EL CAJON, Calif. (KGTV) — A transgender woman is suing an El Cajon gym over the use of gender-specific locker rooms.“My weight went from 340 pounds to 195 pounds,” Christynne Wood said. She says that weight loss is attributed to the water aerobics classes she has been taking at Crunch Fitness for the last eleven years. Not only did it help Wood shed the pounds, she also shed an old identity.“I lived so many years presenting myself as a male. Because I knew that is what was expected of me, and I didn't want to make others uncomfortable. The whole time, Christynne is inside Christopher going ‘I’m suffocating, please don’t let me die,” Wood said. Wood says she has identified as female since childhood. But she did not begin her transition from male to female until July 2016.Just two months after starting hormone therapy, she says a male gym member began to harass her.“The individual comes over to me, and says something untoward, and make a threatening gesture and walks in my direction,” Wood said. Terrified, Wood says she ran out of the men's locker room and told management. At first, she was led to the upstairs men's room, where there were fewer members than the women's facility. But she claims the harassment continued."I still must transit through the place where the assault took place to get to and from the pool for my workouts, so what have you done for me?"Days later, she brought a letter from her endocrinologist, explaining her transition and asking gym staff to accommodate her in the women's locker room. Last February, she legally changed her name and gender. But Woods says it took another seven months for Crunch to finally allow her to use their women's facilities."I thought I had friends in management that so totally understood me. When that was betrayed, how would you feel?"Wood says continued years of alleged harassment and neglect for her well-being led her to sue Crunch Fitness."It makes me cry that it had to get to this degree,” Wood said. “Nobody wants to sue anyone. Nobody does anything or pays attention until somebody hurts or inconveniences them and then they realize the magnitude and depth of what they’ve done wrong.”But she says this civil case is bigger than Christynne Wood.“I’m getting some form of justice, but it’s not just about me. There’s a whole sisterhood out there is being abused and marginalized. I don’t ever want this to happen to any of my T-girl [Transgender-girl] sisters,” Wood said.Crunch Fitness’ corporate office gave 10News a statement after the ACLU announced the lawsuit on Wednesday.  2647

EL CAJON (KGTV) – An El Cajon property owner said a police pursuit in March that ended at her property has led to questions over repairs.Jenny Wu has owned the property in the Villa Madera condominium complex on Mollison Avenue for more than a decade. On March 19, a vehicle crashed into her home, causing extensive damage.According to Wu, she had two elderly renters living there at the time of the crash, with one ending up in the hospital. She said she gave the information about what happened to her homeowner’s association immediately following the incident.More than five months after the crash, her property is still boarded up.Through her translator, she said the HOA wanted to investigate. Wu and her son said communication from the HOA and the property management company on the process to fix the condo has been spotty.Dan Zimberoff is an attorney who specializes in HOA matters. He is not involved in the case, but said the association typically insures common area.“When you have a singular affected homeowner like you do here, many times I see the association allows that homeowner have direct access with the adjuster. It just streamlines the processes and allows that direct communication,” Zimberoff said.Wu was one of the many temporarily laid off from her job at a local casino because of the pandemic. She still pays HOA fees at her condo, which adds up to roughly 0 per month. The president of Property Management Consultants said Team 10 has “been told many inconstancies [sic].” President Hugh Maynard said the insurance company would be contacting Team 10 with information, but the company never reached out. Maynard said the owner did not carry their own insurance and the HOA is paying the deductible. He added that they have kept the “family up on every turn of events” and showed Team 10 emails as proof. Wu’s son, who has been helping his mother with communication, admitted there have been emails exchanged with the property management company, but it has not been consistent.Maynard said the insurance company was controlling the rebuild, adding that the City of El Cajon condemned the unit.A spokesperson for the City of El Cajon confirmed the unit was tagged as structurally unsafe and permits will be required to repair it. As of this week, no permits have been applied for, said spokesperson David Richards.“I want them to fix the problem as soon as possible,” Wu said through her translator. No timeline has been given for when repairs on the unit will begin. 2503

EL CAJON, Calif. (KGTV) -- New video from a nearby business shows the moments before a driver plunged into a sinkhole in El Cajon. The images seeming to tell a different story than was released by El Cajon police earlier in the week. The incident happened late Monday night on Vernon Way and Johnson Avenue. A white car became almost completely submerged in a deep sinkhole after a water main break earlier in the evening. RELATED: Sinkhole forms at El Cajon intersection, swallows car At the time police said the driver, who wasn't injured, ended up there after going around a barricade.Ken Wingert's office has surveillance cameras pointed right at the street where it happened, so out of curiosity, he took a look and says the video paints a different story than the one he first heard. "I saw the video...no that's not true," Wingert told 10News. "The police officer actually went to her window, talked to her and the car pulled a u-turn and went into the sinkhole."After the car goes down, Wingert says the video gets even more interesting. The officers can be seen walking over, but it's how they did it that has him confused.  "Why were the police not reacting so fast once the car went into the pothole? All of a sudden when the car started sinking more everybody started running towards it," he said. "To me that was a little slow on that part."On Thursday 10News made multiple attempts to talk to El Cajon police about the video. We were told that there was no one available to comment. 1537

