SAN DIEGO (KGTV) - A Clairemont neighborhood woke up Thursday to a police raid, one week after surveillance video captured a gun battle in the exact same area. A damaged front door was left behind after a police action early in the morning. Just before 7 a.m., a surveillance camera captured officers arriving on Batista Street. They line up in front of a two-story home, before executing a search warrant there."So unusual. Don't remember anything like this in recent memory," said Gail Martin, who has lived in the neighborhood for more than 30 years. For neighbors, the bizarre events began last Friday. Doorbell video shows a speeding black truck turning onto a street past a sedan, which then begins to move. In the next video, the truck is stopped on the street. Not far away, someone emerges from the passenger side of the car and starts firing a handgun. After about six shots are exchanged. The car then backs up and peels out. Another surveillance camera shows the truck racing out of the area.Evidence markers revealed a scene resembling the Wild West. Did other clues lead to the nearby home? Neighbors tell 10news a lot of young people are seen coming in and out at all hours."A lot of partying, a lot of drinking. Yelling and fighting ... not very common for this neighborhood," said Eric Jacobs. On this morning, the activity was narcotics officers swarming the home. The search of the house lasted more than an hour-and-a-half. When it wrapped up, a young man was handcuffed and taken into custody. A SDPD spokesperon confirmed a search warrant was completed by narcotics officers but said detectives have yet to make a link to the shooting. 1665

SAN DIEGO (KGTV) - A final report from the National Transportation Safety Board points to the probable cause of a 2016 crash into the Navy Pier and dock in downtown San Diego.The Adventure Hornblower collided with the seawall sending people on shore scrambling for safety.According to the August 2017 report, the probable cause is listed as “failure of the port transmission to disengage from the forward propulsion position due to the operating company’s lack of adherence to the transmission manufacturer’s recommended periodic maintenance schedule and the lack of routine maintenance and upkeep of the propulsion system’s equipment.”It also says that the lack of instrumentation to provide a positive indication of thrust direction or an alarm to indicate the propulsion control system was not responding properly to the captain's commands."it was shocking,” said passenger Susan Pendergast. “I mean it was just shocking.”Pendergast says when the vessel hit the dock she was thrown to the ground, re-injuring an already bad back.She eventually had surgery in two different places.“It’s left me certainly not with the life I once had,” she said.Following the collision, an official with Hornblower told 10News it could be related to a possible mechanical failure.A few months later court documents pointed toward an unforeseeable and unpreventable mechanical failure despite proper maintenance, the fault was caused by the neglect of others.The NTSB report disputes that finding.When talking about the collision, the report states,  “As the Adventure Hornblower approached the pier on the accident date, the port transmission failed to respond to the captain’s helm orders. Investigators believe that the fault occurred between the servo-actuator, the mechanical linkage, and the control unit, most likely due to neglected maintenance to the port transmission and control system.”In a statement, a spokesperson for the Hornblower disputes the NTSB’s findings writing, “Hornblower Cruises & Events continues with safe, daily operations, following the allision of Adventure Hornblower back in 2016. On that day, the initial response of our captain and crew to address all immediate safety concerns and ensure the well-being of all guests aboard, was exceptional. Hornblower has noted several inaccuracies in the NTSB report on this matter, and therefore disagrees with its determinations as to the probable cause of the allision.  Due to ongoing product defect litigation, Hornblower cannot comment further at this time. Hornblower, deeply appreciates the amazing loyalty of our customers and guests over the years, and we continue to work with care and diligence, every day, to deliver on that trust.” 2739

