OCEANSIDE, Calif. (KGTV) - Oceanside could be getting a new active sports complex, complete with a man-made wave pool, perfect for surfing competitions, according to Mayor Peter Weiss. The idea is in it's beginning stages, no formal paperwork has been submitted to the city clerk. 10News spoke with her Wednesday and she said the developer, Zephyer Partners, has been talking with council members.Neighbors have already been hearing construction equipment hacking away at the remains of the drive-in that operated before the swap meet took over."When I was driving by and I saw you standing here I thought I need to find out because she probably knows more than I do," Neighbor Liz Lewellen said.She said the neighborhood has been wondering what could happen to the lot. Mayor Weiss told 10News the developer gave him this pitch, "n active sports complex, there would be a BMX track, a climbing wall, things like that, it would also have a hotel and then sports oriented retail." He also described a wave pool that mimics the Kelly Slater Surf Ranch in Fresno. The facility is state-of-the-art and perfect for competitions.The idea sparking interest in the community. Lewellen was shocked and excited when she heard."I love the idea that it's commercial coming in because this area desperately needs more restaurants more things," Lewellen said. "So that's really exciting, I know that we have the skate park up the street and that's been a god send for the kids and the active people in the neighborhood."Thursday Zephyr Partners will host a community workshop at Saint Mary Star of the Sea School from 6-8 p.m."It's something unique, I think I'd like to actually see the plans what they're proposing," Weiss said.When asked if Lewellen would try out the wave pool, "I've always wanted to learn how to surf," she said laughing, "so maybe, we'll see, if it's the perfect wave, maybe someone can train me how to perfectly get up on the board."Lewellen had one concern though, wondering how traffic would affect her drive to and from home.Zephyr Partners did not respond to 10News's request for comment. (CNS) - Police identified a 43-year-old man armed with a machete who allegedly stabbed a police dog and broke a patrol vehicle's window in Oceanside.About 5 p.m. Tuesday, an officer was inside a vehicle, stopped at a traffic light on College Boulevard and Plaza Drive, when he saw the suspect, Noomane Trabelsi, across the street yelling at him, according to Oceanside Police Department Public Information Officer Tom Bussey.The suspect allegedly approached the vehicle swinging a machete and broke the driver's side window, Bussey said.The officer suffered minor injuries and called for assistance. A perimeter was established, and the suspect was seen near the Mossy Nissan dealership, at 3535 College Blvd., and officers tried to make contact with him, according to Bussey.Trabelsi went into a nearby ravine, prompting officers to deploy a police dog, according to Bussey.Trabelsi allegedly stabbed the dog, named Chico, in his head and then stabbed himself multiple times in his stomach, Bussey said. Chico was taken to a veterinarian and is expected to recover, according to Bussey.Officers, assisted by a San Diego County Sheriff's Department helicopter, searched for Trabelsi for two hours in tough terrain, according to Bussey.Trabelsi was located, arrested and taken to Scripps La Jolla to be treated for the self-inflicted injuries, Bussey said. 1381

OCEANSIDE, Calif. (KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. Oklahoma teachers say they have reached their breaking point over pay and school funding and may walk off the job next month.Galvanized by a growing social media campaign, teachers wanted competitive pay to attract and keep teachers in the state. Teachers were hoping for a ,000 raise with House Bill 1033, collectively called the Step Up Oklahoma Plan, which looked to increase the tax on tobacco and gas.However, that bill was voted down in the state House because it didn't get the 75% approval needed to pass, according to Oklahoma Department of Education Superintendent Joy Hofmeister."It was soul-crushing," Hofmeister said.Because of that, and a handful of other failed bills in the last two to three years, teachers are now actively discussing a strike, on the heels of a statewide strike by public teachers in West Virginia."What spurred this momentum was so many teachers across the state are at their wit's end," said Teresa Danks, a third-grade teacher in Tulsa who is also the founder of the nonprofit Begging for Education. "No bills have been passed in favor of teacher pay or funding, the frustration and low morale has continued to grow. We're losing teachers like crazy to other states."One of the authors of HB 1033, Republican Sen. Kim David, did not reply to CNN's request for comment. The legislative assistant for the other author, Republican Rep. Kevin Wallace, said the request for comment was forwarded to the state speaker of the house.
