VISTA, Calif. (KGTV) -- Jury selection is expected to take all week in the trial of former NFL tight end Kellen Winslow II. The San Diego football star and son of Chargers Hall of Famer Kellen Winslow Senior pleaded not guilty to charges that he raped two homeless women in Encinitas last year. He's also charged with raping an unconscious seventeen-year-old girl back when Winslow was nineteen. Prosecutors say he was out of custody on million bail in connection with the felony case when he got in trouble again. Prosecutors say he fondled himself in front of a 77- year-old woman at a Carlsbad gym, asked her if she liked it, and groped her while she was in a hot tub at the same gym.Jan Ronis is a San Diego defense attorney not affiliated with the case, but watching it closely. "From what I've seen at the preliminary examination, everyone that testified seemed to have a lot of credibility. These were older women, you would extend the greatest credibility to that kind of witness," said Ronis. Winslow played ten seasons with the NFL. His defense team is reportedly planning to call two psychiatrists to testify. It's unclear if CTE, or Chronic traumatic encephalopathy will play a role in that defense. Ronis says it might not make a difference. "You can still be responsible for your conduct , criminally responsible, after having sustained a traumatic brain injury or something of that nature. It's different than say, your mental health issue was such that rendered you incapable of understanding the nature of your conduct that you couldn't understand the difference between right and wrong, " said Ronis. (KGTV) - A local couple is defending themselves after having their claims questioned following the release of new surveillance video showing a man allegedly trying to snatch a toddler from their car in a Vista Costco parking lot last weekend.The surveillance video released Thursday night shows 37-year-old Adam Glavinic walking up to the driver's side of the parent’s white SUV. The SUV begins slowly backing out of the stall, and that is when Glavinic reaches for the rear passenger door handle. Glavinic is shown opening the door then quickly shutting it and stepping away as a woman gets out the driver’s seat to confront him. Glavinic doesn't appear to reach inside to grab the boy who was in the backseat, according to his parents.“There's way more to this story that people don't know,” said mother Jennifer Lawson on Friday. She said that she and her fiancé are taking heat from the public after describing the encounter differently from what the video reveals. “We didn't lie. We were told that from everybody who was seeing the incident that he did touch our kid. He did reach his hand in the car. So, that's what we went off of. I didn't see [it] because I jumped out of the car as soon as I saw that guy open up the door,” she told ABC10 News.Earlier this week before the video came out, the couple said the man tried to pull their boy out of his car seat.Glavinic was arrested for attempted kidnapping and being under the influence.In response to community outrage over Glavinic posting bail and getting out of jail the next day, the San Diego County Sheriff's Department published the video in hopes of alleviating concern.The sheriff's office said that, based on the video and other evidence, "the Vista Sheriff's Station believes there is no ongoing threat or danger to our community's children related to this incident."When asked if Glavinic should still be charged, Lawson replied, “I'm not sure. I don't know his intentions. I didn’t know if he was going to kidnap my kid or hurt him. All I know is that it was terrifying and I was scared for my kid's life, safety [and] everything.”The case has been referred to the DA's Office, which is reviewing it. (KGTV) - The man who tried to kidnap a 15-year-old girl in front of her Encinitas home was sentenced Monday to seven years in jail.Jeremiah Owens, 28, grabbed the girl and pinned her to the ground as she waxed her surfboard in front of her home on Neptune Ave in July 2017.Owens tried to drag the girl to a nearby pickup truck occupied by Christopher White, but the girl was able to break free and run home.White was arrested two days after the assault when a witness matched his pickup truck to the description of one which deputies wanted to find. Owens was arrested hours later.RELATED: Men accused of trying to kidnap Encinitas girlOwens could have received nine years in jail, but a judge gave him seven years and ordered him to register as a sex offender for life.White pleaded guilty Tuesday to being an accessory to kidnapping and will be sentenced June 19.The girl and her parents attended Owens' sentencing but did not make a statement. (KGTV) -- Certain businesses in Vista will be allowed to take their operations outdoors in light of the state’s COVID-19 pandemic-related restrictions.Vista officials said a Temporary Emergency Order was issued Wednesday “to relax outdoor use for personal care services, salon and barber shop services, and gym and fitness services to temporarily relocate their existing business operations to an adjacent outdoor area during the COVID-19 pandemic.”The city’s order comes as indoor operations across the state shut down -- effective July 15 -- for gyms, houses of worship, non-critical office businesses, hair salons and barber shops, indoor malls and personal care services.Vista businesses that would like to move services outdoors are asked to contact the city’s Economic Development Department at 760-639-6165 or via email at EconDev@CityofVista.com.In a statement, Vista Mayor Judy Ritter said, “It’s a top priority for the City of Vista to do everything we can to support our local businesses during this pandemic and still protect the health and safety of the community.
