checkpoints, so technically it wasn't against the rules."I couldn't believe that was the best decision, in my opinion, it jeopardizes the fan safety and it jeopardizes a sport that I love," said Scarpuzzi.The man behind the wheel, B-J Baldwin, spoke to 10News and said it looks worse than it actually was.  "I had 100 percent visibility, I knew where everybody was at, knew everybody was safe. Again I was only going about 2 miles an hour when I drove through these tents," Baldwin said. He posted the video on his Facebook page and offered to replace anything he damaged. "I assured everybody that no one was in danger and I was very very careful when trying to re-enter the course and access the course," said Baldwin.  1317

SAN DIEGO (KGTV) — A judge has issued a temporary restraining order against the City of San Diego, barring them from removing pepper trees in Kensington.The trees are more than 100 years old, planted when the neighborhood was first marketed as a housing development in the early 1910s. While the neighborhood was once filled with them, resident Maggie McCann estimates there are only about 33 left.“I think they are pretty looking,” said McCann. “They’re part of the fabric of the neighborhood.”McCann was one of the residents who filed the TRO against the city. She said she has been working for more than a year to designate the remaining pepper trees as “Heritage Trees” and “Parkway Resource Trees” under the City’s Conserve-a-Tree program.When she heard a pepper tree on the 4500 block of Edgeware Road had been cut down on Monday, she rushed to process the TRO.“We don’t know why these trees are being cut down,” said McCann.McCann suggested it may be related to a plan to bury SDGE utility lines in the neighborhood, but the City of San Diego denies that claim.In a statement to 10News, a city spokesperson said the tree that was cut down Monday had been “evaluated more than a year ago as part of a project to repair a damaged and uneven sidewalk caused by the tree’s growth. Noticeable decay and deteriorating tree structure were also observed during the evaluation and the adjacent property owner was notified at that time.”On Tuesday, the remnants of the trunk remained on Edgeware Rd. Decay could be seen in the interior part of the tree, though much of the large trunk appeared to be healthy.“The tree really didn’t need to be removed,” argued McCann.But the city said their decision was more about damage to the sidewalk than whether the tree could have survived a few more decades.“In this instance, the imperative to make the sidewalk safer for residents was weighed against the city’s desire to preserve neighborhood trees and continue to grow our urban canopy. Due to the tree’s damaging impact to the adjacent sidewalk and its decaying state, the decision was made to remove it in order to preserve public safety,” wrote the city spokesperson.A resident on the block said the sidewalk had been recently replaced. The new pavement had been cut around the tree and was undamaged.Several other pepper trees in Kensington have been marked for removal. On Tuesday, McCann walked the streets, posting copies of the TRO on the trees.The fate of those trees remains unknown. SAN DIEGO (KGTV) - A man who was attempting to paint graffiti on a downtown building fell to his death Friday morning in East Village. The incident was reported about 8:30 a.m. on 15th Street near Broadway, across from San Diego Police Headquarters. SAN DIEGO (KGTV) -- A La Jolla hardware store is being forced to remove their popcorn machine they say was used to give the buttery treat to customers for free over the last 25 years.According to a food inspection report, the Meanley and Son Hardware on the 7700 block of Girard was investigated for serving popcorn without a permit."Everybody has had fun with this until now, but we have to obey the law," said co-owner Bob Meanley.One of the store's owners says the inspection happened after someone complained.A customer reportedly saw another person reach into the popcorn machine barehanded."I’m sorry we can’t continue with the popcorn, but we’ll do it with everything else," added Meanley.In the report, the inspector said the small Gold Medal brand popcorn maker was seen in use and with “popped popcorn prepared.”The report forces the hardware store to stop making popcorn and to remove the popcorn machine from the building.If the shop wants to give away popcorn, according to the health department, they’ll have to go through the permitting process. A process which will also legally require that the store install three compartment sinks. The store says staff regularly cleaned the machine and refilled it with popcorn throughout the day for customers to enjoy.The hardware shop has an extensive history in La Jolla. SAN DIEGO (KGTV) - A patient at a North Park dental office got upset after she got hit with surprise fee.Two Thursdays ago, Linda Morrow - donning a mask and gloves - went to Pristine Dental Group for a root canal and bone grafting. After the procedure, Morrow, who doesn't have dental insurance, paid cash for the bill. It was in line with the estimate."The total bill was 0. I didn't have change, so I gave them 0 because I only had bills," said Morrow.Morrow says when no one in the office could make change, the receptionist spoke up."She commented, 'Oh, PPE.'" said Morrow.Morrow says her new bill was for 0 dollars, including a charge for personal protective equipment used by the dental staff."That shut my mouth. I was stunned," said Morrow.Confused, Morrow paid the full amount and left."My concept was that it was definitely an afterthought. If I had exactly 0 or my debit card, I would not have had to pay the charge," said Morrow.Morrow posted details of the charge of the Nextdoor app. Quickly, several neighbors responded that they also have paid similar charges at their dentist offices, ranging from to .
