SAN DIEGO (KGTV) -- A bankruptcy judge told a San Diego-based financial investment advisor that he was spending against her orders. She told Christopher Dougherty he doesn’t have the right to prefer his kid’s expenses over his creditors.Today the judge ruled Dougherty will be in Chapter seven bankruptcy, meaning that he and his wife are no longer in charge of their own assets.A trustee will investigate and liquidate those assets.Dougherty is being accused of running a Ponzi scheme targeting mostly elderly victims who planning for retirement and taking more than million, according to bankruptcy court records.In bankruptcy court documents, the United States Trustee wrote Dougherty’s “deception is the basis of a Ponzi scheme.”“[Their] practice of using new investment money to pay existing investors dividends and the principal gave the false impression that the payments received by investors came from earnings and profits or from a return of their principal,” the documents said.The San Diego County Sheriff's Department tells 10News there is a criminal investigation into Christopher Dougherty with at least 30 potential victims.The Securities and Exchange Commission also has an open investigation into Dougherty. 1237

SAN DIEGO (KGTV) - A Coronado gym is taking on a novel concept, devising a bracket-style challenge involving acts of kindness.Founder Nick Merrill grew up on Whidbey Island, north of Seattle, Washington and giving is in his blood. Merrill said his dad was a founder of Hearts and Hammers, a non-profit that helps build homes for those in need.After college he met his wife, who shared his love of fitness. "I met my wife through working out, we started running marathons together and ended up doing some charity runs where we ran across Washington State where we earned a bunch of money for some charities in Africa, built a school, built some wells," Merrill said.Naturally when they opened the doors of Sweat Equity in Bellevue six years ago, they wanted to marry their gym with good deeds. They opened their Coronado gym about two years ago.Every year they have challenges to engage their members. Each March, they play off of the NCAA's March Madness bracket competition.Each team of four earns points through workouts and "each round will have a specific random act of kindness that everyone will do," Merrill said that will earn them points as well.In years past, it's been anything from buying a cup of coffee for someone, to putting change in an expired parking meter. One year they flexed their giving muscles pretty hard, "we brought in over 2,000 lbs of food basically in one day." Merrill said that was for Northwest Harvest in Washington.This year they hope is their biggest year yet."It's so rewarding, it makes you feel so good and it makes the person you helped out feel so good," Merrill said.The competition starts March 16 and ends April 1, with the winner receiving a trophy for their efforts. 1721

SAN DIEGO (KGTV) — A baby southern white rhino born this week at the San Diego Zoo Safari Park has monumental implications moving forward.Not only is the rhino calf the zoo's first successful rhino birth via artificial insemination, it's the first successful in North America for the rhino species.The calf, named Edward, was born Sunday at the zoo's Nikita Kahn Rhino Rescue Center. Edward's birth now represents the potential to bring back the rhino's relative, the northern white rhino, from the brink of extinction.RELATED: San Diego Zoo to be featured in new reality television series on Animal Planet"Not only are we thankful for a healthy calf, but this birth is significant, as it also represents a critical step in our effort to save the northern white rhino from the brink of extinction," Barbara Durrant, Henshaw endowed director of Reproductive Sciences at San Diego Zoo Global, said.Researchers hope the science behind the calf's birth can lead to a successful recovery of the genetic recovery of the northern white rhino, of which only two remain on the planet. Both are females.Ultimately, researchers believe southern white rhinos could serve as surrogates for northern white rhino embryos. The process has already been successfully applied to other rhino species, according to the zoo. White rhino gestation is estimated to take 485 days. She carried the calf for 493 days. The calf is the zoo's 99th southern white rhino born at the Safari Park. SAN DIEGO (KGTV and CNN) - Actor Will Ferrell is ‘grateful’ for well wishes received after a car crash on Interstate 5 in Orange County Thursday night."While traveling back to Los Angeles after hosting a voter registration event in San Diego, a car carrying Will Ferrell and three of his colleagues was struck on the freeway by another vehicle," read a statement Ferrell's representatives from United Talent Agency.Ferrell and another passenger were "unhurt" and were released from an Orange County hospital, according to UTA.RELATED: Will Ferrell rushed to hospital after crash on I-5Ferrell's longtime driver, Mark Thompson, and his another passenger, identified as Carolina Barlow, remain hospitalized in stable condition, the statement said.Ferrell is "staying close by as his friends are being treated, and has expressed his deep gratitude to the first responders who were immediately at the scene and to the hospital team that took such great care of them," the statement added.Ferrell, 50, was a passenger in an SUV that overturned during a two-car accident late Thursday at Alicia Parkway in Mission Viejo, according to an accident report from the California Highway Patrol.According to the accident report, Ferrell's vehicle was struck when another car veered into its lane. Ferrell's SUV then struck the center divider median and subsequently overturned.On Thursday night, Ferrell appeared at a Funny or Die event at Oceanside High School called Glam Up the Midterms. SAN DIEGO (KGTV) - A first-of-its-kind residential tower opened in San Diego this week.The 300-unit Palisade UTC complex is located right on the Westfield UTC mall's property. It offers an expansive pool, bar area, community room, open-air gym, and a lounge on the 23rd floor, with views to the coast. "The goal was to have multiple spaces, again, that would be like staying at a four or five star resort," said Jerry Brand, executive director of developer Greystar. The building will be among the most expensive in San Diego County.Studios start at ,750 a month, while two-bedroom units start at ,300. The penthouse is advertised for ,000 per month. It also includes 30 affordable units. Analysts say luxury buildings like Palisade can play a role in easing all of the region's housing crunch. "A substantial portion of the people moving into, like, the new projects downtown are actually vacating the older projects and moving up, so the luxury projects that are going up are really helping the housing situation," said Alan Nevin, director of economic research at Xpera Group. Kimberly Brewer, senior vice president of development for Unibail-Rodamco-Westfield, said the project is part of the evolution of the shopping center. The mall recently expanded to add more restaurants and a full office for CBRE, a commercial real estate firm. "What we've done at UTC we're doing across the country and really creating a live, work, play environment," she said. The buildings had its first move-in this week. So far, 50 of the units have been leased. About half of the renters are retirees, while a handful are entrepreneurs.
