A New York appeals court has denied a motion by President Donald Trump's attorney to stay the Summer Zervos defamation case pending appeal, meaning the gathering of evidence known as "discovery" can move forward as both parties await a ruling on the appeal.Zervos, a former "Apprentice" contestant, filed a lawsuit against Trump in January 2017 in which she alleged that Trump defamed her in 2016 after she said he sexually assaulted her in 2007.Trump's lawyer, Marc Kasowitz, is appealing the March 20 ruling by New York Supreme Court Justice Jennifer Schecter, who allowed the case to go forward. He wants the appellate court to revisit the matter of whether the Constitution's Supremacy Clause bars a state court from hearing an action against a sitting president -- what would be considered immunity, because it would make the President immune from suit. Schecter ruled it does not. Kasowitz also argues that Schecter erred in denying the President's motion to dismiss or delay the case on First Amendment grounds.Kasowitz said his motion should be granted on the grounds that New York and federal law both mandate a stay pending appeal, that proceeding with the case could irreparably harm Trump, and that the temporary suspension being sought was not designed to delay the case. A Vero Beach, Florida family woke up to a man stomping on their roof, the Indian River Sheriff’s Office says. When deputies arrived, they say Jacob Futch claimed he was having a meeting with a DEA agent on the roof.The family told deputies that they don’t know Futch, and Futch admitted to not knowing who the agent is, according to an arrest report. A man living in the home told deputies he and this three young sons woke up to Futch yelling, howling and walking down the road around 6 a.m. on Nov. 11.Two hours later, the man says they woke up again after hearing Futch on the roof of his home.When Futch was asked if he was under the influence he said he had injected meth at approximately 2 a.m., an arrest affidavit states.Futch is facing a misdemeanor charge of trespassing. A suspect who had barricaded himself on Tuesday in his Panama City, Florida, home after an earlier shooting was later found dead in the residence, authorities said.The Bay County Sheriff's Office identified the dead suspect as 49-year-old Kevin Robert Holroyd.One person had a minor injury and was transported to a hospital, city spokeswoman Caitlin Lawrence said earlier Tuesday.The hunt for Holroyd, who was wanted in connection with a homicide in Santa Rosa Beach in Walton County, ended with his death about 57 miles southeast in Bay County, after he opened fire on police, the Bay County Sheriff's Office said.Authorities did not say how Holroyd died.The Bay County Sheriff's Office and Panama City police began searching for Holroyd in case he returned to Bay County. Investigators started watching Holroyd's townhome apartment after his vehicle was seen there. During that time, a complex resident called the fire department to report a gas smell, the sheriff's office said.The investigators got out of their cars to find out why firefighters had arrived in the complex parking lot, authorities said.From an upstairs window of the apartment, Holroyd opened fire on the firefighters and investigators, and other responding officers, including Panama City police, the sheriff's office said.About 100 rounds were fired during the gunbattle, the sheriff's office said.At one point, two Panama City officers and a sheriff's deputy were pinned down behind their vehicles by the gunfire, the sheriff's office said.Photos from Eryn Dion of the Panama City News Herald showed a heavy police presence in the area during the standoff.Stacie Houchins said she did not see the incident start, but she decided to go to the scene to see what was going on.
