SAN DIEGO (KGTV) - 10News is learning more about how suspected Poway shooter John Earnest got the weapon. On Thursday, investigators revealed that they believe he got his rifle from a licensed dealer. In federal documents released on Thursday, prosecutors report, “The firearm was manufactured by Smith & Wesson in Princeton, Illinois and shipped to Springfield, Massachusetts where it was assembled. The firearm was ultimately transferred, via Fort Worth, Texas, to a Federal Firearm Licensed (FFL) Dealer in San Diego, California, which sold the firearm to Earnest. Earnest picked up the rifle on April 26, 2019.”That was the day before the shooting. In a press conference on Thursday, Southern District of California U.S. Attorney Shane Harrigan told reporters, “I can say that there is no allegation that the defendant violated federal law when he acquired the rifle that he used in the violent attack on the synagogue.”Questions still remain as to whether state law was violated. Earnest is only 19 years-old.California law requires that adults be over 21 years-old before they can buy a firearm, unless they have a hunting license, are current or former military, or are in law enforcement.Prosecutors wouldn't comment on whether Earnest had a hunting license. “That allegation isn't in the complaint but please understand that as the criminal process moves forward, more information may be available to the public,” added Harrigan.District Attorney Summer Stephan originally said that the rifle had been obtained legally, but when pressed on Wednesday by 10News, she didn't provide a clear answer. “I don't want to [comment any further] because it's a pending case,” she said.At Thursday’s press conference, a reporter asked the federal prosecution about when Earnest purchased his 60 rounds of ammunition. Harrigan replied, “We’re limited to the allegations in the complaint. I hope you understand. I think more information may be forthcoming.” 1962

SAN DIEGO (KGTV) - A college student is suing the San Diego County Sheriff's Deputies from the Las Colinas Detention Facility after she disfigured her face while detained. The lawsuit stems from May 6, 2019. San Diego State student Tanya Suarez, 23, tried methamphetamine with a new group of friends. The document states she had psychotic delusions in a gas station parking lot, causing nearby San Diego police officers to arrest her for being under the influence of drugs.According to the lawsuit, at Las Colinas Detention Facility, while being fingerprinted, she heard another woman screaming about her eyes. That's when Suarez started to claw out her own right eye.Deputies restrained her on a gurney and cut her acrylic nails leaving them jagged. The suit claims deputies then placed her in a safety cell unrestrained. Suarez started clawing again at her right eye.She says the entire time she was screaming and saw a guard standing outside her cell filming her with an iPhone.Within five minutes she scratched both eyes out.Documents state it took another 5-10 minutes before deputies entered the cell.Suarez is now blind and, according to the lawsuit, she was known "to sleep with the lights on because she is afraid of the dark. Now she lives in complete darkness."The lawsuit states she told nurses she is bipolar and was previously hospitalized for wanting to commit suicide.Suarez's lawsuit states she is going back to finish her psychology degree at SDSU and is taking classes with the Center for the Blind; adding she wants to help others who suffer from mental illness and drug abuse. The San Diego County Sheriff's Department sent 10News the following statement: 1681

SAN DIEGO (KGTV) - The ancient Greek philosopher Heraclitus is said to have coined the phrase, “The only constant in life is change.” Like it or not, change happens to all of us. We either learn to embrace it or fall victim to it. A San Diego pastor was on the verge of becoming one of those victims and almost lost his church. Instead, he found a unique way to embrace the oncoming change and gave his ministry new life. “When I got here, we probably had 150 members with an average attendance of 175, and every year it was smaller and smaller,” says Pastor Bill Jenkins. Jenkins arrived at United Methodist Church in the heart of San Diego in 1999. The church was already weak and failing. Like many inner-city pastors, Jenkins was facing the inevitable, a dwindling congregation slowly dying off and the prospect of the church closing its doors. But in 2005, Pastor Jenkins had a life-changing idea.“I challenged the church to become a ministry center,” adds Jenkins. “And they said, ‘What is a ministry center,’ and I said, ‘I don’t know.’”What Jenkins and his small congregation would come to learn was rather than attending a one-day a week church on Sunday, the building would serve all those in need seven days a week. It now welcomes refugees, immigrants, and asylum seekers. It serves as a food pantry for the hungry, a clothing donation center, and twice a week it’s a free clinic with medical students from U.C.S.D and Cal State San Marcos. No insurance, no problem, no questions asked. “So, when people now ask me, ‘What is a Ministry Center?’ It’s easy for me to say we are the 7-day-a-week church,” says Jenkins. Pastor Jenkins gave his last sermon in the church in 2011, but the chapel is still home to 12 different congregations sharing the word of God. “Today, we have somewhere between 1200 and 2000 people who come through our doors,” says Jenkins proudly. “So, we flipped the church. We flipped it from being a dead and dying church to becoming an integral part of the community.” The church wasn’t alone in its transformation; Pastor Jenkins and his family went through one as well. To date, over 7500 asylum seekers have come through the doors of the Christ Ministry Center. Two of them are 5-year-old Harry and his mother. “You would have a hard time convincing me that he is not an angel in disguise,” Jenkins says with Harry on his lap. Pastor Jenkins and his wife were so taken with this little boy they decided to adopt him. Now along with Harry’s mother, they co-parent. Pastor Jenkins may have retired from preaching, and his church may have closed its doors, but embracing change and having a love for all people will always be his legacy in the eyes of his God. “He said, ‘If you welcome the strangers, I will welcome you into heaven,’” says Jenkins. For his dedication to his community and all those in need, we were proud to honor Pastor Bill Jenkins with the 10News Leadership Award. 2928
