OCEANSIDE (CNS) - An attempted murder of a peace officer conviction was overturned Friday for a man accused of intentionally running down a motorcycle officer during a routine traffic stop in Oceanside, after an appellate court ruled that his attorney ignored the defendant's argument that he was innocent of the crime.Roberto Ignacio Flores was sentenced to 29 years to life in prison for allegedly running his car into Oceanside Police Officer Brad Hunter on June 19, 2017, leaving the officer hospitalized with life-threatening injuries that kept him out of the field for just over six months.While Flores contended that he was not the driver of the Dodge Neon that struck Hunter, Flores' attorney, John Wilshke, argued at trial that Flores was the driver, but did not have the intent to kill required for an attempted murder conviction.RELATED: Oceanside officer targeted in hit-and-run is back homeFlores also disagreed with his lawyer's concession on weapons possession charges related to a collection of guns found at his home.A three justice panel ruled Friday that Flores' sixth amendment rights were violated, as he was not allowed to present the defense of his choice.The Hunters released this statement to 10News:"Obviously we are very disappointed in the decision by the 4th DCA but confident that a retrial will result in another conviction - Attempted Murder of a Peace Officer - and the appropriate sentence. It's a shame our justice system indulges games such as the ones he is playing - subjecting the victims of horrific crimes like this one to further emotional distress and further wasting the tax payers money but we are confident that justice will ultimately prevail."In a statement, The Oceanside Police Department said: "Regardless of the court’s decision, it is our continued hope that Flores is brought to justice for the willful assault on Officer Hunter."Trial prosecutor Keith Watanabe, who said he is preparing for a retrial, described the defendant as "very dangerous and evil" and said Flores "bragged about striking the officer and putting him in a wheelchair." "We are disappointed by the ruling. When Flores was sentenced to 29 years to life in prison, we believed justice was served and that we would never have to see him again. Unfortunately, we face the daunting task of having to take him to trial all over again.," Watanabe told 10News. "He proved himself to be erratic and dangerous and we will do everything in our power to protect police officers and the community. He will be re-tried. ""I spoke to Officer Brad Hunter’s family. They are discouraged and frustrated by the injustice of having to see Flores in court all over again. While in jail, he called his girlfriend and told her to claim she owned the guns, since she didn't have a prior felony conviction, the ruling states.He also said the officers "harassed and mocked him" and swore "that when he was released he would go after the people who were responsible," according to the ruling.On June 19, Hunter, a 29-year veteran of the department, was struck while pulling over a driver for an expired registration near Oceanside Boulevard and Foussat Road.RELATED: Injured Oceanside officer hit by driver now awake, 'in good spirits'Flores, who was not involved in the traffic stop, allegedly accelerated and veered directly into Hunter, scooping him up and flipping him over the defendant's car. Hunter suffered head injuries and his leg was broken in three places. The officer had to be placed in a coma until swelling on the brain subsided. Hunter testified he has no memory of the crash.Flores sped away but was captured a few minutes later, Watanabe said.Once in a jail cell, Flores told a sheriff's detective posing as an inmate and a confidential informant that he intended to hit Hunter and wasn't sorry about it, according to the prosecutor."He (Flores) said, `I got one. In that case, Robert McCoy was accused of murdering three of his wife's family members. While McCoy sought to maintain his innocence at trial, his attorney pursued a defense that involved admitting to the killings. In a bid to avoid the death penalty, McCoy's attorney argued that the defendant suffered from severe mental issues, and pursued a second-degree murder conviction instead.Jurors recommended death sentences, but McCoy's convictions were overturned and a new trial was ordered. 4999

