A United States Customs and Border Protection officer is accused of falsely claiming to be a US citizen when he applied for the job, the Department of Justice said. According to DOJ officials, Marco Antonio De La Garza Jr., 37, of Hereford, Ariz. was charged with three counts of passport fraud and false statements on his federal law enforcement background application. The DOJ is claiming that De La Garza knowingly used a fraudulently obtained Texas birth certificate to apply for a United States passport. De La Garza is also accused of using the same birth certificate to claim US citizenship during his background check.It is unknown how US officials were unable to figure out that De La Garza's paperwork was fraudulent.  The charges stemmed from an investigation conducted by  the Department of State-Diplomatic Security Service and the Department of Homeland Security-Office of Inspector General. The DOJ claims that De La Garza was actually born in Mexico. The Associated Press confirmed that he was hired by border patrol in 2012.   1116

A spat between neighbors over an outdoor sculpture has led to calling police and legal actions. Those filings include allegations one of the neighbors blared the “Gilligan’s Island” theme song and other music on loop at all hours to annoy the other neighbor, according to the Los Angeles Times.Billionaire Bill Gross and his partner are accused by tech entrepreneur Mark Towfiq and his wife of harassment and intentional infliction of emotional distress.It’s all about a 22-foot-long and 10-feet-high blue glass art installation, and the pole-and-netting structure around it, that Towfiq claims blocks his view, according to the Times. It was created by Dale Chihuly, a renowned artist known for his blown-glass work, including in the lobby of the Bellagio hotel in Las Vegas.It was installed in 2019, but apparently didn’t upset the neighbors until this year when the netting was installed around it after it was damaged, according to city records obtained by the Times.In July, Gross was sent a letter from the City of Laguna Beach that said the netting, lighting and sculpture lacked the proper permits.Apparently, that’s when things escalated.Gross is accused of blaring music at all hours, including the “Gilligan’s Island” theme song, apparently in an effort to force Towfiq to drop the complaint.The two have both filed temporary restraining orders against the other, both are pending in court. 1409

A mother is grieving the loss of her teenage son, who was stabbed to death Monday morning in Palm Beach Gardens.Jovanni Sierra celebrated his birthday a day early. First, he and his friends played paintball and then they had pizza. He was about to turn 13. Sierra's mom, Karen Abreu recorded video of him with his friends, singing "Happy Birthday" to him, eating pizza. “I could just see it, that night he was so happy. I never thought in my wildest dream that I would get the news I got yesterday,” Abreu said.Jovanni went over to stay at his friend, Dane Bancroft’s house. They’ve known each other for years. “I had told him, are you sure baby? I want you to come home. I want to sing happy birthday, give you a hug and a kiss for your birthday tomorrow,” she said. “He’s like mom, 'It’s OK. I’m going to have fun, please, I love you,’ and that’s the last words he said to me."Palm Beach Gardens police say Dane’s older brother had his friend, 17-year-old Corey Johnson, over that night too. Johnson told police he waited until everyone was asleep around 4 a.m. to kill Jovanni, Dane and Dane’s mother, Elaine. Johnson was allegedly inspired by his Muslim faith, and violent jihadist videos, which encourage killing non-believers, he told police. Dane and Elaine were hurt. Jovanni was killed in a brutal knife attack. Karen says any rumors her son made fun of Johnson are wrong. “I don’t feel like my son is one to make fun of anybody. He’s always been accepting of everyone. It disgusts me because that’s not my son,” she said. Johnson was there Sunday night, celebrating Jovanni’s birthday. Jovanni had invited him. “We had the table reserved for 12 and Jovanni asked, ‘Mom, can Dane’s brother and friend (Johnson) join us?’ and I was like, ‘OK.’ We only had 12, but that was Jovanni. He always wanted everyone to feel welcome,” she said.  1927

  

A pharmacist was arrested for allegedly luring an Indiana woman to his Colorado home and then drugging and sexually assaulting her multiple times, according to a release from the Teller County Sheriff’s Office. And investigators believe there are more victims who have yet to come forward.Brent Stein, 46, was a pharmacist with Mountain Key Pharmacy in Florissant, Colorado, about 2 hours southwest of Denver. His pharmacy license was suspended this week as he was booked on three counts of sexual assault, but has since bonded out of the Teller County Detention Facility.The investigation into the allegations against Stein began on June 18, when Teller County detectives received information there was a sexual assault victim at a hospital in Colorado Springs, the sheriff’s office said.The victim told investigators that she had met Stein on a dating website and that the suspect had made promises to heal her medical conditions and that he was a pharmacist, the Teller County release read.The victim traveled from Indiana to Stein’s home, and during her stay, she claims she was given un-prescribed medication by Stein, which resulted in her being incapacitated. Investigators allege the victim was sexually assaulted multiple times by Stein while the victim was under the influence of the unknown medication.Upon further investigation, other victims have come forward to report unwanted sexual conduct by Stein, the sheriff’s office said. Detectives believe there might be other victims and are asking anyone who knows anything about this case or may be an additional victim to come forward. A middle school teacher and former Miss Kentucky pageant winner has been arrested and charged with sending nude photographs of herself to a 15-year-old boy, authorities said.Ramsey Bearse, a 28-year-old teacher at Andrew Jackson Middle School outside Charleston, West Virginia, allegedly sent the photos to a former student, according to the Kanawha County Sheriff's Office.The boy's parents found the photos on his phone and told police about them last week. They said their son was a student at Andrew Jackson from 6th to 8th grade and that Bearse was a teacher there during some of that time, according to a criminal complaint.In an interview with police, Bearse admitted to sending at least four photos of her topless via Snapchat from about August to October, the complaint states.She is charged with four counts of distributing obscene materials to a minor, a felony.The former beauty queen has been suspended from her teaching position and was released on a ,000 property bond after her arraignment, the sheriff's office said.Bearse, who competed in pageants under the name Ramsey Carpenter, was named Miss Kentucky in 2014.She won the preliminary talent competition at the national Miss America pageant in Atlantic City for her fiddle performance, CNN affiliate WTVQ reported at the time. Her platform issue was raising awareness about multiple sclerosis, which she was diagnosed with in 2010, WTVQ reported. 1427
