IMPERIAL BEACH, Calif. (KGTV) - South San Diego County families were left in tears. A single mother and her kids were forced to sleep in their car. 10News investigative reporter Jennifer Kastner is exposing the man accused of running an elaborate housing rental scheme and preying on people who are struggling to make it in San Diego. Deputies believe that Daniel Uriarte pretended to own a house and scammed more than ,000 from several families that were looking to rent. Jacenia Ramos was crying when she met with 10News. “I mean, he didn't only do it to us, he did it to other people, too. That's just wrong,” Ramons says. Two weeks ago, 10News connected with Ramos’ family and other families after someone posted a warning about Uriarte on an Imperial Beach community Facebook page. Multiple people told 10News that Uriarte was operating a fake rental on a property in Imperial Beach.When 10News arrived at the house, there were signs in the window. “I basically placed [the signs up] that the house is not for rent and if someone did rent it out to them, to contact the local deputies and they'll help them out,” says Eric Leon Estrada.Leon Estrada cares for the house for his mother, who owns it. They started renting it out to Uriarte and his family in 2018. Leon Estrada and his mother tells 10News they came across a Craigslist post a few months ago advertising a two-room apartment for ,200 a month. The ad said the unit -- which was a garage converted to an apartment -- was still under construction, according to Estrada. Leon Estrada says that Uriarte knew that subletting was not allowed. He showed 10News a copy of the lease, which clearly states that they agreed "not to transfer, assign or sublet the premises or any part thereof." Leon Estrada and his mother say that they told Uriarte’s family that they had 30 days to leave.Leon Estrada says he noticed "mail coming in from different families with different last names, so it doesn't take a detective to figure that out.”“I’m very grateful that we had a car to sleep in. We could have been sleeping on the sidewalk,” says a young woman who 10News is not identifying. She’s overcome with shame and embarrassment. She says her family fell for Uriarte’s Craigslist ad and handed over a massive deposit, thinking that he was the owner. Yet when they tried to move in, they tell 10News that Uriarte kept making excuses to delay their move-in. “There was lead paint. There was something wrong with the electric cables. It was just excuse after excuse,” she adds. Ramos tells 10News that Uriarte gave her a similar run-around. “I was so stressed out. I ended up in the hospital because of all the stress,” she explains. She shared with 10News a voicemail that she says Uriarte left her. In part of it, the man’s voice is heard saying, "It’s not that I don't want to rent to you. It's not. I'm telling you, and it's the truth, it's the fact that I don't have enough time to finish up that job.” A few days after 10News interviewed some of the families at the house in Imperial Beach, this station received a call from a San Diego County Sheriff's detective. He told 10News that they planned to arrest Uriarte soon. Over the phone, Uriarte denied doing anything wrong. Last Friday, he was scheduled to meet 10News, but he never showed up. He texted that his attorney would contact 10News, which never happened. This Tuesday, deputies notified 10News that they'd arrested him. Part of the statement reads, “From June 5 to July 24, 2019 Daniel Uriarte…misrepresented himself as the owner and manager of a rental property located in the 800 block of 10th Street in Imperial Beach. Uriarte advertised the property via Craigslist and presented fraudulent rental agreements to his victims. To date, Uriarte has scammed six known victims out of more than ,000. On August 23rd, Detectives from the Imperial Beach Sheriff's Substation arrested Uriarte for six counts of obtaining money by false pretenses. He was booked into the San Diego Central Jail. Uriarte's first court appearance is scheduled for August 28th at 1:30 p.m. at the South Bay Courthouse. While this case has been submitted to the District Attorney's Office, the investigation is ongoing. The Sheriff's Department is looking for additional victims or witnesses. Anyone with information can call Detective Jason Phillips with the Imperial Beach Sheriff's Substation at (619) 498-2400.”10News attended Uriarte’s arraignment on Wednesday, where he pleaded not guilty. Graham says he hopes to have the confirmation hearing process wrapped up by Thursday.Democrats warn of loss of health careSeveral Democrats noted that in the past, President Donald Trump has only promised to nominate justices who will undo the Affordable