SAN DIEGO (KGTV) — PETA is taking aim at SeaWorld once again, this time hoping to put a stop to the parks' dolphin shows.Officials held a press conference Wednesday to call out the park for what they called "dangerous," "circus-style" dolphins shows. The group argues trainers use dolphins "as surfboards" and have caused "open wounds and extensive scarring" on the animals."SeaWorld ceded to public pressure and said that it would phase out its circus-style orca shows, but dozens of other dolphins are still packed into shallow tanks, forcibly bred, and used as surfboards and launch pads in its shows," Heather Rally, a PETA Foundation veterinarian, said. "PETA is calling on SeaWorld to end these demeaning tricks and stop standing on dolphins' backs and faces."Rally, "Blackfish" director Gabriela Cowperthwaite, and behavioral biologist Dr. Toni Frohoff presented a report Wednesday in regards to their observations at the parks. The three argued that the shows, which are performed at all three of SeaWorld's parks, risk damage to dolphins' lower jaws. The group says this, in turn, can harm joints, strain muscles, and damage the animals' hearing.SeaWorld held its own press conference in response. In a statement, Dr. Hendrik Nollens, vice president of veterinary services at SeaWorld and Busch Gardens parks, called PETA's conference a publicity stunt, adding their paper's claims had no foundation:Their findings are presented in a white paper, which is the equivalent of an online blog, which is not peer-reviewed. They are also presented in a press conference instead of a scientific journal, in the presence of a moviemaker, which should be a red flag to all of us. Make no mistake, at SeaWorld, we are the animal advocates, and the difference is we actually have marine mammal and dolphin expertise; you cannot perform a veterinary exam from the stands.None of these behaviors are a veterinary or animal health concern. We have never diagnosed any injury associated with performing these behaviors, whether during presentations or interactions. If we did, we would have eliminated them by now. We also know for a fact that they do not cause any discomfort on the animals, because otherwise they wouldn’t come right back and do it again. 2259

SAN DIEGO (KGTV) - Point Loma families fighting to preserve a makeshift bike track are up against another setback.The land is owned by the San Diego Housing Commission, which recently hired an independent firm to do a feasibility study of the property. The firm looked at traffic, environmental factors, and the impact on schools; ultimately concluding it's feasible to build on the site. "Definitely heartbroken, this is such a special spot for our community," said Darren Miller, who often brings his boys to ride on the track. But Rick Gentry, President and CEO of the San Diego Housing Commission, says it's their job to create as much affordable housing in the city as possible. There are currently 80,000 people waiting for a Section 8 Housing Voucher. "The neighbors don't like to see the neighborhoods change, but change is going to happen, growth is going to occur. San Diego now is not producing enough housing to keep up with the rate of growth of the population," said Gentry. Miller and other neighbors have serious concerns about building on the land. "I don't know if they're necessarily opposed to affordable housing, I think they're just opposed to more development in an area that's already over-developed. In addition to just being an open space, it's a wetland," said Miller. The Housing Commission will be seeking developers for the project. SAN DIEGO (KGTV) -- Once election results start to come in, some of the races could be so close to call that they could lead to legal battles in court. Eugene Volokh, a constitutional law professor at UCLA, explained that it is likely some races could be so close that we won't know the results for a few days, maybe even weeks. When it comes to the presidential race, Volokh said that if the results are a landslide, the likelihood of legal challenges are close to none. If it's a tight race, Volokh said we could see litigation in states where it is just too close to call. Recounts are also possible, but the professor said that it wouldn't be a national recount; instead, it would only focus on the states that have tight races. Across the country, there have already been some legal battles. In Houston, a federal judge refused to invalidate nearly 127,000 drive-thru mail-in ballots following a lawsuit filed by a group of Republicans. In Nevada, a judge rejected another GOP lawsuit aiming to stop early voting over signature-matching software and observers when votes are being counted. If there is need for legal action, in any of the races, Volokh said it would likely be resolved in a couple of weeks. 1221

  

SAN DIEGO (KGTV) -- Neighbors in Ocean Beach and Point Loma are hoping new surveillance video will help arson investigators find whomever is responsible for a series of fires over the weekend. The video was taken from a yard near one of the fires. It shows a man walking in and out of frame then moments later, neighbors say, another fire stared. The fires all happened early Saturday morning within hours and just miles of each other. Arson investigators are calling the fires suspicious , all of them started in people's backyards. San Diego Police tell 10News they're still working to find out if the fires are related and also looking at the surveillance video to find out if the man in the video is a suspect. Detectives ask that anyone else with video, turn it over to the department. 799
