SAN DIEGO (CNS) - A man whose altercation with four off-duty San Diego police officers in the parking lot of a Grantville bar drew attention from local activists alleging excessive force was sentenced Thursday to a three year probation term in connection with cocaine and firearm possession, which includes 90 days in jail and nine months to be served in a work furlough program.Jonathan Felix, 29, pleaded guilty last month to possession of a loaded firearm and cocaine, in connection with the Nov. 7, 2018, altercation outside McGregor's Grill and Ale House just before 2 a.m.The case generated substantial public interest regarding the use of police force rather than for the felony case, in which Felix was accused but never charged with pointing the gun at the officers, prompting them to tackle him to the ground and strike him several times until they were able to seize the pistol, according to prosecutors.RELATED: San Diego man says off-duty SDPD officers assaulted himThe blows rendered Felix unconscious, and left him with a fractured pelvis, fractured hand and cuts and bruising to his head, while one of the officers testified that he broke his hand punching the defendant.In addition to possessing cocaine, Felix was prohibited from possessing a firearm due to theft and drug-related convictions out of Arizona, according to Deputy District Attorney Michael Runyon.Following his 90 days in custody, Felix will continue working during the day at Greystone Prime Steakhouse & Seafood in the Gaslamp Quarter, where he was employed at the time of his arrest. San Diego Superior Court Judge Polly H. Shamoon imposed a suspended four-year prison sentence, meaning Felix could head to prison if he violates the terms of his probation.At a preliminary hearing in February, Officer Anthony Duncan testified that after he and other officers departed McGregor's, they noticed Felix leaving the premises and returning to the parking lot on several separate occasions, both in his Dodge Durango and on a bicycle. He said the officers were concerned that Felix was "casing" vehicles, possibly to break into or steal cars.Felix was exhibiting "odd behavior" and "something didn't feel right (about him)," Duncan said.Officer Jose Rodriguez, who was at the bar with the other men but left before the altercation with Felix, testified that he also felt Felix was looking into vehicles parked in the lot.Despite their concerns, none of the officers called for assistance from on-duty law enforcement until after they restrained Felix, according to Duncan.Duncan said that he approached Felix, at which point the defendant produced a semi-automatic handgun from his waistband and pointed it at him, prompting all four officers to draw firearms on Felix.Surveillance footage from the parking lot of the business captured the physical altercation between the men, but not the purported standoff, which was blocked from view by a parked car. The defendant, who was sitting on his bicycle at the time, backpedaled away from the men, who followed and tackled him to the ground, according to surveillance footage.Felix told investigators after being arrested that he believed the group of men, who he said never identified themselves as law enforcement officers that night, may have been casing his Durango or looking to start trouble.Defense attorney Alicia Freeze argued that her client drew his gun out of concern for his safety, but denied that he ever pointed the weapon at the group. SAN DIEGO (CNS) - Countywide sales of previously owned single-family homes and attached properties fell from July to August while median sales prices ticked up slightly, according to data released Monday by the Greater San Diego Association of Realtors. Single-family home sales fell 7.4% -- from 2,144 in July to 1,985 last month -- while sales of attached properties, such as condominiums, fell 8.6% from 1,100 in July to 1,005 in August. Sales of both property types have vacillated between increases and decreases since May. Median sales prices of both property types have risen fairly steadily for most of the year, according to the GSDAR. Single-family home prices rose 0.5% from 7,000 in July to 0,000 in August, and attached property prices increased 1.2% from 5,000 in July to 0,000 last month. ``The 30-year mortgage rates are approaching the historic lows of 2016,'' SDAR President Kevin Burke said. ``Whether that can give the housing market some relief is still dependent on an increase in our supply of homes for sale. SAN DIEGO (CNS) - A woman died Monday after being injured Sunday when she was hit by a car in Rancho Penasquitos, police said.The San Diego County Medical Examiner says Nang Arm, 37, died after she was taken off life support Monday. Medics responded to a call at 7:07 a.m. Sunday on Black Mountain Road and Carmel Mountain Road, where they found an unconscious woman with face injuries, San Diego police Sgt. Robert Hawkins said.A gold-colored 2006 Nissan Sentra driven by 20-year-old Uvelyn Nunez- Jaramillo and carrying two passengers, was heading south on the 13700 block of Black Mountain Road when the car veered to the right, SDPD Sgt. Tim Underwood said.The car went onto a sidewalk, damaged a fence, then struck the Nang. She was taken to Scripps La Jolla Hospital, Hawlins said.The car continued a short distance down the street, where it also hit a water line before it came to a stop. Nunez-Jaramillo exited the Nissan and walked away.Several passersby stopped at the scene to render aid to the woman and emergency personnel, Underwood said.Detectives determined that Nunez-Jaramillo caused the crash. She was contacted and returned to the scene, where police determined she allegedly was driving under the influence.She was arrested and booked in the Las Colinas Women's Detention Facility for felony driving under the influence and felony hit and run.Detectives also interviewed Nunez-Jaramillo's two passengers, who were released, Underwood said. 1468

SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations takes effect for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight Saturday due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. SAN DIEGO (CNS) - An Arizona man who carried out a series of knifepoint rapes in the city of San Diego 24 years ago, as well as two rapes in Riverside County in 2002 and 2004, was sentenced Thursday to 50 years to life in prison.Christopher Vanbuskirk, 47, of Goodyear, pleaded guilty last year to six rape counts for attacking the women on four occasions between August and November of 1995 in San Diego, as well as two women in the Coachella Valley area of Riverside County in March 2002 and November 2004.Prosecutors said the four San Diego cases occurred twice in the Tierrasanta neighborhood, once in Pacific Beach and once near San Diego Mesa College.