Care Act — the law that enacted public health care and offered more consumer protections. They also pointed to Barrett's past criticism of Supreme Court decisions that have upheld parts of the law.Other Democrats, like Sen. Cory Booker, argued that Barrett's nomination was a ploy by Republicans to undo public healthcare initiatives and protections afforded by the Affordable Care Act, saying that a Barrett nomination would look like "deciding between buying medicine and buying groceries."Sen. Kamala Harris — the current Democratic vice presidential nominee — echoed those statements, claiming that President Donald Trump was attempting to "bypass the will of the American people" so they can strike down the Affordable Care Act. Sen. Mazie Hirono, herself a cancer survivor, wondered aloud if she would have survived had she been in a position that many Americans may find themselves in without government-backed healthcare.Graham has said that he expects Barrett to be confirmed to the Supreme Court a week before the Nov. 3 election. On Nov. 10, the Supreme Court is scheduled to hear a key case to determine the legality of portions of the ACA.COVID-19 fears shape hearingSeveral Democrats called out their Republican colleagues for even holding hearings amid a pandemic. Appearing virtually, Harris claimed it was "reckless" for the Judiciary Committee to hold in-person hearings and called out Graham for not requiring Senators to test negative for the virus before appearing in the room.At least two of the senators on the committee — Sen. Mike Lee, R-Utah, and Sen. Thom Tillis, R-North Carolina — have recently tested positive for the virus. Both at Barrett's nomination ceremony at the White House in late September — an event that has been described as a "superspreader" after about a dozen people in attendance, including President Donald Trump, tested positive for COVID-19. Lee, having been cleared by a Congressional physician, appeared in person. Tillis appeared on video teleconference.Graham said Monday that the hearing room had been deemed by the Capitol architect to be in compliance with CDC social distancing guidelines. Other Democrats said their time would be better spent working on passing more COVID-19 stimulus — something Trump has been willing to entertain in recent days.Republicans defend Barrett's character, call out those questioning her faithRepublicans defended Barrett's character by accusing Democrats of attacking her Catholic faith, often pointing to constitutional statues against "religious tests" as a qualifier for public office. Sen Josh Hawley, R-Missouri, specifically accused Harris of "anti-Catholic bigotry" by questioning past judiciary appointments fitness for office due to their membership in the Knights of Columbus, a Catholic organization.Sen. Joni Ernst, R-IA, further defended Barrett's character against those who she says had labeled her a "handmaid," saying that such accusations were "demeaning to women.""We don't have to fit a narrow definition of womanhood," Ernst said. At this point, Republican Senators have the votes to confirm Barrett. Graham has said he expects the process to be finished in the next two weeks — about seven days ahead of election day.Barrett pays homage to Scalia, GinsburgIn her opening statement, which was obtained and published by several media outlets, Barrett paid tribute to the late Justice Antonin Scalia — a conservative icon for whom Barrett worked for as a clerk early in her career. She said she shared in Scalia's philosophy of "textualism" — apply the law directly as it is written."A judge must apply the law as written, not as the judge wishes it were," Barrett said.Her opening statement also offered condolences to the justice whose seat she hopes to fill, Justice Ruth Bader Ginsburg."I have been nominated to fill Justice Ginsburg's seat, but no one will ever take her place," Barrett will say. In a letter to four senators, Social Security Chief Actuary Stephen Goss estimated that if President Donald Trump eliminates payroll taxes, Social Security Trust Fund would be "permanently depleted" by 2023."If this hypothetical legislation were enacted, with no alternative source of revenue to replace the elimination of payroll taxes on earned income paid on January 1, 2021, and thereafter, we estimate that DI Trust Fund asset reserves would become permanently depleted in about the middle of the calendar year 2021, with no ability to pay DI benefits thereafter," Goss said in the letter. "We estimate that OASI (Old Age and Survivors Insurance) Trust Fund reserves would become permanently depleted by the middle of the calendar year 2023, with no ability to pay OASI benefits thereafter."The letter was addressed to Sens.