EL CAJON (CNS) - A driver whose blood-alcohol content was nearly quadruple the legal limit slammed into the back of a pregnant woman's car in Ramona two years ago, killing the woman and her unborn child, a prosecutor told a jury Wednesday. But a defense attorney denied that his client caused the crash, claiming the prosecution's case was based entirely on circumstantial evidence and a shoddy police investigation.Andrew Milonis, 46, is accused in the Mother's Day 2017 crash that killed 29-year-old Jessica Foderingham and her unborn child, a girl who Foderingham and her husband planned to name Ayanna. Milonis is charged with two counts each of second-degree murder, gross vehicular manslaughter while intoxicated, hit-and-run and drunken driving.RELATED: Witness: Driver in El Cajon crash, that killed pregnant mother, was 'very intoxicated'Foderingham was eight months pregnant when her Dodge Dart was hit, sending it careening into a tree in the center median on San Vicente Road about 6:45 p.m. May 14, 2017.Deputy District Attorney Laura Evans said in her opening statement that Milonis had been drinking throughout the day, having at least seven drinks at a local bar before he got behind the wheel of his GMC Yukon. The prosecutor said a bartender recommended that Milonis arrange a Lyft ride to get home, but he ignored the advice. Then while driving, Milonis struck a tree and multiple telephone poles before crashing into Foderingham's car, Evans said.RELATED: Driver accused of killing pregnant woman, taking Lyft to barAfter the crash, Milonis continued driving to a nearby hotel, where employees called a Lyft driver for him, Evans said. When the Lyft driver arrived and asked Milonis where he wanted to go, the defendant allegedly told the driver something to the effect of, "Anywhere I can get a drink," according to Evans. He was driven to a bar on Main Street, where sheriff's deputies located and arrested him shortly after he arrived. When his blood was tested, he had a blood-alcohol content of 0.20, but Evans alleged it was above 0.30 at the time of the crash -- well above the 0.08 legal limit. The prosecutor told jurors the impact of the crash left a partial imprint from Milonis' license plate on the back of Foderingham's car, and there was no evidence of mechanical issues on either car that might have contributed factors to the crash.RELATED: Vigil held for pregnant Ramona crash victimSix months earlier, Milonis has been arrested on suspicion of DUI for allegedly driving drunk and hitting a neighbor's fence before going home, according to Evans, who said he suffered a minor head injury in the crash and had a 0.28 blood alcohol content at the time.Christian Foderingham, a U.S. Marine, testified Wednesday that he and his wife's two young sons from a previous relationship began Mother's Day by making her breakfast and showering her with gifts throughout the day. The couple then left home for Jessica Foderingham's grandmother's house in Ramona, taking two cars -- Jessica in her Dodge Dart and Christian driving the boys in his Hyundai. He was driving ahead of his wife when he heard a loud bang behind him, saw a dark-colored SUV swerve onto a sidewalk and witnessed his wife's car slam into a tree. He testified that after hearing the loud noise, he saw his wife's car flying through the air before it struck the tree head-on and bounced back into lanes of traffic.RELATED: Judge raises bail to M in Ramona fatal hit and run"It felt like my heart stopped," he testified.Foderingham said he ran to his wife's car, smashed the driver's side window open and cut off her seatbelt to remove her from the wreckage. An off- duty firefighter helped Foderingham perform CPR until emergency personnel arrived and took her to Palomar Medical Center in Escondido, where she died, according to the victim's husband.Milonis' attorney, Ward Clay, told jurors the crash was "a tragic accident" but said Milonis was not responsible."No one witnessed exactly how the accident happened," Clay said. The attorney said Christian Foderingham never got a good look at the SUV driver.Foderingham testified that the SUV had tinted windows and there might have been two people inside. He could only confirm that the driver was Caucasian.Clay claimed that at the time of the crash, Milonis was not near the crash scene. The attorney also said the California Highway Patrol "made major mistakes" in their investigation of the case, and that "critical, forensic evidence" had been lost or destroyed, though he did not specify what that evidence was.Clay said he expected the jury to be "angry and want to hold someone responsible. But that person is not in this courtroom." 4692
