SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135

SAN DIEGO (KGTV) - More local employees are losing their employer health insurance benefits during the COVID-19 crisis.10News was contacted about employees at the San Marcos Veterinary Clinic who were apparently working just as many hours but their medical benefits have been dropped.10News spoke to the owner of the clinic on Thursday who said she was forced to make the tough and emotional call to drop her 13 employees' health benefits, including her own, in order to keep them on the payroll and keep the clinic’s lights on during the pandemic. She said the decision was made out of desperation. Not greed.On Thursday, 10News interviewed Anthony Wright with Health Access California, a consumer advocacy group. “A stay in the hospital for say seven or ten days on a ventilator, which is the treatment for having a severe case of this virus, could be in the tens of thousands of dollars if you're not covered” he told 10News.So, what if you lose your coverage during the pandemic? Wright told 10News that Californians can try COBRA, which temporarily extends your same employer-based health plan, but there’s a downside. “That's a very expensive option for most people,” he added.Wright said a better option could be Covered California, the state's health insurance marketplace that allows individuals to buy coverage at federally subsidized rates.Covered California’s open enrollment period has been extended through June, amid concerns over the virus. “How much Covered California costs is very much dependent on your current income. It's a percentage of your income on a sliding scale,” he said. SAN DIEGO (KGTV) — Police are alerting San Diego State students and neighbors after a man reportedly tried to steal a someone's phone before fleeing in a waiting vehicle.SDSU Police say the man approached the victim at about 9 p.m. in the 5500 block of Hardy Avenue on Wednesday. The man wrapped his arms around the victim and tried to take a cell phone from their hands, police say.The victim crouched down, grabbed their cell phone, and began screaming. A passerby saw what was happening and intervened, pulling the man off the victim.The man then jumped in to rear of a white sedan with tinted windows being driven by a second suspect.Police described the first suspect as a black male who appeared about 30 years old, 6-feet tall, with average build, short curly black hair and short facial hair. He was last seen shirtless, wearing dark-colored pants and basketball-style sneakers.The suspect in the waiting vehicle was described as a 20- to 30-year-old black female, wearing a gray or white shirt and her hair styled in a bun.Anyone with information is asked to call SDSU Police at 619-594-1991. 1109

SAN DIEGO (KGTV) — More people left California than those who moved in last year, according to recent Census data.The data shows that about 691,000 people left California for other pastures around the U.S., while only about 501,000 people moved into the Golden State in 2018.So where did everyone go? Year-over-year, Texas added more jobs than any other state. The state added 283,000 jobs and unemployment fell to 3.7 percent in April, according to The Dallas Morning News. The Greater Phoenix Economic Council's "#CAStruggles" campaign has tried attracting Californians to the desert with the promise of a lower housing cost, taxes, and other financial benefits. A recent UC Berkeley poll found that at least half of California's voters have given either serious (24%) or some (28%) thought to moving. SAN DIEGO (KGTV) — Police have identified the woman shot and killed, allegedly by her boyfriend, at a Point Loma strip mall earlier this month.San Diego Police said 20-year-old Octavia Williams of Phoenix, Ariz., was fatally shot in the parking lot at 4013 W. Point Loma Blvd. just before midnight on Oct. 9.Paramedics transported Williams to the hospital where she died.MAP: Track crime happening in San Diego CountyPolice identified Williams' killer as 41-year-old Joe Bennette Conway. Conway is believed to be Williams' boyfriend, according to City News Service, and the shooting took place after an argument.Conway was described as 5’7” tall and 150 pounds.
