SAN DIEGO (KGTV) - Southcrest neighbors banned together to file a lawsuit against the City of San Diego, claiming a city park was not designed to properly drain and therefore floods the neighborhood each time it rains.Last December was the breaking point for neighbors near Southcrest Trails Park, at S. 37th Street and a dirt road behind houses situated on Beta Street. They say feet of water flooded into their homes."This actually becomes a sinkhole, this area," said Greg Montoya, who is leading the charge with his hefty binder full of decades of documentation of the problem. Montoya has pictures of his white pickup truck sunken rims-deep into his yard due to saturation.The lawsuit describes it as "a 66-acre, 1.2-mile corridor in the Southcrest neighborhood of San Diego to construct Highway 252, which would connect Interstate 805 and lnterstates 5 and 15."The project never materialized, Montoya says, because St. Jude, thinking of the school, put up a fight."So then the City of San Diego put dirt berms in to keep people from driving back here, to keep people from throwing trash back here, because it became a dump," Montoya said. The park took shape in 2003, according to the lawsuit.Montoya and other neighbors say there was not enough drainage put in, sending water running down the five-foot berm every time it rains.A storm in December 2018 left many stranded, including Ricky Vasquez, who was trying to pick up his one-year-old son."Other cars were stuck in the middle of the street because the water was so high," said Vasquez.Neighbor Pastor Nicolas Martinez said his home flooded, ultimately costing ,000.Montoya was fed up."San Diego's America's Finest City for some but not for all because I've got documentation for over 30 years for asking for help for this situation that they've created and I'm just ignored," said Montoya.He went to attorney Evan Walker, who said his team found one of the two storm drains at the park "is not connected to any sort of system despite the city's own plans to connect them to the system."Montoya hopes the lawsuit causes the city to step up.10News reached out to the City of San Diego who said they could not comment on ongoing litigation. 2211

SAN DIEGO (KGTV) - Some parents at a San Diego Unified School District campus are asking district officials for help with challenges they say are brought on by new, later start times.This fall, three schools implemented SDUSD's "Healthy Start Times" program, beginning classes at 8:35 a.m. The District has cited multiple studies that show later start times have positive effects on the health and academic performances of students.RELATED: Three San Diego schools to switch to later start times in 2019But some parents say the District isn't doing enough to help families who still have to drop their students off at school before 8 am, so the parents can get to work on time.Angel Caturay is one of those parents. He drops his son, Angel Miles, off at the San Diego School for Creative and Performing Arts at 7:30 a.m. each morning. Angel Miles then has to wait outside of the school's locked gates until 8 am.10News went by the school at 7:40 a.m. on Thursday morning and found more than two dozen other students also waiting. Some said they had been there since 7 am. Aside from one parking lot attendant, there was no adult supervision.The gates at SCPA don't open until 8 a.m. School begins at 8:35 a.m."Who's responsible?" Caturay asks. "When you drop your kids off, you feel the school should be responsible while they're here at school."In a statement, a district spokesperson told 10News that, "Students left without supervision is a safety risk... the principal has been working with parents to help them identify solutions."Caturay wants to know if the library, cafeteria or classroom could be opened for students to wait in. His son says it's challenging to use that time for homework."There's a lot of groups just sitting down and talking," says Angel Miles. "There are no tables. You're bending your back over, and that can get uncomfortable."The District addressed the issue in a letter to parents last year. Part of it reads, "just because some parents may be unable to provide healthy sleep hours for their teens does not mean that school district policy should prevent all of their teen students from getting the amount of sleep doctors say they need to be healthy and safe."The District plans to have every high school go to the later start times by next fall. Meanwhile, the California Legislature recently passed SB 328. The new law will require all middle and high schools in the state to start later in the day. It specifies start times no earlier than 8 am for middle schools, and 8:30 a.m. for high schools.Governor Newsom has not signed the bill yet, and it wouldn't go into effect until 2022. Former Governor Jerry Brown vetoed a similar bill in 2018, saying start times are an issue that individual school districts need to decide.RELATED: Proposed bill would require later start times for middle and high schoolsCaturay says he understands the decision that SDUSD made. When he emailed the principal at SCPA, he was told about the District's bus program. District files show that costs 0 per year for the first student, 0 for the second. Caturay says he can't afford that, and neither can many other families.He hopes the District can do a little more to accommodate families like his. "It would be nice if they could open up the library," he says. "At least they (the students) could get some work done, study work ahead of time. SAN DIEGO (KGTV) - San Diego’s rainy winter led to a bug-infested spring which is, in turn, giving away to a spider-filled summer. County of San Diego officials say 2019 could bring a “bumper crop” of orb weaver spiders due to an increase of its food supply. “So, you’re probably going to be running into a lot of spider webs very soon, if you haven’t already,” said County supervising vector ecologist Chris Conlan. Conlan has a term for what happens after a person walks into a web: the crazy spider dance. Orb weaver spiders, which include any spider that weaves a web, are usually not harmful to people, according to Conlan. They generally don’t bite unless they’re threatened. “A well-fed female can be a pretty imposing spider,” Conlan said to County News Center. “But they’re generally nothing to be worried about. In all honesty, if you run into their web, their general reaction is to bail off quick. They don’t like to hang around once something that’s big enough to smash through their web hits it. They know it’s not anything they want to tackle and wrap up to eat.” Conlan recommends avoiding walking through areas spiders can use as anchor points. SAN DIEGO (KGTV) — San Diego Police say no foul play was involved with human remains discovered in a fire pit last month.The remains were discovered by a man on Oct. 29, 2020, just after 10:30 a.m. in the fire pit located on the east end of Fiesta Island, according to police. A forensic anthropologist confirmed images sent by police indicated that the remains were human.RELATED: Possible human remains found in Fiesta Island fire pitPolice said after a thorough investigation, it was determined that while the man died in the fire pit, no foul play was suspected.Investigators say the remains have been identified as a 79-year-old Hispanic man, though his name was not released.Anyone with information is asked to call SDPD's Homicide Unit at 619-531-2293 or Crime Stoppers at 888-580-8477. 801
