CHICAGO — An infant cut from his mother's womb in a gruesome crime opened his eyes briefly on Sunday for his father. Marlen Ochoa-Lopez, 19, was nine months pregnant when she was killed and her unborn baby — a little boy — was cut from her womb. The infant is reportedly in grave condition and on life support in the neo-natal intensive care unit, according to CNN. Friends and family of the baby's mother released an image of the baby and his father together in a hospital room this week.There will be three days of visitation for Ochoa-Lopez on Thursday, Friday and Saturday. Her funeral will follow the Saturday visitation at the Mount Auburn Funeral Home in Stickney, Illinois. So far three people have been arrested in connection with the crime. 763

CINCINNATI — It's your right as an American to give people the finger, even if the recipient of your flipped bird is a police officer, a federal appeals court ruled this week.The case centered around Debra Cruise-Gulyas, a Michigan woman who displayed her middle finger to a police officer who had stopped her for speeding and written her a ticket for a lesser violation in 2017.The officer, Matthew Minard, then stopped the woman again less than 100 yards away and amended the ticket to a speeding violation.Cruise-Gulyas later sued Minard, alleging that he violated her constitutional rights by pulling her over the second time.The case eventually made its way to the Sixth Circuit Court of Appeals in Cincinnati, and a panel of judges ruled on Wednesday that stopping Cruise-Gulyas because of the gesture was a violation of her First Amendment rights."Fits of rudeness or lack of gratitude may violate the Golden Rule," Judge Jeffrey S. Sutton wrote. "But that doesn't make them illegal or for that matter punishable or for that matter grounds for a seizure."Cruise-Gulyas hadn't done anything illegal to prompt the second stop, the judges ruled."Minard should have known better here," Sutton wrote. 1214

EVANSVILLE, Ind. — An Indiana teen has died after attempting an internet challenge called the “choking challenge,” according to his parents. Mason Bogard’s mother, Joann Bogard, shared a message on Facebook Sunday saying she wanted the information about his death to come from the family. “We’ve learned that Mason attempted a challenge that he saw on social media and it went horribly wrong,” Joann wrote. “The challenge that Mason tried was the choking challenge. The choking challenge is based on the idea that you choke yourself to the point of almost passing out and then stop. It’s supposed to create a type of high. Unfortunately, it has taken the lives of many young people too early and it will take our precious Mason.”Mason was rushed to the hospital where his mother says he remained on life support until they determined he could not survive. “Over the last several days the amazing staff at the Deaconess Hospital has done everything they can to bring Mason back to us. Unfortunately, we will not have the opportunity to experience so many things with our child because of a stupid challenge on social media,” her post read. On Monday, Mason became an organ donor. Joann posted on Facebook that her son would save six people’s lives. “While we are devastated that we will never experience so many things with Mason again, we are able to find some comfort in the fact that Mason will save the lives of others. He would have wanted it this way," she wrote. "He was an extremely generous young man.”She also issued a plea to parents to pay attention to what their children are doing on social media, so that another family doesn’t have to go through the same pain that they have. “Finally, we want to plead with you from the bottom of our hearts ... please pay attention to what your children look at on social media," the mother wrote. DENVER — The Colorado Department of Health and the Environment has approved a major change to the way state birth certificates work.During its monthly meeting on Wednesday, the board voted to allow more identifying options for birth certificates. There will now be four options: male, female, X and intersex.The move follows a state change on Nov. 30 to driver’s licenses and identification cards that added the third option of "X" for a person’s sex. When a child is born, their birth certificate will only have three options: male, female and intersex. "X" is left out since it is not a biological characteristic, Chris Wells with the department of helath and environment said. It will be available for adults who want to amend their birth certificates.The board of health also approved simplifying the process to change the gender identity on a birth certificate. Under current requirements, a person must undergo gender reassignment surgery and prove it to a judge in order to qualify for the change to their birth certificate. Under the newly approved rules, those wishing to change their identities would simply need to fill out a form — no surgery required. Minors will also need a note from either a doctor or a mental health professional supporting the transition. Those who want to change their gender identity can only do so once without a court order. Advocates for the new rules said the gender reassignment surgeries are expensive and those who want to change their gender identity may not even want the surgery."Transgender individuals often face significant discrimination in the employment housing and healthcare and having a birth certificate that accurately describes exactly who they are is huge in reducing the discrimination," said Emma Shinn, a transgender former marine. She was in attendance Wednesday morning. This decision comes in the wake of a civil lawsuit brought by a 13-year-old against the state after he was not allowed to change his gender identity on his birth certificate. This is one of several changes the LGBTQ community is fighting for. Two others could play out in the Colorado state legislature during the next session:First, advocates said they want state ID cards to change the identifying wording from “sex” to “gender” in order to better correlate with how people feel about their identity, rather than how they were born.Second, advocates want a change to Colorado law when it comes to a transgender person switching their name to better reflect their gender. Right now, Colorado law requires a transgender person to seek a court order and print their old and newly chosen names in the newspaper three times within 21 days before officially making the switch. Advocates said that requires these individuals to out themselves to their entire community unnecessarily. 2827
