A conservative legal group has filed a lawsuit against Maricopa County claiming that votes were disqualified because some people were given a Sharpie to fill out their ballots. The legal group, Public Interest Legal Foundation, says that the ink from the Sharpies bled through the ballots causing them not to be counted. The Maricopa County Recorder’s Office and the Secretary of State, however, both say concerns that surfaced Wednesday over the use of Sharpies are unfounded. Officials spoke out Wednesday morning, saying the use of a Sharpie to fill out a ballot is perfectly fine and no votes would be discarded for that reason. Did you know we use Sharpies in the Vote Centers so the ink doesn’t smudge as ballots are counted onsite? New offset columns on the ballots means bleed through won’t impact your vote! She claims she was told to submit the ballot anyway, and that it was denied. Neither the Secretary of State's Office nor County Recorder's Office have given any information on whether or not there was a separate issue that caused Aguilera's ballot to not be accepted. The questions over Sharpie use on ballots came as ABC News reported Wednesday that Gov. Doug Ducey told the White House he “sees something” that could get Arizona and its 11 electoral votes in the win column for the President. FULL RESULTS: Track election results in ArizonaArizona Secretary of State Katie Hobbs is on the record defending the Sharpie ballots, though a ballpoint pen is the recommended method for filling out a ballot.Sharpie is the trademarked name of a permanent felt tip marker. Its use on Arizona ballots became a prominent conversation point on Twitter overnight. The Maricopa County Elections Department says even if marks made by Sharpies or any felt tip marker on a ballot bleed through the paper, it won't impact their tabulator's ability to read contests. Maricopa County's tabulators are designed only to read the ovals for each contest, according to county election officials. Even if ink bleeds through to the other side of the ballot, the ink won't mark another contest, since ballots are printed in an "off-set" pattern, meaning contests on the back side of the ballot don't align with those on the front.Republicans and the Trump campaign were shocked when Fox News declared Democrat Joe Biden the Arizona winner at about 9:30 p.m. on Election Day. Ducey Tweeted his displeasure as Fox News election analysts defended the decision. Arizona remains too close to call in most media projections, but AP called Biden as the winner early Wednesday. ABC15 data analyst Garrett Archer says as votes are counted, the President will likely pick up more votes than Biden and the Democrat’s lead will shrink. It’s unclear if the President can overtake Biden, who is riding the wave of record early voting that favors Democrats. Tabulation continues throughout the state, focusing on ballots that were dropped off on Election Day and those that arrived by mail and were not part of the early counting process that began October 20. In just a few days, New York could be the first state in the country to ban declawing cats, unless it's for medical reasons. Cities like Los Angeles and Denver already outlaw it. Dr. Aubrey Lavizzo, with Paw Project Colorado, stopped declawing cats years ago, and he helped lead the charge to banning it in Denver. “It's a mutilation,” he says. “Basically, partial digital amputation is an amputation without cost. That's a mutilation, so it's cruel for that reason.” That's why he's excited to hear New York might become the first state in the country to ban declawing. Gov. Andrew Cuomo has to sign the bill that would forbid declawing for "cosmetic or aesthetic reasons." If the bill becomes law, those who violate it could face a ,000 fine. “Finally it's going to happen, and once that happens, I think it will create a domino effect. I'm pretty sure it will,” says Dr. Lavizzo. The New York Veterinary Medical Society opposes the bill, arguing that declawing should be allowed "when the alternative is abandonment or euthanasia." The group released a statement, saying in part "cats that would lose their home if not declawed face a higher risk of euthanasia than if their owner were able to care for them." However, Dr. Lavizzo says cat relinquishments have dropped 20 percent in Denver since the ban. “I'm not saying that's connected, but it does say that you know people are not relinquishing your cats because he can't get them declawed in Denver,” Dr. Lavizzo says. Dr. Lavizzo says he's excited for the future.California, New Jersey and Massachusetts are also considering bans. 1605

Jaqi Wright and Nikki Howard will tell you their new business is anything but a piece of cake. “Trying to get ahead of everything has been a challenge,” says Howard. Last month, the sisters started selling their homemade “furlough cheesecakes” as a way to help pay bills during the longest government shutdown in history. Thanks to word of mouth, their business, The Furlough Cheesecake, took off and hasn't slowed down. They even got a boost in business when Ellen DeGeneres surprised the sisters by having them on her show. Ellen gave them ,000 to help with their business. It didn’t stop there. They got another surprise this month from one of the largest companies in the world. “We found ourselves at Walmart, being able to present our cheesecakes for a tasting,” Howard says. The meeting and taste test went well with Walmart. “Their plans are to get us in the stores before the end of the year,” Wright says. “And she told us, ‘This doesn't happen. There are people who have been waiting over year, standing where you're standing, making this presentation.’ And we came with our A game.”Walmart says the cakes will eventually be sold in stores and online. 1179

A Southern Arizona school district is taking a creative approach to better sanitize the classroom daily.Santa Cruz Valley School District bought six Power Breezers that will disinfect a classroom in 20 minutes.Superintendent David Verdugo said the school district did this as a cost effective way to provide extra safety and security to students and staff. He said it will be used after school to clean empty classrooms, hallways and even school buses. Each unit costs about 4,500 dollars."This is an opportunity for them to look at a way to sanitize a room in a short period of time and utilize their staff but also be cost effective," Superintendent Verdugo said.He said the district is also requiring all students to wear masks, have their temperature checked, and social distance in and out of the classroom.Every classroom will only be at 50% capacity, meaning 15 desks per room, he said. In order to do this, the district came up with a hybrid approach to learning."There will be a group A and a group B," Superintendent Verdugo said. "The group A students will be on Monday. They will come to school, have their direct instruction and then they will be at home the next day. Then, group B will come to school, but they will still have some interaction that day with assignments and virtual opportunities."He said the district is planning on starting remote learning on August 3 and then the hybrid approach will being on August 31. KGUN's Veronika Vernachio was first to report this story. 1517
