SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. SAN DIEGO (CNS) - A motorist who fled a traffic stop in Encanto Tuesday led officers on a 40-minute pursuit that ended with his arrest near Lake Hodges, authorities reported.The man refused to yield when San Diego police tried to pull him over for a traffic violation in the 6800 block of Akins Avenue shortly after 9 a.m., SDPD public-affairs Officer Michael Stirk said.The motorist drove off to the east toward Spring Valley, then entered state Route 125 and headed north, Stirk said.Reaching Santee, the man entered SR-52 and headed west, then merged onto northbound Interstate 15 when he got to the Miramar area.While passing through northern San Diego with SDPD and California Highway Patrol personnel tailing him and tracking his pursuit aboard a police helicopter, the driver managed to avoid running over several spike strips that CHP officers hurled onto the roadway in his path.After entering Escondido, however, the man finally pulled to a stop on the side of the freeway near Ninth Avenue and was taken into custody without further incident about 9:45 a.m., Stirk said.The arrestee's name was not immediately available. 1139

SAN DIEGO (CNS) - A young man accused in a series of San Diego-area gang-related killings and attempted slayings pleaded not guilty Monday to murder, attempted murder and conspiracy charges.Ismael Betancourt, 20, is charged in the Aug. 1, 2019, shooting death of 57-year-old Marco Magana in Mountain View, the Feb. 8 shooting death of 19-year-old Leah Posey in Southcrest, and two attempted murders that allegedly occurred on July 24, 2019 and Feb. 8.San Diego police announced Betancourt's arrest last month in connection with the April 8, 2018, shooting death of 55-year-old Lowry Rivers in National City, which occurred when Betancourt was 17. Rivers' killing is not listed in the latest complaint, and it's unclear whether Betancourt is being tried in juvenile court regarding that crime or whether additional charges are pending in his current case.In addition to the murders and attempted murders, Betancourt is charged along with six co-defendants with conspiracy to commit a crime, for what prosecutors allege was a plan to kill rival gang members.The overarching conspiracy includes the July 12, 2019, shooting death of 20-year-old Joaquin Ruiz, who was shot in a vehicle in Bay Terraces by assailants who opened fire from another vehicle.The four defendants charged with that slaying have been arrested and pleaded not guilty. Two of those defendants, Ethan Apan, 28, and Kevin Herrera, 26, are also charged in the murders in which Betancourt is charged. SAN DIEGO (CNS) - Leaders of the Los Angeles County Federation of Labor plan to announce Monday whether they will endorse a potential strike by grocery workers at Ralphs, Vons, Albertsons and Pavilions in San Diego County and the rest of Southern California.Raising the threat of the first Southland grocery strike in nearly 16 years, grocery workers last week overwhelmingly authorized their union to call for a work stoppage if a contract agreement cannot be reached.``Southern California grocery workers voted in large numbers, and overwhelmingly rejected the unfair terms that have been proposed by Ralphs, Albertsons and Vons,'' said John Grant, president of United Food and Commercial Workers Local 770.The voting was conducted Monday and Tuesday, Grant said. Albertsons/Vons/Pavilions issued a statement saying, ``The outcome of the strike authorization vote does not change anything related to this process. We remain committed to negotiating a contract that is fair to all parties, including our employees, and will continue to work to achieve that.'' Ralphs issued a similar statement and said, for now, ``it is business as usual in Ralphs stores.''The strike authorization vote means union negotiators have the power to call for a strike, if deemed necessary, but it does not automatically mean a walkout will occur.The next bargaining sessions involving the union and the companies are scheduled for July 10, 11, and 12, Grant said.The contract between the union and the companies expired in March. SAN DIEGO (CNS) - A person at Morse High School was recently diagnosed with tuberculosis and may have exposed students and staff, the San Diego County Health and Human Services Agency announced Tuesday.HHSA is working with the San Diego Unified School District to notify those who were potentially exposed and provide TB testing. The dates of exposure are from Feb. 28 to March 13 of this year.Morse High School, in the Skyline area of San Diego, is currently participating in social distancing protocols due to COVID-19 and onsite TB screening will not be available.According to the HHSA, students who were identified as being potentially exposed to TB can get tested with their primary care provider. Students who do not have a medical provider should contact the county's TB Control Program at 619-692-8621 to arrange to arrange an appointment for a free test.School teachers and staff will be provided testing by the San Diego Unified School District.The disease is transmitted from person to person through indoor air during prolonged contact with an infectious person. Most people who are exposed to TB do not become infected."Testing is recommended for all those exposed to make sure they are not infected, since initial infection usually has no symptoms," said Dr. Wilma Wooten, the county's public health officer. "If a person is infected, early diagnosis and prompt treatment can prevent the infectious form of the disease."Symptoms of infectious TB include persistent cough, fever, night sweats and unexplained weight loss. People infected with the disease, or who are immunocompromised, may not show symptoms. It can be cured with antibiotics.Tuberculosis is not uncommon in the region but has been decreasing since the early 1990s and has stabilized in recent years.In 2013, a total of 206 cases were reported in the county, the lowest number since local TB cases peaked at 469 in 1993. There were 237 cases reported in 2017 and 226 in 2018. Last year, 265 residents were diagnosed with TB.
