COLUMBUS, Ohio (AP) — Data released Monday show governors who led state responses to the coronavirus pandemic were among beneficiaries of the loan program created to help small businesses weather COVID-19's economic effects. College campuses across the country have largely sat empty for months, but as schools consider whether to bring students back, they're also considering their legal obligations.“They are a business that needs revenue to function,” explained Chris Feudo, an attorney with Foley Hoag in Boston, Massachusetts.As an attorney, Feudo has been advising folks about COVID-19 waivers, which gained national notoriety leading up to President Donald Trump’s rally in Tulsa last month. Businesses have also been turning to these forms in hopes of freeing themselves from legal responsibility if someone catches the virus.The next round of waivers could be coming from colleges and universities, and many have already mandated student-athletes to start signing the forms in order to start practicing. Students returning to empty campuses could be next.“It sends a really dangerous message,” Feudo said. “If you’re saying to your employees, faculty, students, it’s sending a message that the college or university is bringing people back when there’s still a substantial risk.”A COVID-19 waiver could mean a family loses any right to seek compensation if a student gets sick at school.But Feudo is skeptical any of these waivers will hold up in court.“You’re not going to find out whether it’s enforceable until somebody gets sick and sues,” he said. 1344

Complaints are growing nationwide about workplace safety issues related to coronavirus. The Occupational Safety and Health Administration, or OSHA, has received more than 6,500 nationwide on a federal level since February.One trial lawyer who works in employment law says she expects the number of complains will keep going up.“Where I really think the numbers are going to escalate is in the retaliation world, where employees bring issues to their employers' attention about failing to implement appropriate administrative or engineering controls or social distancing measures and then they feel that they have suffered an adverse employment action as a result of bringing this to their employer's attention,” said trial lawyer Laura Lawless.OSHA recently updated its guidance on COVID-19-related workplace safety. It now suggests wherever possible and feasible employers should require masks at work.This guidance is something Lawless says everyone was waiting on. She says for states or cities that already had a mask mandate it was easier to enforce at work already, but for states that don't have this mandate, it was harder until now.“At least you can now turn to CDC guidance and OSHA guidance as an employer and say look even if you disagree with us for a political reason or personal expression reason, we're following the guidance from agencies that are meant to look out for your health and safety,” said Lawless.Still, there are concerns OSHA isn't going far enough in other areas. One big criticism among employee protective organizations, workers organizations and unions is that OSHA’s guidance on COVID-19 isn't a regulation and doesn't really have any teeth.Virginia and Oregon are two states looking to fill in the gap with their own worker protections.If you see issues in your workplace, the employment lawyer recommends being reasonable in your approach and not getting too emotional in your reaction. CREST, Calif. (KGTV) - The forward rate of spread of the Dehesa Fire burning in East County has been stopped, Cal Fire tweeted just after 5 p.m. The flames broke out about 3 p.m. east of Dehesa and Sloane Canyon Roads near Sycuan Casino, Cal Fire officials told 10News. Sky10 video indicated the flames were on a ridge above the Sweetwater River and Beaver Hollow.By 8 p.m. the fire had burned 200 acres and was 10 percent contained, Cal Fire reported. The San Diego County Sheriff's Office tweeted evacuations were underway for a "handful of structures" at Sycuan Truck Trail and Japatul Road. Employees of the nearby Dehesa School District offices were told to go home. By 8 p.m., all evacuations were lifted. Fire danger was increased due to dry weather Tuesday. Check conditions here."Today will bring mild Santa Ana winds with gusts of 25 to 35 miles per hour far inland to the mountains with humidity down to 15 to 30 percent with elevated fire danger," said 10News Meteorologist Angelica Campos.There was no indication of what may have caused the fire.The agency said it had 26 fire engines, 12 hand crews, and 3 water tenders on scene to mop up and construct containment lines Tuesday night.
