A man in Colorado who was sentenced to more than 300 years in prison for child sex crimes in 2015, is now walking free after his conviction was thrown out on a technicality.Michael Tracy McFadden, 46, was convicted for 19 counts of sexual offenses, including a habitual sex offender against children, according to KKCO. McFadden was released from the Arkansas Valley Correctional Facility on Tuesday.In June, the Colorado Court of Appeals found that McFadden's right to a speedy trial was violated when the judge in the case granted a continuance. When the court ruled that his statutes were violated, they threw out his conviction."Frankly I'm completely appalled with the decision," District Attorney Dan Rubenstein told KREX. "I find it offensive that our justice system would allow this to happen."Rubenstein explained to KREX that speedy trials are broken down into two categories: constitutional and statual.Constitutional speedy trials have no timeframe, depending on the case. However, in Colorado, statutory speedy right trials require a time frame of six months.Rubinstein told reporters, “Because the error here was that he shouldn’t have been tried longer than six months from the last time he waived speedy trial, there was no remedy for that, and therefore there is no ability to retry him." "The justice system completely failed in this situation. If you've heard the phrase 'got off on a technicality,' this is the phrase to the most stark sense I've ever seen it," said Rubinstein.Reports state that McFadden has been exonerated from all of his charges and does not have to register as a sex offender. 1661

A high-speed police pursuit has ended in a Phoenix neighborhood as police continue to search the area for at least one suspect.Police say they were following a possible stolen vehicle and attempted to pull the driver over Tuesday when the suspect refused to stop.Helicopter video showed the white SUV in the Biltmore area around noon, going the wrong way in traffic and driving on light rail tracks near Central Avenue and Thomas Road to avoid stoplights. Video from helicopter showed what appeared to be stop sticks deployed on the vehicle that caused a tire to blow near a neighborhood in west Phoenix. The vehicle was then seen driving through multiple front yards and sidewalks around 12:30 p.m. The occupants of the car bailed in front of a home on foot. Police say one woman, the passenger in the vehicle, was taken into custody. The male driver is still missing and believed to be hiding in the neighborhood.Police say the male suspect is believed to be responsible for at least three carjackings. During one of the carjackings Tuesday, a Phoenix police officer tried to intervene and fired shots toward the suspect. A Dundalk couple says they’re trying to figure out who’s responsible after a carnival accident on Friday.A day at a carnival for David Nagel, his wife Stacy, and their 2-year-old grandson was going great until David and Levi were on board the carnival’s merry-go-round.“I grabbed my grandson,” David said. “Ran away from the [the carousel] and got my grandson over the fence to my wife, and then I went back to make sure that everybody else was ok because there was a young lady with two younger kids behind me.”Part of the merry-go-round collapsed with close to 40 people on or nearby.Stacy watched in horror, capturing the entire incident on her smartphone.“It was his first time ever on a merry-go-round. He’s two. He never wanted to get on before and we didn’t push him. He just wanted to get on the merry-go-round so we had to film it. Thank gosh we did,” she said.Firefighters along with ride inspectors worked on the ride for almost an hour.Then the ride went back into service – not against protocol according to state inspectors.The ride services’ owner, Shaw & Sons Amusements, says the state handles inspections.“A major breakdown is a stoppage of operation from any cause that results in damage, failure, or breakage of a structural or stress bearing part of an amusement attraction,” Matt Helminiak, the Commissioner of Labor and Industry – over the amusement ride and safety inspection division, said.By phone, he said if no one was injured or if there weren’t a major breakdown, the state wouldn’t even be alerted.The incident on Friday wasn’t enough to shut the ride down.Still, Helminiak says the state will look at what went wrong with the merry-go-round.“In the case of a mobile ride, every time that ride is set up, a state inspector inspects it before anybody is allowed to ride it, but the operators themselves have a daily inspection requirement and so they inspect it and keep a log of inspections and then have that available for us,” he said.An unsettling feeling for David, who says he wants to see a change in the inspection process, no matter if someone is injured.“I went, number one, to bring back memories and number two – to share joy. It was supposed to be a joyous time. It was until we got on the merry-go-round,” David said.The state will look at the merry-go-round before it’s set up again.No matter the issue, it’s up to the company to get the ride fixed before anyone is able to get on it again. 2447

A Florida man was allegedly attacked while trying to do the right thing during Hurricane Irma.The alleged victim was letting Tarvice Lamar Payne stay at his home in Port St. Lucie during the storm when his guest attacked him, according to Port St. Lucie police.Payne, 33, of Royal Palm Beach, accused the alleged victim of stealing his drugs, so he punched him and then threatened him with an ax, a police report states. The alleged victim managed to escape and call the police, but not before Payne took the ax and struck a car in the driveway, police said.Arriving officers managed to track Payne down as he was leaving the area.They charged him with aggravated assault, battery, and criminal mischief. 742
