SAN DIEGO (KGTV) — A San Diego-area man and his grandmother filed a federal lawsuit against two San Diego County Sheriff's Deputies.The lawsuit alleges deputies responded to the wrong address and pulled a then-17-year-old out of his apartment. "I've never experienced something like that," said Cesar Jaramillo.Jaramillo says last October he was watching TV on the couch when he heard a knock at the door. He says deputies asked if someone from the residence called 911.According to his lawsuit, "Cesar informed defendants the call was not from his residence. When defendants asked Cesar if there was a young black female in the apartment, Cesar said 'No,' and informed defendants that they were at the wrong apartment building. Cesar knew who defendants were referencing and knew they lived in the other building. Cesar informed the deputies over half-a-dozen times that defendants were at the wrong building."Jaramillo tells 10News he complied with everything the deputies asked but felt like they didn't believe him."That's when I started closing the wide door, that's when he just reached in and grabbed my hand," Jaramillo said.The lawsuit claims, "Without warrant or probable cause, both defendants unreasonably lured Cesar to unlock and open the door, then entered into Plaintiff's residence and forcibly pulled Cesar by the forearms into submission, leaving instant bruises on both arms."Jaramillo's grandmother was in the back of the house at the time and said she woke up to the commotion."I saw my grandson laying on the ground, in handcuffs and I went crazy, and I said, what is happening," said Teodora Villalobos.According to the lawsuit, "Due to unreasonable seizure and force used on her grandson Cesar, as well as defendants' indifferent attitude, Teodora began having heart complications on scene."Jaramillo's lawsuit alleges negligence, battery, and unreasonable search and seizure, among other things.10News reached out to the San Diego County Sheriff's Department for comment, but a spokesperson they can't comment on pending litigation. 2066

SAN DIEGO (KGTV) — An autopsy report for a San Diego State student who died after falling from his bed after a night of partying revealed elevated alcohol levels.The report from the county Medical Examiner found that Dylan Hernandez, 19, died of blunt force injuries of head and ruled his death an accident. At the time of the autopsy, a toxicology report said elevated alcohol levels of 0.06 percent and cannabinoids were found in his system. However, earlier reports from campus police said he had a 0.23 percent blood-alcohol level the morning he fell.Hernandez fell from his bunk bed in the early morning hours of Nov. 7, 2019, after a fraternity party that night. The family said they believed campus police were not pursuing certain angles, including a possible cover-up."The Hernandez family is concerned because witnesses they provided to SDSU and UPD still have not been questioned," George Kindley, the Hernandez family's lawyer, said.Hernandez's family claims SDSU Police never sought out warrants for Snapchat videos or phone records from members of Phi Gamma Delta fraternity, the fraternity Hernandez was pledging to join. SAN DIEGO (KGTV) - A woman's trip to Mission Bay ended with her, and her car, soaked.The woman, who identified herself as Candy, said she was next to her car on a boat ramp preparing to unload her kayak for a day of fishing and roaming around Mission Bay. Suddenly, her 2002 Audi convertible started rolling as she was unloading gear.Candy jumped into the car and road it into the bay as she tried to get her emergency brake to engage."It just wouldn't. It just kept on going," Candy told 10News. "I was standing straight up in it as it was going down ... quite a scene, I'm sure."The car started sinking into the bay with Candy still inside, before she jumped out to swim back to shore. Her lunch and kayak floated to the other side of the bay as her car became completely submerged, she told 10News."I'm going to have plenty of fish now," she joked. "It's not a big deal, things happen."Two tow trucks were able to fish Candy's vehicle out of the bay and San Diego Lifeguards retrieved her car and kayak, in which she had left her purse and lunch.Candy said she had just purchased the car in November.San Diego Lifeguards reminded locals to exercise caution while using boat ramps. 1216

SAN DIEGO (KGTV) -- An hours-long SWAT standoff involving a domestic violence suspect in Point Loma came to an end Thursday night. Police were called to the 2200 block of Caminito Pescado around 4:45 p.m. after receiving a call from a neighbor. Police say a woman who lives in the home ran to the neighbor’s house reporting that she and her 71-year-old husband got into a fight. Police and SWAT responded and found the man on the second floor balcony of the condo. After trying to get the 71-year-old down from the balcony, police say he ran inside before a gunshot could be heard coming from the home. Neighbor Jenny Taylor spoke with 10News on FaceTime, saying she could see officers lined up with their weapons drawn from her patio. She said she was ready for the worst, "let me move it so we can at least duck down really quick and hit the floor and run inside the house, so we left the screen door open and moved all the chairs out of the way."It was hours before police and SWAT packed up.Authorities later found the man dead inside. According to police, records show authorities had never been previously called to the home. An investigation into the incident is currently underway. SAN DIEGO (KGTV) -- All evacuation orders and warnings have been lifted following a brush fire that erupted in San Diego's Talmadge neighborhood Tuesday afternoon. The fire started after 1 p.m. on Fairmont Avenue and Aldine Drive near Central Elementary School. The fire could be seen burning up a canyon in the area as smoke billowed into nearby neighborhoods. At times, flames came within 200 feet of homes. Evacuations were briefly ordered for Norma Drive, Constance Drive and Natalie Drive. The Hoover High School football field had been set up as a temporary shelter.RELATED: Check today's forecastThe fire also knocked out power to thousands in the area, but electricity was restored around 5 p.m. The fire sparked amid elevated fire weather concerns. Gusty offshore winds are expected in the mountains and foothills through Wednesday with afternoon humidity between 15 and 25 percent.
