SAN DIEGO (KGTV) - The family of a YouTube star who drove his McLaren the wrong way on the 805 last year, killing a mom and her daughter, are suing the City of San Diego, County of San Diego, and the Psychiatric Emergency Response Team (PERT).The lawsuit claims the “horrific and tragic event” was entirely preventable.Eighteen-year-old Trevor Heitmann, known as McSkillet, drove his McLaren the wrong way on the freeway in August 2018, killing Aileen Pizarro and her 12-year-old daughter Aryana. The sports car collided with the family's SUV, which burst into flames.RELATED: Autopsy details mental state of McSkillet before deadly crash on Interstate 805 in San DiegoIn the lawsuit Heitmann's family claims "SDPD was warned by Plaintiff's on the day of, but before his death, that Trevor intended to drive his McLaren at a high rate of speed in the wrong direction on a public roadway, under the delusion that he (Trevor) could drive through vehicles traveling in the opposite direction without incident."Worried about their sons' dangerous intentions and fearing for his well-being, as well as the safety of others, Dr. Mary Rusher, a board-certified psychiatrist, called 911 and made a 5150 request for a psychiatric hold, the lawsuit alleges.The lawsuit claims, "Defendants' purported PERT response team conducted either or both no assessment or the wrong assessment of the mental health status of Plaintiffs' son Trevor, pursuant to and under California Welfare and Institutions Code 5150."RELATED: YouTuber's parents requested psychiatric evaluation before deadly I-805 crashIt alleges, defendants also failed and refused requests to take Heitmann into protective detention to transport him to a designated evaluation and treatment facility."As a consequence, and despite Plaintiffs' attempts to ensure their son's safety and the safety of others by blocking the driveway of their residents, Trevor later that day left his residence and drive the McLaren to the Interstate 805 Freeway where he was killed in the beforementioned collision, which also tragically took the lives of the Pizarros."A spokesman for the County of San Diego told 10News they couldn't comment.RELATED: Son remembers mother and sister after release of driver's autopsy in deadly 805 crashAs of this writing, officials with the City of San Diego and PERT have not responded to 10News requests for comment.This is the third lawsuit filed regarding the 2018 crash. SAN DIEGO (KGTV) -- The COVID-19 pandemic has brought uncertainty to school districts across the state. With health conditions changing daily, so does the look of your child's education in the fall.This week an announcement of 100% distance learning from the state's two largest school districts sent some parents into an immediate panic."I was very taken aback," said San Diego mom Leona Smith.How long will classes be virtual? At this point, there's not a clear-cut answer. Parents are left with a lot of questions about how virtual and hybrid programs will impact their kids' education and their family."What are the resources going to be? How is it going to be laid out? What is the time spent? Is it going to be more structured through the distance learning than I felt it had been?" Smith said.Los Angeles Unified and San Diego Unified school districts made their course public, while other districts are still determining what the first day of school will look like, and some already have students back on campus.Statewide, there is no one-size-fits-all answer, but there are requirements districts need to follow."Most parents don't know there is a minutes requirement for each day," said Kevin Gordon with Capitol Advisors Group. "There's actually an annual minutes requirement that we have to hit for kids, and then there's actually a minimum number of days per year that we have to hit – 180 days, generally, and 180 minutes, generally."Gordon said a school day requires a minimum of 180 minutes or three hours of education at lower grade levels and 240 minutes or four hours for high school students.Gordon said those are minimum time standards and most districts exceed that.Reporter Adam Racusin asked him about class sizes."While they are lower than they used to be, they aren't the 20 to 1 that we would like them to be. And in all the upper grades they are absolutely exceeding 30 to 1 in most California classrooms," Gordon said.Imagine the challenge for districts that are bringing students back onto campus while following social distancing guidelines."It's not about cutting class sizes in half, it's like cutting class sizes into thirds," Gordon said.Another area of concern surrounds students who may need more support and instruction than they can get through typical distance learning.In California, once a child is found eligible for special education, the family will participate in the process by attending an individualized education program or IEP. It's both a process and a written document."It becomes almost like a contract and it says here's what the school district is going to do for the student" said special education attorney Timothy Adams."Parents really need the school district to help them, especially in circumstances where the student has really complex needs and requires a variety of in-person, therapeutic services that are delivered usually through their IEP. We need the school districts to implement those services," he explained.Many parents will have to wait for answers, while districts work to make plans flexible enough to adapt to changing community conditions.We reached out to the California Department of Education about guidance for districts regarding hours of learning a day, class sizes, and special education and did not hear back. 3304

SAN DIEGO (KGTV) — The environmental community is concerned that individuals using masks are disposing of the face-covering properly.Dimitri Deheyn is a Scripps Institution of Oceanography research scientist and studies biodegradable objects, something disposable masks are not. He said around the world, researchers are seeing an increase in trashed masks on beaches, which will ultimately end up in the ocean and harm wildlife and our ecosystem.In addition, when the disposable masks are thrown away, the string can become a danger to animals if not cut, so he said if you have to use disposable masks, cut the string that goes around the ear.Deheyn has been working with a company based in Austria called Lenzing that typically makes eco-friendly comfortable clothing from fibers that can degrade, making them better for the environment. He said the company shifted to making biodegradable masks when the pandemic hit, and he’s helped test them.“Basically test them, we put them in the seawater and see if they degrade and yes they degrade,” he said.He said there are U.S. companies that make a similar product, and this is what people should be wearing instead of disposable masks. He said reusable masks are another solution to helping save the environment.“If you are acting as an individualistic human being, and you oppress nature, at the end this could be very bad for us as a human society,” he said, encouraging everyone to do their part. 1457
