SAN DIEGO (KGTV) - A Delta passenger mauled by an emotional support dog has filed a lawsuit against the airline and the dog's owner, a Marine combat veteran.In June 2017, Marlin Jackson boarded a San Diego-bound flight in Atlanta headed for a work conference. Soon after, fellow passengers watched in horror as a brutal dog attack played out in front of them.Jackson sat in a window seat. In the middle seat was a Marine veteran was with an emotional support dog, a chocolate lab pointer mix, in his lap. The lawsuit states the dog was briefly restrained, before pinning Jackson against the window and mauling Jackson again, resulting in 28 stitches and permanent loss of sensation in his face. He bled so profusely that "an entire row of seats had to be removed."The incident sparked national headlines, and tighter policies for emotional support and service animals. For example, Delta now requires proof of training, adding rules for the types and ages of the animals, as well the duration of flights that allow emotional support animals.Delta declined to comment citing pending litigation. SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' The letter also notes Ayala's previously reported statements about killing people.``The deputies had no other option available to them as they Ayala could stab them immediately and seriously injure or kill them,'' the letter reads.Katra has been employed by the San Diego Sheriff's Department for 18 years, McGillicuddy for 12 years and Nulton for 10 years. 2096

SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave. SAN DIEGO (KGTV) - A bluff that overlooks Beacon’s Beach in Encinitas is on the brink of collapsing, which could mean changes for the walking trail that leads visitors down to the beach. The City of Encinitas says the bluff is at risk. There is a low-lying failure and the bluff could fall, taking the walking trail with it.“We’ve been told by our experts that there is a chance that the slide could happen at any time,”says Brenda Wisneski, Developmental Services Director for the City of Encinitas. Visitors at Beacon’s Beach say they feel the walking trail makes the beach different from others. “It’s one of my favorite beaches in all of San Diego. A part of that is because of the access, this trail is highly unique and it's not stairs,” says Mark Tayer. The city has a proposal to add a staircase south of the entry to the trail.“That is the most safe, the most secure. It requires a minimal amount of stability at the base of it,” says Wisneski.Wisneski says the city also has plans to move the parking lot back from the failure area. This could mean fewer parking spaces for visitors. The city hopes to begin construction in the fall of 2019. The proposal will go to the planning commission next. The trail will stay there until it poses a safety issue to visitors. On Wednesday, the City of Encinitas will have an open house where members of the community can voice their concerns. SAN DIEGO (KGTV) - A camp in Vista is giving kids a place to cope with the loss of a loved one, along with others on the same journey.Experience Camps provide boys and girls whose parent, sibling or primary caregiver has died, with a program that helps build confidence, encourages laughter and allows them to navigate their grief through friendship, teamwork, athletics, and the common bond of loss.The nonprofit provides the experience free for families. "My mom she was really, really nice. I loved her with all my heart. When she passed, it was devastating," said 13-year-old Dylan from San Diego.Dylan's mother died of breast cancer. "It was really tough, but once I got here it was really good to know that other people had the same experience," said Dylan.This is Dylan's third year at camp. He and others are gaining coping mechanisms to navigate their grief better. "The common experience we all have is grief, and I think that's the strongest bond between all of us," said Amit Sura, a camp counselor. A typical camp day includes two activity periods, such as volleyball, tennis or arts & crafts. The third morning period is focused on different techniques in the bereavement toolkit, built to help the campers identify, express, and understand their feelings. Later in the day campers take part in a camp-wide activity, such as relay races or a hike up a nearby mountain. The camp comes together again during free swim, dinner, and an evening activity before retiring to their bunks."Today we did a mindfulness activity, talked about sitting with emotions like anger, happiness, sadness," said Sura. "When they're here, and everybody's sharing their experiences and their emotions, it's a bond that's unbreakable."Experience Camps has five locations across the country, serving boys and girls.Families can register in November.The nonprofit relies on donations to send children to camp for free, you can donate here. 1940
