SAN DIEGO (CNS) - A bill that would keep court hearings related to the release of Sexually Violent Predators open to the public was unveiled Tuesday by a state senator who worked with the San Diego County District Attorney's Office to craft the legislation.SB 1023, dubbed the Sexually Violent Predator Act, would prohibit proceedings related to Sexually Violent Predators -- or SVPs -- from being held behind closed doors, particularly when the hearings involve potentially releasing the offenders to a conditional housing program in the community.Recently, hearings regarding the proposed release and placement of SVP Alvin Ray Quarles, 57, otherwise known as the "Bolder-Than-Most" rapist, were held behind closed doors in San Diego County Superior Court.Judge David Gill kept the hearings under wraps due to privacy concerns over the potential disclosure of Quarles' psychiatric reports.The closed-door nature of the hearings drew protests from victims' advocates, include two of Quarles' victims, Mary Taylor and Cynthia Medina.Sen. Patricia Bates, R-Laguna Niguel, who authored SB 1023, issued a joint statement with San Diego County District Attorney Summer Stephan, saying SVP hearings should be held in open court "unless compelling and extraordinary circumstances justify closing the courtroom to the public.""District Attorney Summer Stephan and I believe that court hearings for sexually violent predators should be open to the public unless a judge can provide a compelling reason," Bates said. "Victims, their families, and the public have a legitimate interest in witnessing hearings through which a predator might be released."Gill ruled last year that Quarles should be released to a conditional housing program, though that decision is currently being appealed by the District Attorney's Office.Quarles, who was previously sentenced to 50 years in prison for committing more than a dozen sexual assaults in the mid-to-late 1980s, was slated to be housed at a residence in Jacumba Hot Springs, but that agreement fell through."This important legislation supports the principles of democracy and transparency in our justice system by making sure court hearings for sexually violent predators are open to the public," Stephan said. "As District Attorney, I hear the pain from victims who've been terrorized by a sexual predator but are left in the dark and not able to learn pertinent information guaranteed to them by our open courts system."The bill is awaiting referral to a Senate policy committee, Bates' staff said. 2544

SAN DIEGO — A couple who evacuated from the Woolsey Fire in Los Angeles says their Airbnb hosts kicked them out of their unit and cleaned out all their belongings, forcing them to live with relatives in San Diego.Ben and Jessica Wells said they rented out the Airbnb unit in July, paying in advance through May.The newlywed couple had been living there as they searched for a home to buy.It was a studio apartment located in West Hills, a community on the western edge of the San Fernando Valley, which backed up to where the Woolsey Fire was burning.“I could see the fire burning on the hill. I saw the smoke,” said Ben, who got an evacuation alert on his phone while at the gym.He went home to meet his wife, frantically packing up some important belongings.“We were not trying to check out of the place at all. Obviously things were a mess, clothes were everywhere. We were just trying to basically make sure we had everything we needed just in case everything burnt,” said Jessica.After they left, the Airbnb hosts contacted them to see if they could go inside the unit and turn off the lights. Ben said he agreed to let them in for that purpose.But once inside, owners Larry and Jeri Hannah said they were shocked by what they saw.“I don’t even know how they were living there,” said Larry. “We couldn’t believe the mess we saw.”In addition to the clothes scattered about, the Hannahs say the grout on the tile floor in the bathroom had been stained black. They said the walls needed painting and some of the flooring needed to be replaced.“When It became obvious that we weren’t going to let them come back then we just decided we were going to clean it up because we didn’t want to leave it like that,” said Larry.In order to do that, they removed all of the Wells’ belongings and told them the rest of their reservation had been canceled.The Wells said they agreed to pay through the end of November if they could keep their stuff there. But when Ben arrived on November 17, he said he was surprised to see their belongings strewn across the property.Expensive recording equipment had been left outside, he said. Other belongings had been thrown in trash bags. Some appeared to be missing.“At that point I was in shock, just completely shaken,” said Ben.He grabbed what he could find, not knowing that more of their belongings had been stored in a shed on the property.“Their stuff is all still here,” said Larry.In a statement, a spokesperson with Airbnb wrote, “We are urgently investigating this incident to better understand what happened. SAN DIEGO (AP) — A California tribe whose ancestral lands span across the U.S.-Mexico border is suing the Trump administration to block construction of a section of border wall that the Kumeyaay people say is desecrating sacred burial sites. The La Posta Band of Diegueno Mission Indians filed the lawsuit in federal court in San Diego on Tuesday seeking to temporarily halt construction of the wall until the tribe can protect its religious and cultural heritage. La Posta is one of 12 bands of the Kumeyaay people. The tribe wants its members to be able to monitor work and interrupt it to recover human remains and cultural items uncovered during construction. SAN DIEGO — The economic fallout from the novel coronavirus is leading to increased opportunities to buy a home or refinance one currently owned. Freddie Mac reported Thursday that the average rate for a 30-year fixed mortgage was 3.29 percent, the lowest in its 50-year history.That's down from 4.41 percent one year earlier. "Anytime there's any sort of any big natural disaster, war threat, that type of thing, the Wall Street money seeks safe havens, and that tends to drive rates down," said Scott Harmes, a senior loan officer at C2 Financial Corp. He said refinances should be evaluated on a case-by-case basis, depending on how much a household owes, how much longer the loan will last, and how long they plan to stay in their home. For those in the market to buy, the lower rates come just as San Diego will enter the spring peak homebuying season. Realtor Michelle Silverman said the higher rates could make the market tighter, but that homes still need to be priced appropriately."A seller can't be greedy," said Silverman, of Coldwell Banker. "If you have a greedy seller, the house is going to stay on the market. If the property is priced right, you're going to get multiple offers, maybe even go above list price, and it will move.