OTAY MESA (CNS) - Authorities Tuesday released the names of a 70-year- old man and the two San Diego police officers who shot him in Otay Valley Regional Park in Otay Mesa when he allegedly pulled out a handgun that turned out to be a replica.Around 6 a.m. Thursday, Officers Jeremy Huff and Filip Perry from the Neighborhood Policing Division were in the park, near the 500 block of Beyer Way, to conduct an outreach and cleanup operation in conjunction with other city agencies when they encountered Carlos Soto, who was staying in an illegal encampment, according to Lt. Andra Brown of the San Diego Police Department."When officers approached the man, he produced a handgun," Brown said. "Officers gave the man commands to get on the ground. OCEANSIDE, Calif. (KGTV) - A partnership is turning around the lives of young people at risk in North County. As 10News explores Life in Oceanside, we’re turning our focus to the success of the Boys & Girls Club. One of the young people helped by the program is 17-year-old Hunter Meyer. Like many teenagers, he struggled to find himself. RELATED: Mayor Pete Weiss talks Life in Oceanside“I became someone who preferred to sneak out late, get into a lot of trouble and run-ins with police,” said Meyer. Meyer said he started hanging out with gang members in sixth grade. As a freshman, he was kicked out of high school. Life became more difficult for him. “We were drinking and I came back just feeling like I’ve lost everything. I kind of lost who I was, you know, and then the next day I tried to hang myself and my mom and little brother walked in. That was kind of the turning point where I realized things needed to change drastically,” Meyer said. RELATED: Oceanside businesses continue to rely on thriving military communityMonths later, Meyer found out he was referred to a program to help at-risk youth called Oceanside Youth Partnership. It was started by Oceanside Police Lt. Valdavinos. “The people he was dealing with didn't have positive relationship with law enforcement and we weren't getting to them early enough,” said Ashley Sanchez, an OYP crime prevention specialist and mentor. Meyer was in the first class, spending two hours per week for 12 weeks to be redirected away from gangs. On Friday, the U.S. Food and Drug Administration's list of hand sanitizer products to avoid grew to 101 entries.Based on FDA test results, these products have "concerningly low levels of ethyl alcohol or isopropyl alcohol, which are active ingredients in hand sanitizer products," according to the department.The list includes those subpotent products, as well as those that may be contaminated with methanol. OCEANSIDE, Calif. (KGTV) — San Diego County's third-largest city has three-and-half miles of coastline and is centrally located between Los Angeles and San Diego, making it a natural stop since its earliest days in the 1880s. "Originally, it was on a train depot. It was called Ocean Side; two words," said John Daley, a third generation resident, as he perused photographs at the Oceanside Historical Society. The two-room office near City Hall has become a repository for some 30,000 images and Daley seems to have an anecdote for every one."They had 11 saloons at one time in the 1880s, so apparently they liked saloons," said Daley. "It was a mostly male community at that time and that would be the place to go and eat and socialize. And there wasn't a lot of drinking in the saloons as there is today," Daley said.In fact, the story of Oceanside has a very practical side. Consider the name: Oceanside. Daley says you can thank farmers bound to the nearby fertile inland valley who would occasionally take a break. "They would go to the 'Ocean Side' to go have some fun. And that really became Oceanside," Daley said.Rail lines came in 1881, prompting a homestead in '83, and incorporation in 1888. Founded by land speculator Andrew Jackson Myers, Oceanside was born with 1,100 residents. Numbers destined to rise into the next century as the coastal community continued to become more connected by rail and road. "As soon as they had cars come here we were kind of the easy stopping point between Los Angeles and San Diego or Mexico. We became very prominent for that," said Daley.Oceanside beaches became go-to destinations via the new Highway 101 and business grew. Then came World War II and Camp Pendleton. Oceanside's now 5,000 residents would be outnumbered by a military migration. "As the story goes, they brought in about 7,000 people to build the base because it was such a large base, obviously," said Daley. "Oceanside had to come to grips with feeding, housing and recreating those people. So, people lived everywhere. They lived in sheds and garages."And Daley says an even greater boom would follow in the 1960s and 70s as the region became more well known. Oceanside grew at a rate of 2,000 homes a year while catering to millions of travelers. "Even the restaurant I eventually owned at one time — the 101 Cafe — was called the 101 Cafe and Trailer Park because they allowed trailers in the back of their lot," Daley added.Travelers still stop and some stay. But Daley believes the city is fairly built out at this point. He sees slow growth ahead but a bright future. "We have a beautiful city. I had a restaurant and the tourists always thought they dropped off in paradise when they came here," Daley said. 3019
