(AP) -- The California Supreme Court overturned the 2005 death sentence for Scott Peterson in the slaying of his pregnant wife.The court says prosecutors may try again for the same sentence if they wish in the high-profile case. It upheld Peterson's 2004 conviction of murdering his wife Laci Peterson.Laci Peterson was eight months pregnant with their unborn son, and investigators said that on Christmas Eve in 2002, Scott Peterson dumped the bodies from his fishing boat into San Francisco Bay.The court on Monday said the trial judge made several significant errors in jury selection that undermined Peterson's right to an impartial jury at the penalty phase.The court ruled potential jurors for the death penalty phase were improperly dismissed after saying they disagreed with the death penalty but would be willing to impose it."The trial judge made a mistake by kicking those people off the jury, so the only people that sat on the jury were in the death penalty camp," said criminal defense attorney Gretchen von Helms.Prosecutors will now decide whether to retry the sentencing phase.While the sentence was overturned, the court affirmed the murder convictions. "The sentencing was a positive step. The other decision (convictions affirmed) was about what we expected. Now we go to the habeas appeal," said Lee Peterson, Peterson's father.The court will examine the case again when it decides a separate habeas corpus challenge, based on evidence. not presented at the original trial. Peterson's father declined to talk about the arguments in the appeal, but says he's expecting a development within the next four months.Peterson's family issued this full statement in response to the court's decision:Our family is sincerely grateful that the California Supreme Court recognized the injustice of Scott’s death penalty. For a long and difficult 18 years, we have believed unwaveringly in Scott’s innocence, so today’s decision by the court is a big step toward justice for Laci, Conner and Scott.Now our family will do two things: First, we wait for Stanislaus County District Attorney Birgit Fladager to decide whether to pursue a new penalty phase trial. If the DA elects to do so, a new jury would be seated, and they would hear all the evidence. They would then decide only Scott’s sentence: life without the possibility of parole or the death penalty. While we hope for the opportunity to present the new evidence to a jury, it is not likely that this penalty phase trial will happen. The case against Scott has weakened to the point where no jury would ever sentence him to death again and the District Attorney is aware of these facts.Second, we wait for the court to address the new forensic and eyewitness evidence we have submitted that shows Laci was alive the morning of December 24th and demonstrates Scott’s innocence. (KGTV) - Mexican officials have rearrested two suspects who may be connected to the disappearance of Los Angeles firefighter Frank Aguilar who went missing in Mexico in August.Suspects Santos "N" and Fanny "N" were briefly released from a Baja jail overnight Sunday, according to media partner Televisa which confirmed the update with Mexican authorities.On Monday, ABC10 News interviewed Aguilar’s daughters, 17-year-old Bella and 23-year-old Amaris. “We were extremely devastated last night. It was probably the most hopeless we felt during this entire experience,” said Amaris.They told ABC10 News that their own sources have made significant discoveries about the suspects. They said the female suspect may have been dating their father. Officials have only said that it may have been a kidnapping setup and that the suspects were found in possession of Aguilar’s bank cards which had been used across Baja.“We don't know what happened for sure but after he went missing, between the seven weeks, they have been using his credit cards, his phone and there were blood traces [from] my dad in the location of the investigation,” said Bella.ABC10 News reported last Friday that the two suspects were arrested on Thursday but Aguilar still hasn't been found.Televisa has now learned from Mexican officials that on Sunday a judge allowed for their release but the state investigation agency got another arrest warrant at dawn and the two were apprehended.In September, ABC10 News reported that the 48-year-old's family learned that he may have been violently kidnapped from his second home in a guard-gated community in Rosarito.There were reports that his condo may have been ransacked, his vehicles were missing and Ring video showed a troubling scene.The two suspects reportedly have a new hearing scheduled for Monday night.“These people could be let out on bail and we have no other way of finding information until [they remain] incarcerated so this is our most desperate plea in our most desperate time of need,” added Bella.The San Diego FBI Office told ABC10 News on Monday that their agents are still assisting Mexican authorities with the investigation. 2193

SACRAMENTO, Calif. -- Governor Jerry Brown has agreed to deploy 400 National Guard troops at President Donald Trump’s request, according to the Associated Press.Brown specified that not all the troops will head to the U.S.-Mexico border and none will enforce federal immigration enforcement.The troops will focus on fighting drug crime, firearms smuggling and human tracking, a letter sent to the Trump by Brown Wednesday said.Brown said the troops will not help build a wall or “detain people escaping violence and seeking a better life.”Trump has said he wants up to 4,000 troops to be sent to the border to combat illegal immigration and drug trafficking.Brown said the deployment will happen pending review and approval of the federal government. 758

(AP) — A rookie Sacramento police officer was shot during a domestic violence call and lay wounded for about 45 minutes as the gunman kept officers at bay with bursts of fire, authorities said Thursday. She was finally rescued with an armored vehicle but died at a hospital."We are devastated," Deputy Chief Dave Peletta said. "There are no words to convey the depth of sadness we feel or how heartbroken we are for the family of our young, brave officer."Officer Tara O'Sullivan, 26, was shot Wednesday evening while helping a woman collect her belongings to leave her home. As officers swarmed the area, the gunman continued firing in a standoff that lasted about eight hours before he surrendered.Stephen Nasta, a professor at the John Jay College of Criminal Justice and a former inspector with the New York Police Department, said taking 45 minutes to reach a wounded officer is "unacceptable."If officers couldn't immediately get an armored police vehicle to the scene, he said, they should have commandeered an armored bank vehicle, bus or heavy construction equipment."If there's somebody shot, lying on the ground, you have to do everything you can," Nasta said.If no such vehicle was available, he said he would expect police to use a diversionary tactic such as firing at the home, setting off smoke grenades or breaking a door or window in another part of the home to distract the gunman as other officers rescued the wounded comrade.