SAN DIEGO (KGTV) - A grieving mother says the flu was the main cause in the death of her healthy teenage son.Cellphone video captured a smiling Brian Finete, 19, surprising his mother with flowers for her birthday last Tuesday night at their home in Clairemont."The moment was special. He was always a happy boy with a big heart. He loved life and always wanted to make people happy," said Maria Finete.Later that night, Finete played Xbox all night with his friend at his home. Just past 4 a.m., he went to the bathroom. About two hours later, the friend woke up and went looking for him. Finete was found collapsed in the bathroom."I started screaming, said to call 911. I start CPR," said Maria.Finete was rushed to a hospital, but was declared brain dead a few days later. He was taken off life support on Saturday."We have no words to describe this. We don't understand why," said Maria.Finete, who had no known underlying conditions, tested positive for influenza B. Doctors told her the flu had spiked his blood sugar levels, and the combination of the flu and the high blood sugar levels caused him to collapse and stop breathing. "I never thought in my mind my kid would die from that," said a tearful Maria.She says her son had few symptoms. He had a lingering cough from a cold from last month. The night before he collapsed, he woke up in a sweat next to his girlfriend."When he sleeps he always sweats a little bit. He did tell her, 'I'm not feeling that good,'" said Maria.She says he didn't have a fever, took ibuprofen for a headache and seemed fine that Tuesday night. He was discovered hours later."Just so hard to see my baby gone. Don't know what to do without him," said Maria.Amid the grief: the pain of 'what ifs.' Her son decided not to get a flu shot this season, despite almost always getting it in the past."Take it. Take the flu shot if you can," said Maria. SAN DIEGO (KGTV) - A former gang member who turned his life around in stunning fashion just got accepted to four different universities, including UC Berkeley and UC San Diego. 10News first met Apollo in 2010, as he and several others went to court to get off a gang injunction list for an Oceanside street gang.  An injunction prevents gang members from doing activities in certain areas, like associating with each other.  At that time, Apollo told us he had been out of the gang for several years after four years inside as a teenager."What hurt the most is hurting my mother... You want to amount to something, so (when i decided to get out) I'm trying to do this for her," said Apollo.Apollo was removed from the list about a year later, which is a rare feat. Among the requirements: written explanations, background checks, and approval from prosecutors and a judge.Since then, he has gone on to Palomar College, earned awards at speech and debate competitions, and at the age of 30, he just got accepted to four schools, including UC Berkeley and UCSD.  He's leaning towards Berkeley, though he isn't sure he can pay for it.  He's hoping to have a career in communications or social welfare so that he can help his community."Sometimes I can't believe it and sometimes I feel I should be doing more.  You want to leave something for them to look at, to hopefully inspire them to do more and succeed," said Apollo. 1473

SAN DIEGO (KGTV) - A former La Jolla restaurant owner convicted of raping multiple women was sentenced on Tuesday to 40 years in prison.On a live stream to the courtroom while sitting in jail, Daniel Dorado was read his term after several women gave their victim impact statements.The former owner of Voce Del Mare was found guilty last December on 20 counts related to rape and sexual assault of four victims who were unconscious and intoxicated. ABC10 News broke the story two years ago when he was charged with drugging and raping women, sometimes at his restaurant.Fighting back tears on Tuesday, one victim described her trauma from meeting Dorado after answering an ad on Craigslist for a hostess position. "Years after the assault, I still don't feel safe going to job interviews in-person, alone. I don't feel safe to do outdoor activities alone. I can't tolerate being around men. Not even family," she stated."He is an evil individual," said another woman who added, "I simply went on a date with him and ended up getting sexually assaulted by him for hours in a hotel room where I was unconscious."One woman who was named as a victim defended Dorado on Tuesday and said that she was even friends with him. She accused detectives of manipulating her to testify against her will and appear confused about a possible assault. She told the judge, "Your honor, Mr. Dorado never raped me. I never went to the police. I never filed a police report. In fact, I declined a restraining order against Mr. Dorado and I told detectives that I did not want to press charges."Dorado addressed the courtroom and denied any wrongdoing. He added, "I have spoken the truth since the very first day that this all began. I did not skip town. I did not make faces to the accusers. I am still in shock by what has happened." He maintains his innocence and has said that every sexual encounter was consensual."The total term of imprisonment is 40 years. I don't mind saying [that] I believe this is the maximum I can impose under the law," the judge told the courtroom.
