The New York state attorney general's civil lawsuit against the Donald J. Trump Foundation, President Donald Trump and his three eldest children can proceed after a state court judge on Friday denied their motion to dismiss the case.In her decision, Justice Saliann Scarpulla ruled that a sitting president can face a civil lawsuit in state court for actions not taken in his official capacity. That ruling puts Scarpulla in agreement with another recent ruling against Trump, a decision in the defamation lawsuit brought against him by Summer Zervos, a former contestant on "The Apprentice."And, Scarpulla said, it is in line with the US Supreme Court's 1997 ruling concerning President Bill Clinton in response to Paula Jones' sexual harassment lawsuit."Allowing this action to proceed is entirely consistent with the Supreme Court's holding in Clinton v. Jones that the President of the United States is 'subject to the laws for his purely private acts,'" Scarpulla wrote.As she did in court in October, the judge noted that Trump has appealed the Zervos decision, and if the appeals court rules in his favor, the attorney general's office would likely need to amend its lawsuit to remove Trump himself as a defendant.The Trump Foundation case is being considered in the New York Supreme Court, the state's trial court.The suit, filed in June, names as defendants the foundation, Trump and his children Eric, Donald Jr. and Ivanka Trump, all of whom sat on the charity's board. It alleges that they violated federal and state charities law with a "persistent" pattern of conduct that included unlawful coordination with the 2016 Trump presidential campaign.The attorney general's office, led by Barbara Underwood, is seeking to dissolve the Trump Foundation and wants .8 million in restitution, plus additional penalties. The office is also seeking to ban Trump from serving as a director of any New York nonprofit for 10 years and to prohibit the other board members, the Trump children, from serving for one year."As we detailed in our petition earlier this year, the Trump Foundation functioned as little more than a checkbook to serve Mr. Trump's business and political interests," Underwood said in a statement Friday. "There are rules that govern private foundations — and we intend to enforce them, no matter who runs the foundation."An attorney for the defendants, Alan Futerfas, said "the decision means only that the case goes forward. As we have maintained throughout, all of the money raised by the Foundation went to charitable causes to assist those most in need."He added: "As a result, we remain confident in the ultimate outcome of these proceedings."The judge gave the defendants 45 days to respond to the lawsuit. 2745

The largest nutrition study in the world could change the way people eat as researchers indicate that your genes aren't the reason for your weight loss or gain.Susan Kim, 49, an Illinois mom, wife and teacher who was flat out fed up, and tired of struggling with her weight, a problem she's battled her whole life.“I was scrolling through my phone one day and I saw this study that I started reading- and I was intrigued,” Kim said.She admits she also wanted to prove a point to her husband of 20 years."He has maintained if I would only eat what he eats then my problems would be solved and there’s sugar in his food too and that’s a lie. That’s not the key,” Kim said.She signed up to be a part of The Predict Study commissioned by King’s College in London. A research team sent her everything she needed, including a box with a way to submit her blood, saliva and glucose.Researchers say the Predict study has allowed them to predict an individual's response to food.“The study showed us there’s no such thing as an average person-when it comes to food, we’re all different and unique and this is not something that food manufacturers or anyone else wants to tell you they want everyone to be the same,” Dr. Tim Spector, who is a senior researcher.Spector and his team of scientists gathered huge amounts of data, using Zoe, a data science company, and artificial intelligence to personalize nutrition.“The idea was to come up with enough information from research from very large studies around the world- and put it together in a format used in advertising and internet based procedures that would come up with algorithms that would tell an individual what the best way to eat is,” Spector said.The team worked off of probabilities, but they also have lots of new technology to use.“We can look at your gut microbes in a very detailed way,” Spector said. “We have glucose monitors that will tell you what your glucose level is. We’ve got finger prick tests people can do at home that will tell you what your blood fat is doing. We’ve got exercise monitors, sleep monitors and apps that record everything you’re doing and how you’re feeling every minute of the day.”There were identical twins in the study who had different responses to food. Hollywood actress Dame Emma Thompson also participated in the study."She has a big interest in health in general and as an actress, is always conscious of her health and her weight and wanted to find out more about nutrition,” Spector said about Thompson. “She claimed to have been on every diet under the sun and wanted to learn what the latest cutting-edge science was.”Spector says Thompson is doing well and is thoroughly enjoying what she's learning about her body. The Pennsylvania Academy of the Arts, or PAFA, is the nation’s oldest art school and museum but it’s facing a new dilemma: what to do with an artist’s work when the artist is accused of sexual misconduct.                                                                                                                                                                       The artist in question is portraitist Chuck Close. He may not be a household name to you and I, but in the art community he’s huge. He’s considered a pioneer of portrait work who rose to prominence in the 1960s who made a name for himself in the way he incorporated photography within the world of painting.But this past December, four female models accused the artist of sexual harassment, claims the Close denied in an interview with the New York Times. Close, through a rep, declined our request comment.Brooke Davis Anderson, PAFA’s museum director, had a tough call to make: what to do with a high-profile exhibit, on view in one of their most prominent galleries, filled with Close’s work.“I’m very hesitant to censor artwork,” Anderson said. She and the museum executive leadership convened their art community of students, staff, and patrons to gauge the reactions to try to fiigure out ho to handle the exhibit.“We really asked everybody what they were feeling, thinking, how they were responding,” Anderson said. “How they felt we should respond as an institution, and collectively what this meant for us.”The broader discussion is not all that new. You may recall that a few years back, “The Cosby Show” was pulled from syndication following allegations made by a slew of women against its star and creator Bill Cosby. You don’t want to have to look at it anymore.”But, she says, over a few weeks’ time her views evolved.“If you think about what’s going to be most productive for this movement, what’s going to actually move things forward, your initial emotional reaction isn’t always the right one.”Jensen interjected.“Well yeah but don’t diminish emotional responses. Emotional responses are really tied up with moral responses,” Jensen said, adding that understanding the context in which art was made is key.“Being willing to value the aesthetic decisions that were made and also be critical of the maker,” Jensen said. “So it’s not a black and white.”PAFA is not the only institution having to navigate this gray area.Seattle University recently removed a Chuck Close self-portrait hanging in a campus library.The National Gallery of Art in Washington, DC indefinitely postponed its Chuck Close exhibit that was set to open in May. A museum spokesperson declined an interview but told us in an email that “all parties involved” agreed that it was “not the appropriate time” to present the installation. Anderson made the final call for PAFA: keep the Close exhibit, but with a caveat in the adjoining gallery right next door.“The site of an exhibition isn’t where you respond by censorship or changing the project. I rather felt that what we could do because of our real estate here. We had an opportunity to have a dialogue with another project.”That other project is what they’re calling a “response exhibit,” a gallery created to force a conversation that explores gender and equality in the art community.“There are no longer town halls and town squares,” Anderson said. “So what if a museum was a site where we could say we don’t agree, and lets unpack how we don’t agree. And let’s understand how we don’t agree, and maybe that advances us a little bit.”Anderson pointed out some of the highlights of the responsive exhibit, including a timeline regarding how and when the art world can become “an equitable space.”“How do we get more women in leadership positions? The Pentagon has sent more than 300,000 pounds of Thanksgiving food to US military troops stationed overseas and at the US southern border, the Defense Logistics Agency announced Tuesday.The shipments, which include 9,738 whole turkeys and 67,860 pounds of shrimp, were sent to dining facilities throughout the Middle East, Europe, Africa as well as field kitchens in Texas and Arizona."Many of America's military men and women are away from home this Thanksgiving, making sacrifices to secure our freedom and to protect our southern border," Army Brig.
