She told Christopher Dougherty he doesn’t have the right to prefer his kid’s expenses over his creditors.Today the judge ruled Dougherty will be in Chapter seven bankruptcy, meaning that he and his wife are no longer in charge of their own assets.A trustee will investigate and liquidate those assets.Dougherty is being accused of running a Ponzi scheme targeting mostly elderly victims who planning for retirement and taking more than million, according to bankruptcy court records.In bankruptcy court documents, the United States Trustee wrote Dougherty’s “deception is the basis of a Ponzi scheme.”“[Their] practice of using new investment money to pay existing investors dividends and the principal gave the false impression that the payments received by investors came from earnings and profits or from a return of their principal,” the documents said.The San Diego County Sheriff's Department tells 10News there is a criminal investigation into Christopher Dougherty with at least 30 potential victims.The Securities and Exchange Commission also has an open investigation into Dougherty. 1237

SAN DIEGO (KGTV) — A border officer admitted in court Wednesday to putting his hands around a person's neck and shaking them at the Calexico Port of Entry two years ago.U.S. Customs and Border Protection Officer Esaul Bello, 53, pleaded guilty to using unreasonable force on the individual while on duty in the primary vehicle lane booth at the Calexico Port of Entry on Nov. 26, 2018.U.S. Attorney Office officials say during inspection, Bello placed both of his hands around the person's neck, even though they were not resisting. Officials say Bello then shook the person.The person was applying for admission to the U.S., officials said.As part of the plea, Bello agreed to resign from his position.“This is a rare and troubling situation,” said U.S. Attorney Robert Brewer. “We will always move swiftly to protect the public from officers who use their power to violate another person's Constitutional rights.”Bello will be sentenced on June 2, 2020. SAN DIEGO (KGTV) -- A man died Saturday night following an officer-involved shooting in El Cerrito. Police say they received a call just before 8 p.m. from a 70-year-old woman who said her 52-year-old nephew attacked her with a brick at a home on the 5800 block of Adelaide Avenue. Two officers responded to the scene and found the woman, who they say had been hit in the head and chest. Officers found the man in the backyard of the home and tried to arrest him, but they say he struggled.Witnesses say the suspect then picked up a shovel and started swinging at police. "He continued quickly advancing on the officers while swinging the shovel, prompting one officer to fire his Taser, while the second officer fired his service weapon," San Diego Police said in a news release. The suspect was struck by gunfire at least once and died at the scene, police say. The man's identity isn't being released at this time. The suspect’s aunt is expected to be okay and no officers were injured in the incident. The department says one of the officers is a four-year veteran of the department while the other is a 16-year veteran. SAN DIEGO (CNS) - The unemployment rate in the San Diego-Carlsbad Metropolitan Statistical Area dropped to 6.6% in November, down from 7.5% in October and above the year-ago estimate of 2.9%, according to figures released Friday by the state Employment Development Department.This compares with an unadjusted unemployment rate of 7.9% for California, down from 9% in October. The rate is 6.4% for the nation, down from 6.6% during the same period.According to the EDD, total non-farm employment in San Diego County increased by 14,300 jobs month-over-month -- from 1,412,000 to 1,426,300 -- while farm employment contracted from 9,500 to 9,200.The region lost 97,700 non-farm jobs and 400 agricultural jobs over the year.The region's unemployment rate rose to 15% in May during the COVID-19 pandemic, according to EDD data, while data from the San Diego Association of Governments showed rates of nearly 30% unemployment in May.The November data reported Friday does not include regional stay-at-home orders which Gov. Gavin Newsom put in place for California regions this month with fewer than 15% of their intensive care unit beds available. Thursday's data from the state claimed Southern California had filled its ICU beds as the COVID-19 pandemic worsens, but San Diego County health officials reported 16% of local beds were still available.Trade, transportation and utilities led all industry sectors in month- over-month job gains at 8,200. Retail trade, up 6,500, and transportation, warehousing and utilities, up 1,800, logged increases in jobs. Within the category of retail trade, clothing and clothing accessories stores -- gained 1,500 -- and general merchandise stores -- up 1,200 -- were large contributors to month-over job gains. SAN DIEGO (CNS) - Two additional suspects were arrested today in connection with a shooting that left a 20-year old man mortally wounded in a Bay Terraces-area neighborhood 16 months ago.Ethan Leland Apan, 28, and Kevin Herrera, 26, were jailed this afternoon on suspicion of taking part in the slaying of Joaquin Ruiz of San Diego, according to police.Another suspect, 26-year-old John Orozco, was taken into custody last Wednesday on suspicion of murder in the case, Lt. Andra Brown said Shortly after midnight on July 13, 2019, patrol officers responding to a report of a possible traffic accident found Ruiz unconscious and suffering from a gunshot wound to his upper body in a vehicle alongside the roadway in the 7000 block of Paradise Valley Road.Paramedics took the victim to a hospital, where he was pronounced dead. Police have not disclosed what led investigators to identify Apan, Herrera and Orozco as suspects in the case and have revealed no suspected motive for the slaying.``The District Attorney's Office is currently reviewing this case, which is still an ongoing investigation,'' Brown said. ``We will not be making any further comments or providing additional information at this time.'' 1216
