SAN DIEGO (KGTV) — Heartwrentching video of a humpback whale tangled in fishing net off of San Diego's coast prompted wildlife experts to react quickly.But the whale's condition is unknown after rescue crews were unable to help the animal.The video was captured Friday by Domenic Biagini, owner and captain of Gone Whale Watching San Diego. What appeared to be another spectacular whale sighting turned into heartbreak."We got really excited because we saw these giant splashes," Biagini told 10News' Amanda Brandeis. It's maddening," says Biagini. "For me. that's when I really started to get emotional because these are very sentient animals that do feel a wide range of emotions."This season, boaters are already being warned to watch out for newborn gray whales making their way from Alaska to Baja, Mexico. Vista Way was closed over three months ago due to the COVID-19 pandemic, but on Saturday, June 20, guests will be allowed to return.In a press release, officials said, “Boomers Vista will build upon its longstanding commitment to cleanliness and safety by implementing a series of measures following the recommendations of the Centers for Disease Control & Prevention and best practices within the amusement and attractions industries.”The following measures will be in place at the Vista facility:-- The center and mini golf course will operate under limited capacity-- Face coverings/masks required for all guests and staff members; kids under 3 won’t be required to wear face coverings, guests can remove masks when eating-- Employees will be we wearing personal protective equipment such as face shields and gloves-- Six feet of social distancing between parties are required; markers are posted throughout the property, including parking lots and entrances-- Temperature checks will be conducted for all guests and workers upon entry-- Guests and all staff are being asked to frequently wash hands-- Hand sanitizer stations will be located throughout the center-- Staff will carry out frequent sanitization of high-touch surfaces and rides and high-traffic locationsFacility General Manager Garrett Gross said, “The health and safety of our Guests and Team Members continues to be our number one priority as we work to welcome guests back to the Park. SAN DIEGO (KGTV) — From the confrontation in a Los Angeles Trader Joe's to a showdown in a San Diego Starbucks, there have been a lot of customers claiming businesses can't legally require them to wear a mask.Some customers even carry a card threatening fines and citing the Americans with Disabilities Act, or ADA. But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. Businesses can ask if a person has a disability, but not much beyond that.RELATED: Confrontation over wearing a mask at Coronado coffee shop"You can't delve into someone's medical condition and ask them a bunch of questions," said attorney Colin Harrison. "I would not advise businesses to ask for any type of documentation."If the person says they have a disability, the ADA requires businesses to make reasonable accommodation. There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. There have been at least nine across the country. But businesses that win can pursue legal fees from the other party. 2548

SAN DIEGO (KGTV) — Even though Americans could start getting vaccinated in days, experts say people who get the shot will still need to wear masks and practice social distancing until scientists can answer a key question: whether immunized people can continue to spread COVID-19.The clinical trials by Pfizer and Moderna showed the two vaccines were about 95 percent effective, but what that really means is they were 95 percent effective at preventing COVID-19 symptoms.The trials did not measure whether vaccinated volunteers got infected without showing symptoms.That means “it is possible and conceivable” that immunized individuals could still be silent spreaders, said Dr. Christian Ramers of Family Health Centers of San Diego. “You’re not going to get sick, but you still get an asymptomatic case, pass it on to your grandmother and kill her.”Both the Pfizer and Moderna vaccines are injected into the arm muscle to stimulate production of antibodies. From there, the antibodies can quickly get to the lungs to fend off severe infection. But experts say the antibodies may have less access to the nose and throat, the primary entry points for the virus.Some studies have suggested that people without symptoms can still have high enough levels of coronavirus in their nose to infect other people.“The vaccine is doing something to prevent disease. We don't really know yet if it prevents transmission,” said Dr. Ramers. “So we have to fall back on all those fundamental things like distancing, masking and washing hands.”Still, experts say there are encouraging clues that vaccinated people may be less contagious. A study in October found antibody levels in the blood were similar to levels in saliva.AstraZeneca had volunteers in its trial test themselves for signs of infection and reported there were fewer asymptomatic cases. However, the company has not yet provided details and its vaccine relies on different technology than Pfizer and Moderna’s mRNA candidates.Until we know more, doctors say vaccinated people will have to keep wearing masks -- potentially until there we achieve herd immunity.“There is modeling to suggest that it will be summer until we reach the point where there are enough people vaccinated that this curve of new cases really starts to go down,” Ramers said.There’s a chance we could get good news before then. Both Pfizer and Moderna say they’ll start testing their volunteers’ blood to reveal if they got infected after vaccination.Pfizer plans to examine a subset of its volunteers. SAN DIEGO (KGTV) - Flames shot out a window of a Spring Valley apartment that caught fire Thursday morning.The fire broke out at the home in the 10,000 block of Austin Drive about 10 a.m.No one was injured but the family who lives there says their cat died in the fire."I heard the beep beep beep and ran up the stairs," said Jacquline Amey, "I looked in the other room it was all smoky - opened the closet and it was engulfed in flames."San Miguel, Heartland, La Mesa firefighters and the San Diego Sheriff’s Department assisted in the emergency.The cause of the fire remains under investigation.  636
