WEST SENECA, N.Y. — Prosecutors have charged a West Seneca man with criminally negligent homicide after a dispute over wearing a face covering left an 80-year-old man dead.Donald Lewinski, 65, of West Seneca, was taken into custody Monday following an incident on Sept. 26 at Pamp's Red Zone Bar and Grill.According to Erie County District Attorney John Flynn, Lewinski got into a verbal confrontation with Rocco Sapienza — another regular at the bar — after Sapienza noticed Lewinski was not wearing a mask while bringing buckets of beer to a band playing outside.At one point, prosecutors said Sapienza got up and confronted Lewinski. That's when Lewinski stood up and pushed Sapienza "hard" with both hands, the D.A. said. Sapienza fell back and hit his head on the ground.Sapienza was taken to Erie County Medical Center, where he was unresponsive for four days. He died on Sept. 30.The cause of death is blunt force trauma to the head."We are all deeply saddened by the loss of Rocco. He was a part of our Red Zone family and loved by all," the owner of Pamp's Red Zone released said in a statement. "Our deepest sympathies go out to Rocco's family."Lewinski is set to appear in West Seneca Town Court Tuesday night.A celebration of life for Sapienza will take place Tuesday at 11 a.m. at the Southtown Christian Center.This story was originally published by WKBW in Buffalo, New York. 1398

With his spring break just hours away, Central Michigan University student James Eric Davis Jr. was with his parents in a campus residence hall Friday morning when he shot them dead, police say.Davis Jr., 19, shot and killed his mother and father in the dorm on the northwestern edge of campus Friday morning, authorities said, leading to an hours-long manhunt that ended with his arrest early Saturday.It was the nation's 12th school shooting this year.It's not immediately clear what led to the shooting or why the parents, James Eric Davis Sr., 48, and Diva Jeenen Davis, 47, were on campus in Mount Pleasant, a roughly four-hour drive from their Chicago-area home.But authorities said the student had an encounter with police hours earlier -- on Thursday evening when he was taken to a hospital for what officers believed was a bad reaction to drugs, campus police Lt. Larry Klaus said.And the parents may have been intending to pick up their son for spring break, said Andre Harvey, mayor of the Chicago suburb of Bellwood, where the elder Davis was a part-time officer."The family is in shock and trying to piece everything together," a relative, speaking on condition of anonymity, told CNN.Arrest comes after midnightDetails about the younger Davis' arrest weren't immediately clear. But it came early Saturday after someone reporting seeing him on or near campus, the university said."The suspect was seen and reported by an individual on a train passing through the north end of campus shortly after midnight," the university said in an online statement. "Law enforcement personnel responded and arrested the suspect without incident."The shooting, which happened on Campbell Hall's fourth floor around 8:30 a.m. Friday, disrupted a campus that otherwise was winding down for a nine-day spring recess beginning Saturday.Students were told to stay in campus buildings until the afternoon when police officers started allowing them to leave. People trying to enter the campus to pick up students for spring break were initially directed to a campus-area hotel, where the university asked them to wait for instructions.The university's men's basketball home game Friday against Western Michigan University was rescheduled for Saturday morning at a neutral site, Northwood University, where it will be closed to the public except for family members, the Mid-American Conference said.The university, with roughly 23,000 students, is about a two-hour drive northwest of Detroit.Student had 'drug-related' incident earlier, police sayCampus police spoke with Davis Jr. on Thursday night, Klaus said during a news conference."At some point in the evening, he was transported to McLaren Hospital due to what the officers believed may be a drug-related-type incident, an overdose or a bad reaction to drugs. At that point he was released to the hospital staff," Klaus said.As for Friday's shooting, "we're calling it a family-type domestic issue at this point," he said.The victimsThe Davis family was from the Chicago area. Davis Jr. graduated from a high school in Plainfield, Illinois, about 30 miles southwest of Chicago, in 2016, said Tony Hernandez, Plainfield school district spokesman.His father was a part-time police officer in Bellwood for 20 years and assisted the department on special occasions."He was always there when you asked for him to be there," Bellwood police Chief Jiminez Allen said.The elder Davis was a pillar of the community, which has 20,000 residents, and was beloved by friends and neighbors, said Harvey, Bellwood's mayor.An Army veteran, he was also a police officer employed at the Jesse Brown VA Medical Center in Chicago, said center director Marc Magill."The staff at Jesse Brown VAMC take enormous pride in the care we provide our Veterans, and this situation hits us especially hard. With just eight days until election day and despite attempts at parliamentary roadblocks by Democrats, Senate Republicans easily confirmed Judge Amy Coney Barrett to the Supreme Court on Monday.On Sunday afternoon, the Senate voted 51-48 to advance Barrett's confirmation, which opened a final 30 hours of Senate debate. Senate Majority Leader Mitch McConnell directed the Senate to work overnight to complete the process by Monday evening. According to CNN, President Donald Trump is expected to swear-in Barrett at a ceremony at the White House at 9 p.m.Sen. Susan Collins, R-Maine, was the only Republican Senator set to vote against Barrett's confirmation. The final tally was 52-48.Meanwhile, Democrats' repeated attempts to delay the process have proven futile. On Thursday, Democrats on the Senate Judiciary Committee chose to boycott a vote that sent the vote to the Senate floor. And since Senate Republicans changed parliamentary rules to prevent the filibuster of Supreme Court nominees in 2017, Democrats have little recourse to further block Barrett's confirmation.The push to fill the Supreme Court seat vacated by the death of Justice Ruth Bader Ginsburg stands in stark contrast to 2016, when Republicans chose not to hold confirmation hearings for President Barack Obama's nominee to replace Justice Antonin Scalia for more than six months prior to a presidential election, saying that the American people should decide who fills the vacancy.Barrett's confirmation would give conservative judges a 6-3 voting edge on the court, which could significantly shape policies and precedents for a generation. 1626

  

Wildlife biologists with the Conservancy of Southwest Florida shared a shocking python find in Collier-Seminole State Forest on Thursday. An invasive Burmese python's eyes were a little bigger than its stomach when it decided to devour a white-tailed deer fawn. Officials say pythons have been known to kill and ingest large prey and this was a record breaking meal.  Officials stumbled upon the python with the massive prey inside. The biologists removed the python out of the wild into an open area and the python was stressed so it pushed the deer out of its mouth. In the photo below you can see the breathing tube and tongue of the python as it has its mouth wrapped around the deer. Biologists believe it is the largest python-to-prey ratio documented. The python was 31.5 pounds and the deer was 35 pounds; 111% of the python's mass. The findings will be published in the March 2018 issue of the Herpetological Review.“This observation is another important piece of evidence for the negative impact invasive Burmese pythons are having on native wildlife across the Greater Everglades Ecosystem” said Ian Bartoszek, Conservancy of Southwest Florida wildlife biologist. “Imagine the potential consequences to the state and federally protected Florida panther if Burmese pythons adversely affect the number of white-tailed deer, a panther’s primary prey.”Biologists are focused on the impact the python is having across the food chain. Since 2013, the Conservancy and its research partners have been conducting research to document the invasive Burmese python's biology and behavior in Collier County, including the tracking, removal and necropsy of captured pythons.Kelly Bazzle is the Digital Executive Producer at Scripps Station WFTS.
