(KGTV) -- The San Diego Sheriff's Office is investigating an incident involving Phil Graham, a candidate to represent the 76th district in the California Assembly. Niki Burgan filed the battery case with the Sheriff's Office Sunday, May 20.  She accuses Graham of forcibly kissing her at an Encinitas Bar. Burgan told 10News that it happened at 1st Street Bar on S. Coast Hwy 101 on the evening of Sunday, May 13, into the early morning of Monday, May 14 as the bar was closing. She said that Graham had initially been flirting, even mentioning that he was running for office and asked whether she would vote for him. After finding out that he was a Republican candidate she said, no she was a Democrat. At some point, she says his talk turned into aggression and Graham grabbed her hair, pulled her in, and started to kiss her. She said she had to push him off. Burgan also said she remembers that Graham had so much to drink that night that she had to help him sign his tab. The next morning Burgan says she learned that he was related to former Governor Pete Wilson and she was worried about repercussions. That's why she didn't file right charges right away.  1259

Fake states "New California State" and "New Nevada State" have joined in on a lawsuit brought on by Republican Texas Attorney General Ken Paxton, looking to overturn the results of the 2020 election.According to Forbes, Chairman of the New Nevada State movement Robert E. Thomas III filed a 13-page amicus brief Friday.According to the brief, the pretend states are "directly impacted by the arbitrary and capricious changes in election laws and procedures occur with unfortunate regularity in the current States of California and Nevada.""New California State" and "New Nevada State" are movements seeking to form new states from rural counties who are trying to "stop the lawless actions" of the Democratic governors of Nevada and California, Forbes reported.According to USA Today, "New California" claimed its independence in 2018 in a bid to become the 51st state.The brief also alleges that the states took arbitrary actions to change voting laws without consulting their state legislature, which they say violates the Constitution.According to the Associated Press, 17 Republican attorney generals and 106 House Republicans have signed onto the case. 1165

They're Painted Lady butterflies, migrating north from Mexico. Tom Merriman, Director at Butterfly Farms in Encinitas, says conditions have been perfect for the species. The wet winter fueled vegetation growth in the Sonoran Desert in Mexico, giving caterpillars a lot to eat. “You’re going to see butterfly after butterfly after butterfly. Every two, three seconds you're going to see another butterfly coming through.”However, it's hard to predict when and where they'll be throughout the next few weeks. “The conditions were just perfect, I mean there could be over a billion of them, we don’t know. I'm hearing people from Palm Springs to Vista," said Merriman.He says he hasn’t seen a migration this vast in years. They're traveling at about 20 to 25 mph headed north to Oregon where they’ll breed, lay eggs and then die; the next generation will continue on north. The Painted Lady is smaller than the Monarch, and the two are relatives. ESCONDIDO, Calif. (KGTV) -- Wednesday morning, more than 110,000 signatures were turned in in an effort to put a housing project in North County in front of voters.The signatures were gathered by the “No on Newland Sierra” committee in 17 days. The signatures were turned in roughly a month after the County Board of Supervisors approved the project amid Southern California’s housing crisis.The Newland Sierra project would bring more than 2,000 new and affordable homes north of Deer Springs Road and west of the 15 in Escondido.RELATED STORIES: County approves North County?housing development | Signature drive underway to delay Newland SierraThose against the project say it would create traffic. ENCINITAS, Calif. (KGTV) — Dr. Pat Davis stood atop the bluffs at Grandview Beach in Encinitas on Friday, holding back tears."Bear with me, please," he says. "This is only the second time I've been near the beach since the accident."That accident, on Aug. 2, 2019. His wife, Julie, daughter Annie, and sister-in-law Elizabeth were on Grandview Beach, when the bluff above them crumbled and fell, killing them.RELATED: Lawmakers hope 0K federal grant will help prevent future bluff collapse in Encinitas"Believe you me," Davis says, "It'd be a lot easier to not come down here. I came down here about a week ago for the first time in six months and it was difficult."But Davis made sure he would be there Friday, to help announce the first significant federal money devoted to help make the bluffs safer.Congressman Mike Levin announced 0,000 to start the engineering phase of the project to help prevent the tragedy from occurring again.RELATED: Community, husband of victim push for Encinitas bluff stabilization"The primary purpose of the project is to stabilize tall bluffs that erode due to high-energy storm swells and rising sea levels, posing threats to life, property and critical infrastructure," Levin said.There's still a ways to go.The project needs another roughly .5 million dollars for engineering, and it's estimated to cost million to carry out every five to 10 years. He says he'd like to see more education about staying 40 feet from the bluffs; more blunt warning signs saying people have died at the beach; beach closures to families at high tide or when there is no safe are away from the bluffs, and 100-foot safe zones where parents know it is safe for their kids to play."I'd like to be able to at least say that I tried to do something," Davis says. 2038
