ESCONDIDO, Calif. (KGTV) — First it was toilet paper and now there are reports of a shortage of outdoor recreational equipment, specifically kayaks. But one local business owner says San Diego is ready to meet the demand during the COVID pandemic. Bruce Damon, the owner of Nomad Ventures in Escondido, says after a 10-week shutdown they are back serving outdoor enthusiasts."We're just hoping that people can get out and enjoy themselves safely, and kayaking was one of the first things that I understood was considered a safe endeavor," says Damon.In what came as a surprise to Damon, he saw media reports saying kayaks were in short supply due to the COVID-19 pandemic. That hasn't been the case at Nomad Ventures"We've had the busiest year as far as I can remember in terms of kayaks selling a lot of kayaks here," Damon said. So to say there is a kayak shortage, at least in San Diego, would not be accurate as far as Damon is concerned."Our shutdown was right when we were at complete inventory," Damon said. "Stock levels were high, and when we reopened, we had stock."He was quite alarmed when customers were steered towards shopping online when his shop was completely full of outdoor products. "We have back stock in storage units that we pull from to restock the store. We just picked up a new load of five kayaks, so we are fortunate that we have product," Damon said.His message to customers in the market for a new kayak is quite simple, shop small business and local."We've been in business 40 years, so we felt it was important to get our message out. ENCINITAS, Calif. (KGTV) -- Two women were rescued from a cliff in Encinitas early Sunday morning. San Diego Fire-Rescue was called to the cliffs around 2:20 a.m.According to the department, two women climbed down the cliffs and were unable to get back up. The department says the women were about a 30-foot drop away from the beach. Crews were able to carry the women to the top of the cliff in about an hour. It’s unclear if alcohol or drugs were involved in the incident. 483

Employers may soon be able to require workers who make tips to share that money with other staff. It's part of a new regulation from the Department of Labor.The agency says the rule could help increase pay for back of house staff, like cooks and dishwashers who have historically been excluded from tip pools.The rule says pooling is only allowed if the tipped employee makes the full federal minimum wage.Federal law allows tipped workers to make .13 an hour, as long as they earn enough tips to match the minimum. State laws vary on that point, though.The rule also gets rid of a guideline that said tipped workers must spend at least 80% of their time doing tasks that earn them gratuity.The National Restaurant Association has praised the rule, calling it a win for the industry because it clarifies laws under the Fair Labor Standards Act.“Today’s Department of Labor (DOL) final rule revising tipping regulations under the Fair Labor Standards Act (FLSA) is a year-end victory for the restaurant industry and its workers after years of litigation," said the National Restaurant Association in a statement. "The changes in this rule bring much needed regulatory clarification for the small business owners and their employees about what the law allows and requires. At a time when the restaurant industry is faced with instability, this rule provides renewed sensible regulations on tip-pooling and tip-credit standards.”We spoke to an employment attorney named Louis Pechman who founded WaiterPay.com. He said there may be some clarification in the rule, but that's not the big issue.“Tips traditionally have been viewed by management as kryptonite. Don't touch the tips, servers' tips, stay away. That's my money. Now you have a whole situation where servers, it's my money. The tip was left for me. Why am I paying a cook in the kitchen?” said Pechman.The Economic Policy Institute has estimated the rule would let employers take 0 million from tipped workers each year. That's based on numbers before the industry suffered under the pandemic.As Pechman points out, some local laws are very protective of employee tips and will supersede federal regulations.“So, it's important if you're analyzing the issue, is there a state regulation, is there a city regulation which gives more protection to workers than the FLSA does?” asked Pechman.The rule is set to go into effect in 60 days. FALLBROOK, Calif. (KGTV) -- A North County baker who has lost thousands of dollars due to postponed or canceled weddings is trying to help neighbors and keep her business afloat at the same time. Jennifer Duarte said owning a bakery is a dream she’s had since she was a child.“There was a bakery close to my house and the lady worked in the window,” said Jennifer Duarte, owner of Elegance on Display. “I would go and I would just stand there and watch her and said, when I grow up I want to do that.” That’s what she did. She has owned Elegance on Display in Fallbrook for 15 years. With the COVID-19 pandemic—and her specialty being wedding cakes—she’s lost a decent chunk of income.“I had 50 weddings postponed… maybe eight of those are canceling completely,” Duarte said. She has three employees, two of which she had to lay off. She hopes to be able to rehire her employees, but for now, she’s just trying to stay in business. With some items, like eggs, hard to find on store shelves, she’s using her connections to provide a service to her neighbors and also make some up some of her lost income. “We can order bulk through our bakery supplier. Last week, I got flour, sugar, eggs, and butter,” Duarte said. She repackages it in smaller amounts to sell to her neighbors. She said she isn’t making a big profit, but the community has been great lending their support. “So many people realize that there’s not a huge mark up on it. They’ve been tipping or volunteering to help with deliveries,”she added. Duarte is also still making cupcakes, cookies, and small cakes for people who would like to place an order. “I’m just trying to bring a little joy to everybody who’s stuck at home. Cupcakes [and] cookies make everybody feel better,” Duarte said. She makes deliveries throughout Fallbrook, although you have to order ahead. You can also place an order for pick up.
