SAN FRANCISCO (AP) — A U.S. judge on Monday blocked the Trump administration's policy of returning asylum seekers to Mexico as they wait for an immigration court to hear their cases but the order won't immediately go into effect.Judge Richard Seeborg in San Francisco granted a request by civil liberties groups to halt the practice while their lawsuit moves forward. He put the decision on hold until Friday to give U.S. officials the chance to appeal.The launch of the policy in January in San Diego at the nation's busiest border crossing marked an unprecedented change to the U.S. asylum system, government officials and asylum experts said. Families seeking asylum typically had been released in the U.S. with notices to appear in court.President Donald Trump's administration says the policy responds to a crisis at the southern border that has overwhelmed the ability of immigration officials to detain migrants. Growing numbers of families are fleeing poverty and gang violence in Guatemala, Honduras and El Salvador.The lawsuit on behalf of 11 asylum seekers from Central America and legal advocacy groups says the Trump administration is violating U.S. law by failing to adequately evaluate the dangers that migrants face in Mexico.It also accuses Homeland Security and immigration officials of depriving migrants of their right to apply for asylum by making it difficult or impossible for them to do so.Under the new policy, asylum seekers are not guaranteed interpreters or lawyers and don't get to argue to a judge that they face the potential of persecution or torture if they are sent back to Mexico, Judy Rabinovitz, an attorney for the American Civil Liberties Union, said at a March court hearing.Seeborg appeared skeptical of the lawsuit's argument that the administration misapplied a U.S. law that allows the return of immigrants to Mexico. The ACLU and other groups that are suing say that law does not apply to asylum seekers who cross the border illegally or arrive at a border crossing without proper documents.The judge also questioned the Justice Department's argument that asylum seekers sent back to Mexico are not eligible for certain protections, such as a hearing before an immigration judge.The administration hopes that making asylum seekers wait in Mexico will discourage weak claims and help reduce an immigration court backlog of more than 800,000 cases.Justice Department attorney Scott Stewart said there is a process to protect immigrants who could face harm in Mexico. All 11 plaintiffs in the lawsuit are represented by attorneys, and 10 already have appeared for court proceedings, he said.Border Patrol arrests, the most widely used gauge of illegal crossings, have risen sharply over the last year but are relatively low in historical terms after hitting a 46-year low in 2017.The launch of the policy followed months of delicate talks between the U.S. and Mexico. SAN DIEGO, Calif. (KGTV) - A new California law could let convicted killers out of prison, and San Diego County's district attorney said her office will fight it on a case-by-case basis.Senate Bill 1437 passed the state Legislature last year and went into effect on January 1. It narrows the definition of murder so that only people who are involved in a killing can be charged with that crime.Before the law, accomplices in a killing could also have been charged with murder."It may let murderers go free, because of how far it goes," said San Diego County District Attorney Summer Stephan.Stephan said her office will challenge some re-sentencing hearings based on the new law, although she said they don't know how many there will be.One possible case involves Kurese Bell, who He as convicted of murder in 2016 for his role in the robbery of a North Park marijuana dispensary.During the robbery, Bell and another man, Marlon Thomas, got into a shootout with a security guard at the dispensary. The guard shot and killed Thomas.The DA's office argued that Bell should face murder charges because his actions in the robbery led to the shootout and, ultimately, Thomas' death.Bell is currently serving a 65-year-to-life sentence.Stephan said criminals need to be held accountable for the crimes they commit and cause."It's really important that each offender is held culpable at the right level," she said. "That's what justice is about."Supporters of the new law say it is a vital part of California's efforts at criminal justice reform. They say the old law unfairly targeted young minorities.On its website, the group Restore California says the new law makes sentencing in California more "equitable." They also say it gives accomplices an incentive to cooperate with investigators."In a co-defendant felony murder case, co-defendants who were not the actual killers, who did not aid and abet the killing, or who did not act with reckless indifference to human life will now have an incentive to talk and tell the truth about what happened," the website reads. 2073

  

SAN DIEGO, California — One person died and two others were injured, and Coast Guard crews rescued 17 others after a mega yacht collided with a fishing vessel off the coast of Imperial Beach on Friday night. The 332-foot yacht, Attessa IV, crashed into the 65-foot sportfisher vessel, Prowler, just before 8 p.m. about nine miles off the shore of Imperial Beach, according to the Coast Guard.The collision caused extensive damage to the right side of the Prowler.One man was airlifted to UCSD Hillcrest and died at the hospital, the Coast Guard confirmed. Two others were injured in the accident.Coast Guard crews transferred 17 passengers from the damaged fishing boat back to San Diego. The Prowler's 10 remaining passengers were transferred onto the Attessa IV, set to return to San Diego.The Coast Guard is investigating the cause of the accident. 884
